Well the question remains how did he get Iranian passport? Are they in it?

There is no way of finding this out. No way.

But Iran is pretty much a police state and one cannot get anything done there without extreme clearances. Many Pakistanis like Uzair Baloch also have Iranian passports.

We will once again go to icj saying that his human rights are voilated and once again court will ask you to provide him fair trail .. also so that you do not treat him unfairly our counsel and will keep a check on him regularly

The court found that nothing in Article 36 of the Vienna Convention on Consular Relations (VCCR) precludes its applicability to persons accused of espionage.

The provision basically states that when a national of a foreign country is arrested, they must be informed of the right to have their country’s consulate notified and should also have the right to regular consultation with their consulate’s officials during their detention and trial.

Pakistan had argued, unsuccessfully, that Article 36 of the VCCR does not apply to people involved in espionage.

Pakistan has been directed to suspend the execution of the death penalty awarded to Jadhav till it fulfills the new conditions (ensuring consular access and 'effectively' reviewing the case).
So we can give death penalty after we provide him with consular? Cool :coffee:

Furthermore:

Article 36 addresses communications between consular officers and nationals of the sending state. The Convention provides that "consular officers shall be free to communicate with nationals of the sending State and to have access to them."

So we only failed to prove that Article 36 is not valid for espionage....not an entire loss we will review with consular and then award death penalty to indian officer involved in terrorism in Pakistan! :agree:

As much as I want to see KY hang, but keeping my emotions aside let's think about this through if he is hanged soon than it will be all over , soon KY story will lost In time , but as long as he is alive it will be a pain in Indians butt , Everytime they see KY in Pakistan custody they will burn , longer he draws breath the longer Indians choke .

As for who's victory is this , Indians needs to understand that just getting him consular access won't change much for him right? What will you guy do by sending few diplomats to meet him ? His trail will be held in Pakistani courts ( possibly military courts ) and we have all the desired evidence to punish him . Court determined that he was using the fake passport of Hussani Mubarak and used the passport to travel India 15+ times , he was indirectly declared a spy working for India hence proving our POV . India can claim this as their victory just like the claimed victory after 27th Feb , the whole world laughs at you and the it was Pakistan who got everything it desired .

I am hoping that we keep him alive for now and present him on every international stage to show the real face of Indian terrorism in Pakistan .

You already requested ICJ to annul the decision of military court and acquit him.. kitni baar jaega bhai? :rofl:

Interesting that both sides are claiming victory. Though both sides have something to cheer about, I feel that objectively this is a victory for Pakistan.
