Well to me rape should be dealt in the same manner intention to kill is dealt death penalty should be teserved for murfer cases only

The death penalty does not mean we are somehow 'uncivilized'.

Think of the word 'penalty' for a moment. What is a 'penalty' ?

a punishment imposed for breaking a law, rule, or contract.

All laws have moral foundations. The law against theft came from the moral outrage that it is wrong to take something that does not belongs to self. The law against infidelity came from the moral outrage that sexual relations outside of marriage defiles the institution and possibly render helpless the weak -- namely the children. But just because something is morally offensive does not mean it is automatically illegal, meaning there ought to be a law against said offense. Lying -- in the abstract -- is morally offensive in the eyes of God. But if a woman asks: 'Does this dress make my butt look big ?' The man had better lie. He can deal with God later, but he has to deal with the woman now.

So what would compel a society to impose the death penalty ? What is it that is so morally heinous that the punishment is the ultimate -- death ? The fact that this society had to debate means this society is civilized. To be 'uncivilized' is often to act and/or react from impulsiveness, un-thinking, unreasonable, and just about everything associated with the base emotions and feelings of man. So how is it 'uncivilized' when the law that punishes with the death penalty was debated before it became law, enacted into a law, and the execution of the offender is restricted to a few ? At each step in the entire process, there were thoughts, debates, and time. How are those signs of savagery ?

Deterrence ? Not really. We have laws against speeding and the punishments ranges from financial levies to imprisonment. And yet, people still breaks those speeding laws. As a motorcyclist, would anyone believe me if I say I have never broken any posted speed limits ?

So look at the death penalty for exactly what it is, along with all other penalties: punishment.

If you do not believe that murder deserve the death penalty, then propose an acceptable alternative. The key word here is 'acceptable'. The alternative punishment must go through the same process of debate, reasoning, and time as any punishment and law. If enough people do not find the alternative acceptable, the death penalty stands.

How morally offended you are of that act.

You can debate on 'proportionality', such as no death penalty for stealing a pencil, but the basis for any form of punishment depends on how morally offended you are of an act.

Death penalty for serious offences is definitely less painful than life imprisonment or spending most of your life inside prison cell in depression and anxiety. Sudden quick death is good for serious offender as well as for sate

In my opinion. Death Penalty should be abolished. There should be a better way to utilize the life of a person and turn him around.

I don't believe in turn around theories of lowlifes but my argument against death penalty is simple.

Can you give life to a person who deserve to live ? NO. Then you don't have the right to take life of a "non-deserving" person as well. You better stay out of taking and giving life business.

Those violent criminals should be behind bars to make sure they are not a threat to society. The high cost of feeding of that criminal is a non argument since criminals I believe are a product of societies' failure structurally or behaviorally.

The title of the post to vote is DECEPTIVE----. Change it.

But if you look at the number of murders after pakistan re-started the death penalty----most on the fringe would agree to the death penalty---it works----.

But the number of death penalties should be high in order to stop the crime---not like in the u S.


So---since the hangings re-started in pakistan---the murder rate has dropped down by 50% plus as compared to the year prior to that.

According to supreme court sacrificing animal on festivals (non hindu) is good, but jallikattu/rooster fighting/racing is not.

So if you put that in human terms, death is actually better and less painful than jail term(long confinement, psychological probs etc) :lol:

get him to feed hungry, disabled kids
get him to work hard physical labor so he wont have time to think other thoughts
even if its a little, get him to remember his humanity

Or should it be banned? (NO)

By the time I tried to change the options to Vote , Someone had already voted . So I had no chance to remove the 2 options . I think the 2nd one would be more appropriate .

Bharatiya Janata Party leader Subramanian Swamy – reacting to assertions that only Muslims were being hanged – recently said that 170 people have been hanged in India after 1947 with only 15 of them Muslims, according to Asian News International.



Since independence, at least 60 Muslim (according to their surnames) convicts were hanged, according to the Death Penalty Research Report by National Law University, Delhi.

The report compiled data from central prisons but is not an exhaustive list because many states did not provide complete information. Some states provided such reasons: Kerala and Andhra Pradesh authorities said termites destroyed records.

The 35th Law Commission report, released in 1967, said more than 1,400 prisoners were executed from 1953 to 1963 but does not give religion-wise details of hanged convicts.

2007: Year of death sentences

The most death sentences were awarded in 2007 (186), followed by 164 in 2005. That year – 2005 – 1,241 death sentences were commuted to life imprisonment, the most ever.

Uttar Pradesh awarded the most death sentences (318) over the last 10 years. Maharashtra was second with 108, followed by Karnataka (107), Bihar (105) and Madhya Pradesh (104).

These top five states comprise almost 57% of all capital punishments awarded in the country between 2004 and 2013.

In Delhi, 2,465 prisoners had death sentences commuted to life imprisonment (between 2004 and 2013). Jharkhand and Uttar Pradesh were second with 303 death sentences commuted to life imprisonment, followed by Bihar (157) and West Bengal (104).

Bachan Singh vs State of Punjab, 1980[edit]
The Constitution Bench judgment of Supreme Court of India in Bachan Singh vs State of Punjab (1980) (2 SCC 684) made it very clear that Capital punishment in India can be given only in rarest of rare cases.[3][18] This judgement was in line with the previous verdicts in Jagmohan Singh vs State of UP (1973), and then in Rajendra Prasad vs State of UP (1979).[19][20][21] The Supreme Court of India ruled that the death penalty should be imposed only in "the rarest of rare cases."[1]While stating that honour killings fall within the "rarest of the rare" category, Court has recommended the death penalty be extended to those found of committing "honour killings", which deserve to be a capital crime.[22] The Supreme Court also recommended death sentences to be imposed on police officials who commitpolice brutality in the form of encounter killings.[23]

An appeal filed in 2013 by Vikram Singh and another person facing the death sentence questioned the constitutional validity of Section 364A of the Indian Penal Code.[24]
