Dutt jailed in Mumbai bombs case

Bollywood actor Sanjay Dutt has been jailed for six years for buying weapons from bombers who attacked the Indian city of Mumbai (Bombay) in 1993.
The star's lawyers argued he should remain free on bail for good behaviour, but the judge ruled against leniency.

Dutt, 48, is the most high-profile of 100 people who have been convicted over the blasts which killed 257 people.

The actor was cleared of conspiracy, but found guilty of illegally possessing a rifle and a pistol.

His lawyers said they would appeal against the sentence.

The blasts were allegedly carried out by Mumbai's Muslim-dominated underworld in retaliation for Hindu-Muslim riots which broke out after Hindu zealots tore down the Babri mosque in Ayodhya.

'Mistake'

Dutt, who has been on bail since 1995 after spending 18 months in prison during the initial investigations into the bombings, has now been taken back into custody.

As the sentence was announced, a shocked Dutt told the court: "I made a mistake."

Judge PD Kode responded by saying "everybody makes mistakes".

But he said there was strong evidence against Dutt and he was not entitled to leniency.

"In no sense can this be said to be a minor offence."

Earlier, the court released on probation another defendant, Russi Mulla, who was also found guilty of possessing an illegal weapon.

Two others convicted of destroying an illegal weapon and possessing illegal weapons - were given jail terms of two and five years.

Tuesday's sentences bring to a dramatic end one of India's longest-running court cases. In all 100 people were convicted.

Twelve were given death sentences and 20 others life in prison. The remainder will serve varying prison terms.

The alleged masterminds of the blasts, Dawood Ibrahim and Tiger Memon, have been on the run since 1993.

Indian investigators say they were assisted by Pakistan's intelligence service, but Islamabad has denied any link.

'In the top ten'

Dutt found fame playing gangsters and anti-heroes. His trial has generated huge interest among Bollywood fans across India.


In anticipation of the sentence, he had stopped accepting new Bollywood projects and had completed almost all the films he had already been working on.

Dutt, whose recent hits include Munnabhai MBBS and Lage Raho Munnabhai (Keep Going Munnabhai), is one of the top stars in an industry starved of heroes.

Film expert Komal Nahata told the BBC News website that Sanjay Dutt is currently one of the top 10 actors in Bollywood.

"He is capable of delivering and playing many roles, maybe not central but important ones for the next 10 years at least," he said.

Mr Nahata said that although "not much money was riding on the actor at present" because he had stopped signing new films, his absence would hit the industry "quite badly".

Dutt, son of a Hindu father and Muslim mother, had initially confessed to having the weapon in order to defend his family against threats during the riots.

Dutt shocked by prison term

It was not the sentence Sanjay Dutt expected when he walked into the special court hearing the Mumbai 1993 blasts case.
Wearing a white checked shirt and blue jeans, he arrived with friends - including Bollywood director Sanjay Gupta.

In court he seemed a little nervous but relaxed as he went about shaking hands and hugging people who wished him well.

He was smiling and talking to all the people he recognised, including this correspondent, to whom he said: "We must listen to [Pink] Floyd together at some point."

This was a reference to a conversation he had had a couple of weeks ago with some journalists, including me, about how he enjoyed listening to rock groups.

Plea

When Judge P D Kode announced his decision of denying the actor's probation plea and sentencing him to six years in jail, there was shock on the actor's face.

Announcing the sentence, Judge Kode said: "Laws of the nation must be respected. If you don't respect laws then you can't be called a moral person."


He said that although Dutt could not be linked to the bombings, he should be jailed for buying firearms from the bombers.

The actor's face turned red. He seemed to be holding back tears as he heard the sentence.

Soon after, Dutt pleaded for more time with his loved ones.

He said: "Your Honour, I am requesting you to let me speak to family, my sister is pregnant... I thought I would get probation that's why I am not prepared, give me time to wind things up."

The judge however denied the request saying he could not do so legally.

The actor then asked the judge to let him speak to his daughter who is studying in New York - a request the court granted.

Dutt was in constant talks with his lawyers and seemed to discuss the next course of action.

He will be taken to Arthur Road jail in Mumbai where he will be kept until 2 August.

'Strong man'

The defence says it will launch an appeal in the Supreme Court.

"We think that the judgement is harsh," defence lawyer Satish Maneshinde told reporters.

"Sanjay Dutt is a strong man, he has bounced back every time from a crisis. This is one of those crises. Millions of fans and family members are praying for him."
Mr Maneshinde also said film producers and directors are standing by the actor and have not asked for refunds.

Millions of rupees are riding on the actor at the moment as at least two projects are still in production and nowhere near completion.

Film director and close friend Bunty Walia told the BBC he was "saddened" by the verdict.

He said: "As for his ongoing projects, I think he will be given bail by the Supreme Court and most of the producers will wait until he is out of jail."

Many of his fans standing outside court were also shocked by the sentence.

"He is a good guy, he should have been sentenced but not for six years. I think that was too harsh," said one.

Another fan said: "I agree he has wronged and therefore should be punished but he isn't a criminal. What was the need to give him six years? He has already done almost two years in jail, another year should have sufficed."

I am actually saddened by this whole event although law took its own course. I think of him as the lovable hoodlum in Munnabhai and not the Khalnayak of 93'.

Guess we have seen the last of Munnabhai & Circuit together.

5 years is the minimum punishment for possessing a illegal firearm.
He got 6. I am happy with the judge, thoroughly deserved. He was guility and he got punished. Just cuz he is a celeberity and played a very lovable character doesnt him any less guility. It doesnt matter he is a nice person now, the fact he did wrong, and he should do time for that,

Yes, investigating rioters and investigating a certain gang, which is easier.
Bombay riots had people killed, not muslims not hindu;s.
These idiots only see religion. They will only see that.

Oh, dont you worry about my family.

There is a difference in finding a group 20 people who planted bombs to a 1000's of rioters.
