2 Chinese ships flying inverted PH flags accosted off Batanes

The Bureau of Fisheries and Aquatic Resources (BFAR) and the Philippine Coast Guard apprehended on Monday two Chinese fishing vessels flying an inverted Philippine flag in waters bound by Sabtang Island, Batanes in the north, Balintang Island in the west and Calayan Island.

Accosted were the F/V Shen Lia Cheng with 12 crew members and F/V She Kou with 13 crew members.

Authorities were conducting a seaborne patrol aboard BFAR patrol vessels MCS 3010 and MM Patrol Boat 3049 when they chanced upon the two vessels both observed to be flying an inverted Philippine flag.

PH authorities nab suspected Chinese poachers off Batanes

MANILA, Philippines (UPDATED) – Philippine authorities have seized two Chinese fishing vessels suspected of poaching in waters between Babuyan Island and Batanes province, the Bureau of Fisheries and Aquatic Resources (BFAR) said on Tuesday, May 17.

The BFAR said its joint team with the Philippine Coast Guard (PCG) nabbed the Chinese vessels around 3 pm Monday, May 16.

The team was aboard BFAR patrol vessels conducting a routine check when it chanced upon Chinese fishing vessels Shen Lian Cheng 719 andShen Lian Cheng 720, with 12 and 13 crewmembers, respectively.

“Both fishing vessels were observed to be flying inverted Philippine flag within Philippine archipelagic waters,” BFAR said.

Upon inspection, documents provided by the crewmembers showed that the vessels are registered with China and had no authorization to traverse Philippine waters.

The fishing vessels were escorted to the Batanes capital, Basco, for further investigation.

“Based on existing rules, the fact that both foreign fishing vessels were flying the Philippine flag gave rise to the presumption that they are engaged in poaching, as there seems to be an attempt to conceal the vessels’ true identity to enable themselves to engage in fishing activity in Philippine waters,” said BFAR Director Asis G. Perez, who is Agriculture Undersecretary for Fisheries.

“We will ensure, however, that the incident will be thoroughly investigated following the proper procedures,” Perez added.

He said that BFAR has informed the Department of Foreign Affairs about the incident, and requested for official interpreters to aid in the investigation in Basco.

Perez also said that the DFA will formally notify the Chinese Embassy about the incident.

PH detains 25 Chinese fishermen for suspected poaching

MANILA - Philippine fishing authorities said on Tuesday they had detained 25 Chinese crew of two seized fishing boats on suspicion of poaching, a move that could further strain ties between two countries at odds over maritime sovereignty.

A joint team from the Philippine coastguard and the Bureau of Fisheries and Aquatic Resources (BFAR) captured the Chinese vessels on Monday sailing without permits between waters off Babuyan Island and Batanes province in the northern Philippines.

The Chinese vessels were in waters that are not part of the disputed South China Sea, which China claims almost entirely. Brunei, Malaysia, the Philippines, Vietnam and Taiwan also have conflicting claims.

Tension between the Philippines and China has risen as an international tribunal in the Hague prepares to deliver a ruling in the next few months in a case lodged by Manila in 2013.

The Philippines is seeking a clarification of United Nations maritime laws that could undermine China's claims to 90 percent of the South China Sea. China has rejected the court's authority.

The fishing boats were flying an inverted Philippine flag when apprehended on Monday, BFAR said in a statement.

Speaking at a regular press briefing in Beijing, China's Foreign Ministry spokesman Hong Lei said he had no information and needed to further understand the situation.

Documents seized by Philippine authorities showed the vessels were Chinese registered. The fishermen failed to show permits required to enter Philippine waters, BFAR said.

"Based on existing rules, the fact that both foreign fishing vessels were flying a Philippine flag gave rise to the presumption that they are engaged in poaching," said BFAR director, Asis Perez.

A Philippine court fined nine Chinese fishermen $102,000 each in late 2014 after they were caught with hundreds of sea turtles in the disputed Half Moon Shoal in the Spratly islands of the South China Sea.

At the time, China protested against the arrests and refused to recognise their trial.

MANILA, Philippines – The Philippine Coast Guard (PCG) arrested 10 Chinese nationals on board a ship in waters off Camiguin Island in Mindanao, following a chase Wednesday night, May 25.

The monitoring, control, and surveillance (MCS) vessels of the PCG went after the Chinese vessel, which allegedly hit the rear of MCS 3010 and tried to escape.

MCS 3010 then sought assistance from MCS 3007 at around 8 pm.

