HC asks Mumbai firm to pay Rs 2L to Microsoft

New Delhi: The Delhi High Court has stopped a Mumbai-based firm from selling computers loaded with Microsoft software programmes like Windows 7 etc and has imposed a fine of Rs 2 lakh on it for breaching the intellectual property rights of the software giant.

Accepting Microsoft Corporation's plea, Justice Manmohan Singh granted permanent injunction to M/s Gizgahertz and its proprietor Nimesh from using Microsoft hard-disk in its computers and selling them to the customers.

"The defendant (company) is restrained from copying/ reproducing, hard-disk loading on computers, selling/ offering for sale/ distributing/ issuing to the public pirated/ counterfeit/ unlicensed versions of Windows Vista, Microsoft Office 2007 or any other software of the plaintiffs in any manner, so as to infringe the plaintiff's copyright," Justice Singh said.

The court's order came on an injunction suit filed by Microsoft seeking a restraint order to the Mumbai firm from selling computers loaded with unlicensed versions of softwares such as Windows 7, Windows Vista and MS Office.

In its plea, Microsoft claimed infringement of its copyrights and other intellectual property rights by the company for selling branded computers with the Microsoft software without taking authorisation from it.

In its civil suit, Microsoft had contended that in July 2010, it had come to know that the Mumbai firm was infringing its copyrights and other intellectual property rights by loading its hard disk with software programmes on to branded computers and they were sold to the customers without taking any authorisation from it to do so.

could'nt find new sources of poverty/hunger/religious intolerence/lack of toilets in India ?......of course you wouldn't coz they have all been used by you already.......you deserve credit for exhausting the internet for sources of the above topics and putting up in this forum....koodoos...to you Mr.Hafizzzz , you are probably the first individual to exhaust the internet sources for the particular topic

it is just one of those PC sweat shops selling clone / assembled PC....

I know....there are millions of similar case of copyright violations that took place in India but not reported by the Indian News Media.

Mate - I believe Somebozo is right - should have been the ubiquitous PC assembling shops in India. Nothing wrong here to accept it as a mistake by these shops. Some of them violate the copyright.

This is not piracy but copyright violation. I guess they should have informed microsoft before installing software and selling the computers(even if the software is legit)

I use to own a franchise of a reputed computer center in India few years back. I was offered assembled PCs for half the price but went in for computers from a leading firm. I paid for each one of the software including windows, sco-unix, oracle, powerbuilder etc. while a local computer teaching facility got assembled PCs and charged very less.

This is not piracy but copyright violation. I guess they should have informed microsoft before installing software and selling the computers(even if the software is legit)

That is called software piracy. period.

I remember a few years ago there was a raid in many computer assembly shops in my city conducted by MS with the help of Police. They put big legal cases on these shops demanding huge sums of money as compensation for Copyright Violation, but in the end withdrew the cases in return for the promise by the shops they will never ever sell pirated copies of MS software.

This monopoly by Microsoft should end ... the people in our countries can't pay the amount of money for registered copy of Windows like the people in west .

I really hope they OS Chrome will be free source OS in near Future .

Why not linux? Many versions of Linux is free and a mature O.S.

Well...MS is not forcing anybody to buy their OS and whose stopping anybody from forming a competitor for MS.

Good let make it proper discussion. Can our beloved OP Mr. Haffizz or great ELITE member can put some figures of software piracy around the world ??? Take a hint and please tell us which country uses the most pirated software or other intellectual property rights violations ???

And for mr. Elite ever heard of Songs.pk ??? Any comment on the currupt life in Pak ??? Or your courtesy is just for India.
