German citizen sentenced to death for double killing despite Berlin protests

Going by the comments of many news articles in our media, pretty much everyone in Germany are in accord with China's decision to punish him hard. But many, including me, are against death sentences for any crime, because killing him would not bring the other two back to life. It just adds another killing to the list.

We in Germany think that he should get a life sentence and work off his guilt for the rest of his life. That would give back more to society than to simply kill him. The law must give justice and not used as a tool of revenge.

Having a murderer in jail for the rest of his life would waste precious resources and jail space.

Murder and manslaughter should receive death penalty.
Why should a person deserve to live when they killed another human being?

You are ridiculosu to claim that law should not include death penalty otherwise it is revenge. As I said, the deterrence is not supposed to apply to criminal's familiy and friends, but to other people who plan committing similar crime. if you know you will get shot, you may not do it.

we apply the same prctice for 5000 years and we know its effect.

And tell me why we have so little murder in Germany even without death sentence? Are Chinese more prone to murder and only death sentences deter people in China to do so? Has 5000 years of deterrence eliminated murder in China?

Not when the criminal has to work for all expenses and a surplus to repay to the society.

To murder a murderer is still murder.

Though I'm not an expert of Chinese philosophy, I remember that Mengzi (Mencius) was against death penalty because he thought that to mistakenly sentence an innocent to death is a crime that makes heaven weep. And there is always a chance to make human errors at any time. How will you bring that person back who got wrongly sentence to death when you already killed him/her?

you have low murder rate cause you are rich now, it is common sense that rich country has low crime rate. But don't expect your rich will last forever, You will change your opinion once your crime rate become higher.

That may be a serious concern, indeed. Although I am for death penalty in extreme cases like the above incident when there would be no room for misjudgment etc., I would be for taking pains to perfect the means of investigation to ensure that the suspect is 100% proven guilty.

Whenever there are human involved, there is never 100% certainty. On top of that, there is still the chance of abuse from well connected people.

US death penalty is pretty much non-functional, except for Texas. The guy committed crime in China so he should be punished according to Chinese law which means the death sentence. Simple principle, easy to understand. No need to argue over the merit of the death penalty.

There is a difference in psychology. In China it is believed a deed DESERVES an equal response. And no we don't really care if some another one come to close his end.

I disagree, first of all China is a very populous country compared to Germany. Because we have > 1 bln people the chances are very high there are crazy people among the population. If there's no death penalty, it's quite possible the number of murder could increase, crime rate most definitely rise. Just look at India (another country with massive population), weak punishment and lots of rapes or other crimes. Capital punishment serves as a fear factor despite people still commit murder, smuggle drugs in countries with death penalty you may question the effectiveness of this kind of deterrent. But without it i'm pretty sure the number of these serious crimes will be much higher. In this case the evidence isn't questionable whether the culprit did commit the murders or not.

The EU has more than half a billion people, almost double the US, and yet we have altogether less murder per capita than the US.

German citizen sentenced to death for double killing despite Berlin protests

A local court in Xiamen, Fujian province on Wednesday sentenced a German citizen to death for a double homicide, which is the first time that the People's Republic of China has imposed a death penalty on a German citizen.

"The verdict will be submitted to the Supreme People's Court for approval," a source from the Xiamen Intermediate People's Court told the Global Times on condition of anonymity.

The German foreign office on Thursday told the Global Times via telephone that the German government strongly opposes all form of capital punishment, and that it will try everything in its power to ensure that the death sentence will not be carried out.

The 36-year-old German man is reportedly from Teisendorf, the southern German state of Bavaria. He killed his ex-girlfriend from Venezuela and her new German boyfriend with a hammer and a knife on a street in Xiamen in June 2010, according to German weekly Focus Online.

Chen Liqun, the defendant's lawyer, said in an interview with Deutsche Presse-Agentur that his client has not decided whether to file an appeal or not.

"China will not accept any judicial interference from other countries," Mo Shaoping, a renowned criminal defense lawyer and a professor with the Central University of Finance and Economics, told the Global Times on Thursday.

He added that German government's opposition to the death penalty will not affect any judicial decision in China, unless the criminal enjoys diplomatic immunity.

To date, around 140 countries have abolished the capital punishment. Only 58, including China, Japan, Singapore and the US, retain it.

I am with you on this one,he is guilty of 2 murders & should be punished accordingly

Fact is this German is not wrongly sentenced. Proof is 100%, cannot be denied.
If you are against death penalty, what penalty do you think is appropriate for drug dealers, smuggling drugs, (serial) killers, (serial) rapists, corruption which led to lost of lives etc.

He committed a crime and now he will pay the price. Get rid of this piece of trash China, oh don't forget to his harvest his organs. He may be of use to many poor folks waiting a transplant.

It's ironic to call for leniency, for a man who showed none to his victims. If this was manslaughter it could be argued to spare him.
