Rare defamation notice by ex-chief justice to Imran Khan

ISLAMABAD: Former Chief Justice Iftikhar Muhammad Chaudhry’s notice to PTI Chairman Imran Khan threatening a defamation suit for hurling unsubstantiated allegations is unique and exceptional.



Although Iftikhar Chaudhry knows more than others for having been in the judicial service for a long time, about the results of defamation suits in Pakistan, he has chosen this trajectory against Imran Khan if the latter doesn’t apologise for his accusations against him.



This is the first time in the history of Pakistan that a former topmost judge has served such a notice on a politician and warned to file a libel suit against him if he did not tender apology for his tirade. Given his track record, Iftikhar Chaudhry is not in the habit of backing out.



What provoked him to adopt this course? Over the past few months, Imran Khan has perpetually hammered him. At one time, his legal advisors particularly top PTI leader and senior advocate Hamid Khan counseled the chairman to desist from subjecting the former judge to wild accusations. He halted the campaign only for a while and then resumed it after some time.



Imran Khan has relentlessly charged that Iftikhar Chaudhry, while serving as the chief justice, rigged the 2013 general elections against the PTI and in favour of the Pakistan Muslim League-Nawaz (PML-N) through the district returning officers (DROs).



He claimed that the top judge addressed the DROs to pat them on the back for the good job as per his will and direction. He also alleged that there was a nexus among Iftikhar Chaudhry, the PML-N and Geo TV to manipulate and maneuver the last polls against the PTI.



Every victim is crying hoarse since long, demanding of the accuser to come forward with solid proof and evidence but he hasn’t, and keeps falling back on the verbal assaults for his propaganda.



The former chief justice maintained total silence on Imran Khan’s lethal campaign. Only once, he trashed the accusations through a curt comment that they were rubbish. He never responded in detail with the PTI chief continuing his attack.



However, when Imran Khan severely slammed former chief justice at his June 27 Bahawalpur public meeting and said that the former judge got a very petty price for the service rendered to the PML-N by getting his son, Dr Arsalan, inducted as the vice chairman of the Balochistan Board of Investment, the son got angry and started taking on Imran Khan in his own style. In this connection, he approached the Election Commission of Pakistan etc., to get certain documents to expose the alleged lies of the PTI chief. Iftikhar Chaudhry remained offstage.



It is evident from the record that as the chief justice he was very reluctant to spare members of the subordinate judiciary to supervise the 2013 polls while Imran Khan was insistent upon engaging them and had repeatedly pressed this demand.



Finally only because of his demand, the then Chief Election Commissioner (CEC) Fakhruddin G Ebrahim had written a letter to Iftikhar Chaudhry to allow the subordinate judiciary to do the election duty. But still the top judge did not agree. Ultimately, the CEC met him and repeated his request. Only then Iftikhar Chaudhry obliged, and thus, Imran Khan’s demand was accepted on the condition that it would be a one-time permission.



As per the famous judicial policy framed under the direction and guidance of the chief justice in 2009, it was decided that in future, the judges would not be allowed to perform election duty, and that they would leave all the administrative jobs in different government departments they were holding at the time. After that, the high court chief justices also stopped to act as provincial governors in the absence of the governors from Pakistan.



When last year the Punjab government was about to hold local elections, deputy commissioners and assistant commissioner were appointed as DROs etc. However, the PTI objected and demanded that the judicial officers should replace them. Nobody paid heed to it in view of Imran Khan’s attack on the judiciary for its role in the 2013 elections.



Before the then President Ghulam Ishaq Khan accepted a Pakistan Peoples’ Party (PPP) demand in the eighties to have the judiciary supervise the polls, deputy commissioners and other members of the bureaucracy used to be nominated as the DROs, ROs and Assistant ROs.



The standing and credibility of the bureaucracy has consistently eroded due to its politicisation. However, if the 2013 elections would have been supervised by civil servants, their rejection would have been more forceful and universal, which would have created chaos and anarchy.



As far as the defamation law is concerned, it is quite strong in several countries where it serves as a great deterrent against throwing uncorroborated charges against adversaries. It is not possible that there such a case would remain unproductive and it would be decided either way. But sadly in Pakistan, there is no such tradition. The libel law is equally impressive but has been treated just as a useless piece of paper as it has never been implemented.



There are no examples to cite showing that a certain person, who was maligned, ever won a defamation suit or even his plea saw a conclusion either way, and the accuser got the due punishment. What will be fate of Iftikhar Chaudhry’s suit, if filed, is not yet clear.
