The International Criminal Court has called on India to arrest and hand over Sudanese President Omar al-Bashir, who is wanted on genocide charges and expected to visit New Delhi for a summit this week.

Bashir is accused of masterminding genocide, crimes against humanity and war crimes in his campaign to crush a revolt in Sudan's western Darfur region. The Hague-based tribunal issued warrants for his arrest in 2009 and 2010.

Along with at least 40 other African leaders, the 71-year-old president is expected to arrive in New Delhi on Wednesday to attend an India-Africa Summit aimed at boosting trade and investment between the two regions.

Although India is not an ICC signatory, New Delhi should act as a U.N. Security Council resolution had lifted Bashir's immunity under international law and urged all states to fully cooperate with the ICC, said the office of ICC Prosecutor Fatou Bensouda.

“As states ponder over such matters, it is fundamentally important not to forget the victims who deserve justice for the unimaginable atrocities they have suffered,” Bensouda's office told the Thomson Reuters Foundation by email late on Monday. “By arresting and surrendering ICC suspects, India can contribute to the important goal of ending impunity for the world's worst crimes.”

Indian officials were not immediately available for comment, but Foreign Ministry spokesman Vikas Swarup, when asked the country's position, told local media, “India is fully compliant with its international legal obligations.”

This is not the first time the ICC has asked a foreign government to arrest and hand over Bashir.

South Africa, which is a signatory to the ICC and obliged to implement warrants from the court, was criticized in June for allowing Bashir to leave an African Union summit, defying a ruling by its own court ordering his detention.

Sudan has previously accused the ICC of being a political tool to target African leaders. Others indicted by the ICC include Laurent Gbagbo, former president of the Republic of Cote d'Ivoire, and Muammar Gaddafi, the late leader of Libya.

But Amnesty International India said the two warrants against Bashir charged him with criminal responsibility on 10 counts, including murder, torture and rape, and appealed to India to detain the Sudanese president.

"As a country which aspires to a more prominent global position, India must not turn a blind eye to these charges. The Indian government must show true leadership by helping bring Omar al-Bashir to trial," Aakar Patel, executive director of Amnesty International India said in a statement.

India is the second largest exporter to Sudan after China, selling everything from chemicals, pharmaceuticals and machinery to iron and steel. Several Indian oil, gas and construction firms operate in Sudan.

Total bilateral trade between India and Sudan surged to $1.4 billion in 2014-15, from $327 million in 2005-06, according to data from India's foreign ministry.

Diplomatic immunity is granted by the host country - though under international obligations..so I don't see how it becomes obligatory for India especially when India is not a signatory to ICC.

You can't even arrest a diplomat forget sitting Head of State without violating diplomatic immunity laws.

India is not a signatory to the Rome statutes, So the ICC can go F*ck themselves.. The Hague tribunals are nothing but selective prosecutions.. Bush and Blair should be the first to go

South Africa is a signatory of ICC but have not arrested Sudan President when he visited to South Africa in June.

So here i dont think its about being ICC member or not.

India has hosted the third India-Africa Forum.

India should be first asked to arrest MODI to bring JUSTICE.

There is no case against him.

Sudan is a major beneficiary under the Indian Technical and Economic Cooperation (ITEC) Programme. Indian experts also visit Sudan under this programme. From 35seats in 2002-03, Sudan had 130 and 150 ITEC slots in 2010 and 2011 respectively(130 in 2006, 136 in 2007, 160 in 2008 and 170 in 2009)), apart from several scholarships offered by the Indian Council for Cultural Relations. For the year 2012-13, India is offering 150 slots under ITEC programme. As per the decisions taken during IAFS II held in Addis Ababa in May 2011,India also offers various training programmes in addition to ITEC courses.

India also trains Sudanese diplomats at the Foreign Service Institute in New Delhiand its petroleum sector technical personnel.

India sells manufactured goods, machinery and equipment, transport equipment,chemicals and pharmaceuticals, foodstuffs, wheat, textiles,etc. India buys raw hidesand skins, cotton, leather, ores and metal scrap.

Several Indian companies are now active in Sudan including BHEL, ProgressiveConstruction Ltd, Mohan Exports, Angelique International Ltd.,Ramco, Lucky exports,Mahindras and L&T. Tata buses have re-entered the market and Maruti cars and Scorpio vehicles are visible.

Lets see if Pakistan has the capability to take some steps and arrest Modi if he visits Pakistan during the 2016 SAARC meets, though I have my doubts that the SAARC meeting would be held in Pakistan as most head of countries would not find it safe.

Sometimes its really hilarious that how you all take world acknowledged terrorists as your leaders while an visionary as terrorist.
Forget about Indian courts who have given a clean chit to himhim,do you have even an FIR in Pakistan against him? Get up Mr Lazy, go file a suit in your country ,and if by chance you are able to declare Modi a terrorist in Pakistan, better don't show up and embarras yourself . Because innocents are not arrested in present society. Don't give yourself as a source to be laughed upon.
