Haji Ali case: Prefer not to interfere, era of intolerance, says Bombay High Court

The Bombay High Court Tuesday said this was an “era of intolerance” while hearing a plea about the ban on women entering the sanctum sanctorum of Haji Ali Dargah in Mumbai. Stating that courts generally refrain from interfering in religious matters, the HC urged the parties to amicably settle the dispute.

“This is an era of intolerance. When it comes to religious matters, people become very sensitive. This is why we normally prefer not to interfere,” said Justice V M Kanade.

The petitioners argued their matter was not necessarily religious but that of “gender parity”. The court posted the petition for further hearing on December 15.

Is Bombay High court implying that Indian Muslims are intolerant and would react aggressively if HC interfered?

Is Bombay High court implying that Indian Muslims are intolerant and would react aggressively if HC interfered?
why the same was not applied in case of Shani temple scenario !

Do you guys know as per supreme court directives it is illegal to use loudspeakers for morning azaan? Yet a hundred thousand mosques use them daily. Ever seen burkha dutt foaming at the mouth talking about this intolerance?????

What I meant was it was a stupid thing to demand women can't enter, and that it's good Kanade did not support it.

That's exactly every liberal view. But the funny thing is - wait for it - the Hindutvavadis want this to fail to appear in court, so that they can jump up and down and say that the court discriminates against Hindus and for the Muslim clergy (there was a parallel case just a few weeks ago, where some Hindu women insisted on entering a temple). :D

Interesting observation by court. Lets see if these people approach Supreme Court.

Bombay High Court played a master stroke refusing to interfere. This will be challenged and escalate to Supreme Court and hopefully petitioners while filing the SLP would also seek to club this with Shani case.

So judicial system is in line with #Liberals and #Secular thought process of India which can interfere with Shani temple but not with Haji Ali.

I can feel that India is bit tolerant today :)

My thought would cause contempt of court charges against me now.
What is this excessive interference of courts in religious matters and that too without any logic or sensitivity.

Well it plays to their interests, and ultimately that's what people think about above all.

In fact, the judicial system is precisely not in line with liberals and secular thought processes. Not as far as expressing doubt about acting in the matter is concerned. However, the matter has been posted for further hearing. Let us hope that he is clear-headed and accepts the matter for detailed hearing and passes an order.

Because ALL citizens have a right to practice their religion, and by restricting the access of women alone to the inner shrine, the guardians of the dargah are restricting their right to practice their religion on the same footing as men.
