Former Pakistan President Pervez Musharraf arrested

Judiciary--even in the land of the Laws called America--is still widely criticized for Bush's victory in the 2000 elections.

And Pakistani judges are from a 3rd world country where the rule of the Law is far less than in America. I am not going to speculate on the motives of the CJP or about his son's alleged corruption. But the current superior judiciary in Pakistan has significant number of people who 'abetted' Musharraf's 1999 coup and then more later.

As I keep saying: Why start the trials leaders with Musharrafs or Zardaris? Is that because they are from the minority provinces? Can anyone say with a straight face that the Sharifs have never taken part in corruption or abuse of their power?

Why don't we go back to 1977 and start from Zia's Martial Law and sort out the good from the bad?

Let Musharraf sulk in his irrelevancy--that's probably worse than death for him. Let him go free unless we want to go back to 1977. I mention 1977 because General Zia thoroughly victimized the PPP's record up to 1977.

I.Chaudhry is going after Musharraf, because it was he who deposed him during martial law. This is a personal vendetta, has nothing to do with justice and upholding the law, otherwise whole GoP would be on trial.

It was quite interesting to watch Hamid F'ing Mir's "Capital Talk" program where Ahmad Raza Kasuri very eloquently pointed out that the bail hearing judge had no authority to add any new charges to the General's case. The worst he was allowed to do was to deny the bail and even that was not possible because the legal precedence was that this was a bond bailable concern. But since the only way the court could hold the General in custody was to add charges; that is legally not possible because for that these charges can only be brought by a complainant which can only be the federal government in this case...

This is a Kangaroo trial, in a Kangaroo court... Long live the general... I am just waiting for the Army to show a gesture for all this nonsense to fizzle out...

As for Musharraf, the trator's realized his mistake and wants to leave Pakistan. I say, make an example of him to strengthen Democracy. It's either now or never.

14 day remand, I believe its next to impossible for musharraf to contest elections now and very very hard for him to become president again. As a civilian you are eligible for presidency but you need majority amongst senate, MPA, MNA and he just doenst possess the strength. As far as military option goes i dont see kiyani imposing martial law just to bring musharraf to power. I doubt he spent the last five years trying to remove army from politics just to bring them back again.

I get the feeling the next COAS will most probably be like kiyani too beside the people dont want military control, they are looking at democratic choices. the army will be very foolish to involve itself in politics when the people dont want them to do so as our military thrives on the trust of the masses. the very trust that was broken by musharraf but was reinstated by kiyani.

ISLAMABAD: An anti-terrorist court in Rawalpindi has ordered former president Gen (retd) Pervez Musharraf to be made part of the investigations into former premier Benazir Bhutto’s assassination.

It was the first time on Tuesday that the former military ruler appeared before the anti-terrorist court over Bhutto’s murder.

Musharraf was driven to the court in Rawalpindi from his plush villa on the edge of Islamabad where he is serving a two-week arrest order.

Musharraf is accused of conspiracy to murder Bhutto, who died in a gun and suicide attack in December 2007. It is one of a barrage of legal cases he is fighting in the courts since returning home last month after four years in self-imposed exile.

Despite a heavy police and paramilitary presence, scuffles broke out between lawyers and Musharraf supporters, who threw stones and beat each other with sticks outside the court building.

About 150 lawyers shouted in protest against the former president, while two dozen supporters chanted “Long live Musharraf!”

“Today it was routine hearing of Benazir murder case and General Musharraf appeared for the first time in this case,” his lawyer Salman Safdar.

Musharraf spent around 15 minutes in court and then another 15 minutes with his lawyer, before being driven back to his Chak Shahzad residence on the outskirts of Islamabad which has been declared as a sub-jail.

The court while adjourning the next hearing of the case until May 3, also ordered for Musharraf to be made part of investigations.

During the hearing, the court issued a notice to the Federal Investigations Agency (FIA) and sought a reply from the agency on the next hearing over the petitions submitted by the former military ruler against his declaration as a proclaimed offender and seeking resumption of his frozen assets and bank accounts.

Moreover, Salman Safdar, counsel of the All Pakistan Muslim League (APML) chief was allowed to meet the former president, who is under judicial custody at his farmhouse.

Earlier, the ATC had summoned all accused, including the retired general, for the case’s April 23 hearing.

The farmhouse was declared a sub-jail by the anti-terrorist court in Islamabad as it heard the judges’ detention case against the former military strongman.

Benazir Bhutto was assassinated in a gun-and-bomb attack outside Rawalpindi’s Liaquat Bagh on December 27, 2007. She was killed after addressing an election campaign rally in the city.

Nobody has been convicted or jailed for Bhutto’s assassination yet.

‘No faith in Supreme Court bench’

Meanwhile, lawyers for the former military strongman argued in the Supreme Court that adding their client’s name to the exit control list was in violation of the Constitution and his fundamental rights.

Musharraf’s counsel Ahmed Raza Kasuri on Tuesday told the apex court that his client had no faith in the Supreme Court bench hearing the treason case against the former military strongman.

Another counsel for Musharraf, Ibrahim Satti, said there was no hint of a case for high treason against his client and therefore the addition of Musharraf’s name on ECL was a violation of his fundamental rights.

Furthermore, Kasuri said his client had no confidence in the apex court bench hearing the treason case against him.

“My client has no faith in the bench hearing the case,” Kasuri said, adding that the Supreme Court should first address the question of formation of a larger bench on the matter or hand the matter over to the full court.

