Pakistan never have and never will accept this as a fact despite unsurmountable proof. Yet again this all will be blissfully denied as a conspiracy by CIA+RAW+Mosad.
I for one believe in Karma and i think u get what u deserve. The Govt of pakistan will be put down for something more progressive in the future im hopefull.

CHICAGO: Tahawwur Hussain Rana, the Pakistani Canadian accused in the Mumbai terror attack case, has claimed before a court here that he provided "material support" to the terrorists at the behest of the Pakistan Government and its spy agency ISI and not the terror group Lashkar-e-Taiba .

Rana in his defence, which is to be produced before the court here, said his "alleged illegal acts of providing material support to terrorists -- were done at the behest of the Pakistani government and the ISI, not the Lashkar terrorist organisation," according to court documents.

The documents have been published by Canadian newspaper Globe and Mail ahead of Rana's trial that is set to begin on May 16.

They reveal that Rana in his defence, which was struck down by the Illinois court, said: "ISI has authority to act in India to protect Pakistan's national interests."

Trying to invoke "Public Authority Defence" wherein a defendant tries to find shelter under the arguments that his acts were done at the behest of a government, Rana claimed he "acted under the authority -- whether actual or apparent-- of the Pakistani government and the ISI."


Rana also relied on the grand jury testimony of the co-accused LeT operative David Headley, likely to appear as witness against him, who claimed involvement of one Major Iqbal in funding the terror attacks.

"Therefore, he contends, he relied on a public authority, one that he argues is immune from criminal prosecution in US courts under the Foreign Sovereign Immunities Act FSIA)... when he engaged in activities such as allowing Headley to open a First World Immigration office in Mumbai," the order of Judge Harry D Leinenweber said.

The court rejected arguments put forth by Rana, saying his defence that "Pakistani Government and ISI officials sanctioned his violations of US Federal law is objectively unreasonable... Defendant acted not in Pakistan or India, but rather in United States."

"He cited no authority holding that a foreign government official can sanction an individual living and acting in the United States to violate US federal law," the court said.

The trial of the Pakistani-Canadian, Mumbai co-accused, is all set to begin here on May 16 and is likely to be held for a month.

49-year old Rana is accused of helping David Headley in setting up his office in Mumbai which the latter used as cover for his trips to the city for identifying targets.

"The process of seating jurors for the trial has begun," US District Court Judge Harry Leinenweber said at the court hearing yesterday.


He's just trying to save his a$$.

The onus of proof is always on the person making the accusation - in this case India. I still can't believe that Manmohan has decided to re-start talks with Pakistan.

The Peace Talks hold two key fundamental Advantages..
One it open barriers for Intelligence sharing and monitoring. and second it Puts Pakistan in a Precarious position as it cannot justify its dubious activity against India with Enmity.

Pakistan has allot to gain the biggest one being that it can Finally weaken its Military grasp over the Pakistani mindset that has been nurtured over generations of Propaganda...this will in turn help Pakistan look toward better prospects of welfare rater than getting in an arms race, welcoming its own demise.

For more than 60 years we have been saying that but no use except 3 wars....

Let us look at this confession on a simple game theory of loss or gain.

It is known that the level of detail involved in planning and execution was unparalleled in terrorism history and made it clear that an organisation such as Lashkar or some intelligence agency should be involved in carrying this out or both. Indians believe it is Lashkar or ISI or both. Pakistan barely manage to convince themselves with the RAW, Mosad and CIA angle.

Let us consider the later and remove the unlikely scenarios :

1. RAW did it. If that was the case, why would Rana not come out clean and say that Raw was behind it. It will be great for Pakistan. US can continue its war on terror and Pak and US are best buddies all over again. That kind of rules it out. If all he had to do was to confess coercion, he could have named RAW or ISI. Does it really matter as he is screwed anyway. The same argument goes for Mosad. So it is unlikely that RAW or Mosad had anything to do with 26/11. They failed to stop it happen is a better way of looking at it.

2.CIA did it. If that was really the case, what do they stand to gain. Pakistan and India enter into a possible conflict and war on terror goes for toss. Does not add up. Unlikely. If they want Pak and India to fight for glory and enjoy the fun, they should have let the confession linger in the media when India and Pakistan were close to a nuclear war post 26/11. Also Rana's confession was kept a secret and quashed. Does not add up at all.

3. Lashkar did it but supported by ISI : Possibly. But why would Rana not include Lashkar in his confession. Does he fear the Lashkar. May be. But pointing fingers only at ISI does not add up. Was Laskhar just an entity to recruit and supply man power. Quite possibly.

4. ISI did it. Rana got caught and decided to come clean. Possibly. But again, why would Rana confess the truth if the US claims of not sufficient proof. Unless US fears heightened tensions between India Pak. But US can't be bothered. However, it will be bothered if it WoT suffers and yes that adds up.

On 3 and 4, take your pick. You can't be 100% sure in any case but this is as close as you can get to.

What exactly is meant by "Unsurmountable" proof. Proof should be undeniable. If you are refering to the statements of the apprehended criminals, then they are not prrof enough because their statements can be a result of a secret deal in return for a reduced term or whatever. The question may arise why wouyld someone want to give the apprehended criminals a reduced sentence or some other benefit? Because such a statement, specially at the time when ISI chief is visiting US, will enable the US officials to use it for leverage to put more pressure on Pakistan specially in the backdrop of Raymond Davis arrest and resulting embarrasmment for the CIA.

Its very easy to make any arrested person say anything by using dirty torture techniques.

Read post #6, how the court is looking at this case and his claims. A simple "This organization did it" doesn't work by itself. The criminal may be doing it to avoid responsibility. That's common in such cases, and that's a fact, not a conspiracy theory

But if it doesn't even pass the court then it's you who is making the conspiracy theory by clinging on to such statements.
