Former head of Intelligence Bureau’s Gujarat wing and three of his serving colleagues were on Thursday charged with murder and conspiracy in the extra-judicial killing of Ishrat Jahan and three others 10 years ago.

However, in a morale booster for the BJP ahead of Lok Sabha elections, Narendra Modi’s confidante Amit Shah was not named in the second chargesheet filed by the CBI on Thursday.

Shah was last year quizzed after some of the accused alleged he had been aware of the police’s actions all along. HT had reported on December 2 and 17 that Shah might escape unscathed because he was not present in Ahmedabad on the day of the encounter and there was no evidence against him.



The chargesheet says former Gujarat wing head of IB Rajendra Kumar is the main accused who generated a false intelligence alert that the four persons were terrorists on a mission to kill Modi. Not only that, he also provided arms to the accused a day before the encounter.

Besides Kumar, three serving IB officials -- P Mittal, MK Sinha and Rajiv Wankhede -- who helped him carry out his plan have also been charged with murder, criminal conspiracy, wrongful confinement, kidnapping, wrongful concealment. Kumar has additionally been charged under Arms Act.

This is for the first time a top-ranking officer of the country's premier intelligence agency has been chargesheeted in extra-judicial killing.

Ishrat Jahan, a 19-year-old college student, was killed along with Pranesh Pillai, Amjad Ali and Zeeshan Johar on the outskirts of Ahmedabad on June 15, 2004 by a team of the Gujarat Police’s Crime Branch.

The police had claimed the IB had alerted them about the assassination plans of the four persons. But in a row that pitted IB and home ministry with the CBI, the former defended Kumar saying he had only passed on the intelligence but didn’t authorise or participate in the killings.

The CBI last year said that Kumar, a 1979 batch IPS officer, actively participated in the conspiracy to kill Ishrat and others. His juniors in Ahmedabad IB office picked Ishrat and her former employer Javed from a toll plaza and illegally confined them, while Kumar interrogated them.

The CBI did not wait for home ministry’s formal consent of sanction for prosecuting Kumar. The ministry had said its sanction was required to prosecute Kumar because he was a serving officer when the encounter took place.

In its primary charge sheet, the CBI had described the encounter as joint operation by Gujarat police and central IB.

The CBI while sharing the details of evidence implicating Kumar with the ministry officials, had contended that without including Kumar as a prime accused, the case would collapse.

It argued that Kumar’s role is crucial in getting custody of the two persons who were killed along with Ishrat and Javed, supplying weapons and generating false IB alert when the four persons were already in the custody of the police.

Now Indians; Now please dont blame us as if we r the only victims of it and yr living in an exemplary world. Two of Yr Intelligence bureau officials/operatives r arrested for it.@indic @Capt.Popeye

thats not the point, the point is this also happen in yr country so dont through the garbage at us.

Thats not the point either, the point is that it happen in all the countries. Even USA, UK, EU, etc are not oblivious to it.

The point is, In rational countries law takes its due course and every independent agency does its job irrespective of any malign.

Now say that bout Pakistan. :)

And regarding garbage, we never threw it coz we were escaped of it. We always n always questioned the role of Establishment in case of these anti social groups. And as always we prove that Establishment in Pakistan is not serious bout actual root cause issues.

Otherwise what she was doing with 2 other terrorists in a car ?

Promoting terrorist activity is also act of terrorism.

Though I am a quite anti Modi .. but this Ishrat case was devised by Congress to indict Narendra Modi in false cases.

This is very encouraging for Pakistanis. They can dream of a day when their own out of control intelligence agencies will be brought under civilian control like India, made to answer the judiciary like in India and being questioned by the media without fear of death like in India.

This poster, inadvertently, through his inability to process the meaning and importance of this news has actually posted a positive article about India. Thanks.

all right ill take that. But remember that we r in a state of war so things will be different b/w a state which is in war and a state which is not. Hence this happening in yr country by yr intel agencies is no excuse in peace times.

Doesn't comes as a surprise at all, fake encounters, extra judicial killings is a buzzword in places like IOK and Manipur. There was even a case filed against the nominee for the next Indian army chief for being party in an alleged fake encounter.

That is not the point. The point is different parts of the system that are supposed to keep a check on one another - media, judiciary, armed forces, intelligence, civilian authority, parliamentary supervision, auditors and comptroller etc etc seem to be working fine to make this case follow a process and take it to its rightful end. We have not become so pathetically reduced to worshipping pictures of heads of our intelligence agencies who are actually our servants :)

Mistakes happen everywhere, but at least its not legal here, or lets say that the accused will be put infront of a judge.... unlike in other countries.

And the funny thing here is how Hindustan Times suddenly becomes a trustworthy source for news.... because not too long ago I saw somebody saying that the same news source is "BOLLYWOOD RAW HINDUTVA MASALA PROPAGANDA" when it reported something about a young Gurkha soldier and his hand to hand combat kill.

But when its about things which put India in a negative light, it suddenly becomes an oasis of pure truth :lol:

I agree, we must not let intel agencies out of control, otherwise we have all seen how that ends up. ;)

Thats Why Modi led BJP was against his kneejerk appointment by the ousting Congress govt. This is ur same Laadli congress which Pakistan was mooting for since day 1.

This report is from yr own media which is controlled by yr gov so if it itself reports something abt u then its logical to believe the particular report.

Hence, U can be assured that any malign intent by any agency will be countered and not abetted. And thats exactly what we r seeing.

Thats Democracy of India for u. ie. All 5 pillars of Democracy are as strong in itself and nobody can fool it for a long tym.