Let us not forget that it was Musharraf who required at-least BA for running elections and introduced the local body governments... the trouble is that the politicians are just too busy looting the country than to think about it... The army for the survival of the country and itself (which is intimately linked to the first) has to respond EVERY FREAKING TIME...

ISLAMABAD: As the complainant in the judges detention case filed another petition for the transfer of former president General (retired) Pervez Musharraf to the Central Jail Adiala, ex-generals warned that the army would not tolerate if the lawyers continued pushing their former chief to the wall.



The complainant in the judges detention case through his lawyer Chaudhry Mohammad Ashraf Gujjar maintained in the petition filed with the Islamabad High Court that after dismissal of the pre-arrest bail petition of Mr Musharraf, chief commissioner Islamabad Tariq Mehmood Pirzada and inspector general of Islamabad police Bani Amin Khan had extended undue favour to the former president by declaring his Chak Shahzad farmhouse as a sub-jail.



The petition said the accused did not join the investigation despite the court directions. Mr Musharraf was a proclaimed offender and being an accused in a terrorism-related offence, he was not entitled to being kept at a place other than the Adiala Jail.



He requested the court to set aside the notification of April 20 according to which the residence of the former general has been declared as a sub-jail.



When contacted, Qamar Afzal, the counsel for Mr Musharraf, said the lawyers were dragging the former president in the courts for their own publicity.



He alleged that during the hearings the lawyers did not maintain the decorum of the court and passed unethical remarks and even used abusive language against the former president of Pakistan.



According to him, the lawyers trying to humiliate the former president wanted to get publicity by indulging in such unethical practices.



Talking to Dawn, defence analyst General (retired) Jamshed Ayaz said the military was closely monitoring the situation. He said at least nine corps commanders currently serving in the army were promoted during the Musharraf regime.



He claimed that Musharraf still enjoyed support within the army ranks and the incumbent army chief General Ashfaq Pervaiz Kayani should play a role to save Mr Musharraf from such a humiliation.



“Otherwise Musharraf’s sympathisers may intervene to rescue the former military chief,” he added.



General (retired) Faiz Ali Chishti, the president of the ex-servicemen society, was of the view that Musharraf has to face the court in case he had done something wrong but the lawyers should not be allowed to treat him as a criminal.



“An accused, in the eye of law, remains innocent until or unless he is proved guilty,” he said, adding after proving the charge against the accused courts announce its verdicts and it was executed by the law enforcement agencies and the lawyers’ role was only to assist the courts.



But in the case of former president Gen Musharraf, the black coats are trying to take the law into their own hands which is not acceptable, he further said.



There was, however, some division among the ex-servicemen over the treatment of Mr Musharraf. Brigadier (retired) Mian Mohammad Mehmood, a representative of retired army officers association, claimed that there was no sympathy for Gen Musharraf within the ex-servicemen. He said Musharraf was reaping what he had sown in 2007 when he sacked the judges of the superior judiciary.



“We were with the lawyers and the civil society during the movement for restoration of the judges and rendered sacrifices for the supremacy of the law,” said Brig Mehmood.



He, however, added that the lawyers should show decency during the appearance of Mr Musharraf in the courts to prove that they had fought for the supremacy of the law and let the court to decide the fate of the former dictator.



Former chief of the army staff General (retired) Aslam Baig, on the other hand, said the army would not tolerate these developments after a certain level.



He told Dawn that certain quarters were encouraging the lawyers against the former military chief. “Otherwise they could not dare to humiliate the former COAS who ruled the country for more than a decade,” he added.



According to him, certain elements laid a trap for Musharraf while he was abroad by giving him an impression through the social media that the whole country was waiting for him and he would be warmly welcomed upon arrival in Pakistan.



After his arrival, planned and coordinated efforts are being made to humiliate him and to provoke the military by dragging the institution into unnecessary litigation along with Gen Musharraf, he added.



“The situation may turn dangerous if the lawyers continued to humiliate the former military chief and tried to drag the institution into the courts,” he added.



According to senior analyst Ayesha Siddiqa, army had tried to stop Gen Musharraf from coming back to Pakistan but the former general ignored the advice.



She said the army would not come to his rescue because it would again destroy its image if it tried any adventure.



The army after consistent efforts is restoring its image and to some extent has achieved certain targets and it cannot undo this for the sake of Mr Musharraf, she added.



Senior journalist Imtiaz Gul also thought that army would not step into the controversy just to rescue Musharraf.



He said the violent act of black coats was itself damaging their repute in the public as it appeared that instead of the courts they were intending to punish Musharraf for his wrongdoings.



Syed Qalbe Hassan, the vice-chairman of Pakistan Bar Council (PBC), the apex body of the lawyers, said the Supreme Court was examining the ‘high treason’ charges against Musharraf and senior lawyers were presenting their arguments for and against the former military ruler before the apex court.



He said ‘a few lawyers’ under their ‘hidden agenda’ were bringing a bad name to the entire legal fraternity by humiliating the former general.



They are pressuring Musharraf because they wanted him to leave the country without facing the trial, he added.



He suggested that Musharraf should be tried for 1999 coup and those generals and judges who facilitated and validated his unconstitutional steps in 1999 and in 2007 would be dealt with in accordance with the law.

Musharraf was Punjabi... Kiyani is Punjabi... Zia was Punjabi, Ayub Khan was Punjabi... these "bloody Punjabis!" looks like anyone who joins this "institution" turns into a Punjabi...

I wonder what is the definition of "Punjabi"... Does it really mean "Pakistani"... well then I am a "Punjabi" too... :)
