THRISSUR: Beedi Tycoon Muhammed Nisham was on Thursday sentenced to life imprisonment on charges of murdering security staff Chandrabose by mowing him down with his Hummer car at Puzhakkal near Thrissur on January 29, 2015.
The district additional and sessions judge K P Sudheer, who was the trial judge in the case, sentenced Nisham to another 24 years of rigorous imprisonment for the various other charges like causing grievous injuries, attacking with lethal weapons and threatening to murder.
According to the special prosecutor C P Udayabhanu, Nisham will have to undergo about 39 years of rigorous imprisonment as the judge has not said that the various conviction periods will run concurrently.
The judge has also slapped a fine of Rs 70 lakh on Nisham for murder charges, and another Rs 10.30 lakh on various other charges. Out of this Rs 50 lakh would be given to the family of Chandrabose.
The judge had pronounced Nisham guilty of various charges including murder on Wednesday.
The prosecution had argued for awarding capital punishment treating this as 'rarest of rare cases', but the court did not accept this. The prosecutor said the possibility of going in appeal against the order to get capital punishment for Nisham would be explored based on the instructions from the government.
The prosecutor, however, said the sentence was already a rare one considering that the 39-year-old Nisham will have to undergo 39 years of rigorous imprisonment.
The family members of Chandrabose, who had also demanded on Wednesday that Nisham should be given capital punishment, expressed disappointment over the sentence.
Prosecution alleged that Nisham had come in an inebriated condition to the Sobha City on January 29 last year and had started abusing the security staff for alleging opening the gates late.
Chandrabose who had gone to the scene to settle the issue was also targeted by Nisham, prosecution alleged. Nisham chased Chandrabose who tried to take shelter in the security staff's cabin. Nisham broke open the glass window and entered the cabin and attacked him again, the prosecution argued.
Chandrabose tried to run away from the staff cabin when Nisham stepped into his Hummer car. However Nisham again chased Chadrabose in his car and mowed him down. Nisham succumbed to his injuries on February 16, after 19 days of treatment at ICU of Amala Hospital.
Chief Minister Oommen Chandy meanwhile said on Thursday that the guard's widow had been appointed a typist in a state-run organisation in Thrissur.
Owner of Kings Group of Companies, Nisham courted controversy after his seven-year-old son's photograph driving his car was put up on social media. In another case, he allegedly abused a woman police official for checking his vehicle.
Defense counsel however had contested this and argued that Chandrabose had attacked Nisham and when the latter tried to escape the former jumped in front of his car. Defense counsel said Chandrabose had actually attacked Nisham and former had jumped in front of the latter's car when he was trying to escape.
The defense counsel had also argued that Nisham was undergoing treatment for bi-polar disorder.
