Choose either PAF or PIA, SC tells Arshad Malik

AVM Arshad Malik was "Deputed" to PIA from PAF.
He was not working for both PAF & PIA at the same time.
He was being paid salary from only PAF and not PIA.

Armed forces officers can be deputed to work in other organisations as well as in other countries if and when required/requested.

PN/PAF serving officers are deputed to QEAF and other ME countries for a specific period of time after which they return to their parent service.

It has nothing to do with military structure. We have similar things in civilian jobs.

My grade/pay scale is a separate thing and my functional title has nothing to do with my pay scale/grade.

I have had people working under me that were three pay grades above me but the position that they held was subordinated to mine.

He holds a rank from the air force. However, he is not doing holding a position/command there. He is only holding one position in PIA as he has been sent there on deputation.

If the judge has any problem with deputation then he should pass a judgement and get all the govt. officials that are on deputation across the country to be transferred back to their respective parent departments.

Im not talking about grade, im talking about transfers between departments. I dont believe civil service and military have a system where officers can be transferred between the two. From what I understand the requirement for military officers is them first retiring from the military before taking a civillian job.

PIA is not a government organization. Its a private public limited company in which government has majority shares.

So they should hire a chairman of the Board from open and not from civil servants

Oh I though all state owned companies come under branch of civil service, hence why the SC even speaks on the matter.

Still if its a private sector job, then thats even worse, he definitely should not be in the PAF and be the ceo of a private company too.

No. It is not. Rangers e.t.c come under ministry of interior and yet army officers are deputed to it. Similar examples include ANF and what not.

As for whether mil officers can serve in companies. I have interacted with many such myself where the companies had serving mil personnel (can't quote them for obvious reasons).

In a fair world the CEO should be hired only from Pvt sector. However, we have seen the results so far in last two decades (even hiring foreigners did not cut it).

If the Memorandum/articles of association of the company or SECP regulations/company's act e.t.c do not prohibit it then there are no rules under SECP's purview that prohibit deputation from PAF by the govt.

If there are, then the govt is at fault and they should get the same rectified in MOA/AOA and company's act.

However, he is still not holding two positions as quoted in OP.

SC cant use their powers to repatriate the billions of stolen Pakistani wealth sitting in UAE, Europe and Far East, yet these dotards target ISPs, Telco's and honest, hardworking people who are genuinely working for the betterment of the nation.
