According to Toshakhana Rules 2018, gifts can not be purchased they can only be Retained by paying 50% of the assessed value.

There is a difference between purchase and retain. The term retain is mostly used by software companies, they sale their software in the name of retention, you can not sale further these software, though you can retain them with you.

Diamonds used in watches/pens tend not to be worth all that much individually or collectively if taken off the item.. however as a package it will add value to the item if you are into that kind of thing. EIther way as I understand it, he was allowed to buy it legally then he can throw it in a gutter or sell it or gift it.