"At first, we thought it was a local vessel because it was marked with Subic and was flying a Philippine flag, but it was found to be manned by Chinese crew," said Captain Allen Toribio, commanding officer of MCS 3007. "They pretended that they were aboard a locally registered vessel to avoid suspicion."

The two Philippine vessels were able to corner the Chinese ship, where PCG personnel found endangered black corals.

The PCG will sue the arrested Chinese nationals for poaching.

Lieutenant Jeffrey Collado, who was on board MCS 3010, also said there were two other Chinese ships in the area, but they managed to escape. –

10 Chinese fishers nabbed for ramming PCG-BFAR vessel

MANILA, Philippines - Ten Chinese on board a fishing vessel marked “Subic” and flying the Philippine flag were arrested on Wednesday night after they rammed a ship of the Philippine Coast Guard (PCG) and Bureau of Fisheries and Aquatic Resources (BFAR) in waters off Camiguin island in Cagayan Valley.

The Chinese ship bearing the numbers 0202 might have tried to sink the Coast Guard and BFAR vessel to avoid capture, according to Lt. Jeffrey Collado, commander of the monitoring, control and surveillance vessel 3010.

“At first glance, there was nothing irregular with the ship, but when we tried to communicate with them through radio, they did not answer,” he said.

At around 8 p.m. of May 25, the MCS 3010 spotted three vessels, Collado said.

“Two of the vessels turned off their lights and hurriedly left,” he said. “We no longer saw which direction they went.”

The Chinese steel-hulled vessel left a dent on the starboard or right side of the MCS 3010 after ramming it, Collado said.

MCS vessels are BFAR vessels jointly operated with the Coast Guard for illegal fishing operations.

BFAR Region 2 Quick Response Team head Rommel Diciano was with the Coast Guard.

Collado then called MCS 3007 under the command of Capt. Allen Toribio.

At that time, MCS 3007 was headed to Babuyan Island, but upon receiving the call it immediately proceeded to Camiguin Island.

2-hour chase
Toribio said the word “Subic” was merely spray painted on the Chinese fishing vessel which zigzagged in an apparent effort to lose the two MCS vessels.

“When our ship was positioned at the back of the Chinese fishing boat, our boarding team boarded the fishing boat and they crept toward the bridge of the fishing board and ordered the skipper to stop,” he said.

“There were other additional personnel who helped secure the fishing boat. Our men are used to boarding ships even at high speed.”

Toribio said to board the Chinese ship, they kept up with the speed of the other vessel.

The MCS ships then positioned themselves at each side of the Chinese vessel to “sandwich” it and force it to stop, he added.

It was only when they successfully boarded the vessel that they discovered the 10 Chinese on board.

They were brought to Port Irene in Cagayan for investigation even as poaching charges might be filed against them.

Toribio said that they are verifying if fragments of black coral were found on board the ship.

“If it would be confirmed that there were black corals on board, additional charges might be filed against them because black corals are considered endangered species,” he said.

“This would be a violation of the Convention on international trade in endangered species of wild fauna and flora.”

this must be a mistake on the part of the fisherman. they are honest hardworking people and are more concerned about the fish rather than the international protocol for flying flags in international waters.
Give them a mandatory lecture on flags and let them go. they have mouths to feed.

An ABS-CBN News team joined Filipino fishermen in their attempt to enter the area.

"Nakisabay kami dito sa isang grupo ng mangingisdang Pinoy na susubok nga, sumubok sila na magpalaot isang araw pagkatapos ng arbitral tribunal at susubukan nga nila kung papapasukin na sila sa Scarborough Shoal," Chiara Zambrano said.

They were met by a Chinese fishing vessel, which followed them and stopped them from entering the area around Scarborough Shoal.

"Pero ang lumalabas eh parang, siguro, 40 miles pa ang layo namin mula sa Scarborough (Shoal) eh...sinalubong na kami nitong malaking China Coast Guard ship at binuntutan na nila kami kasi nakikita na nila siyempre ang direksyong tinatahak nitong bangka ay papunta doon sa Bajo de Masinloc," Zambrano added.

"At iniisip nga namin bakit kami sinusundan at binubuntutan, 'yun pala ay para hindi kami makaliko pakaliwa dahil papunta na doon 'yung Scarborough (Shoal)," she also said.

Fishermen also noticed another Chinese fishing vessel blocked the entrance of Bajo de Masinloc, one of the traditional fishing grounds of the Filipinos living near the area.

"At itinuro ng mga mangingisda na may pangalawang barko ng Chinese Coast Guard na nandoon mismo, nakabalagbag doon sa bukana, doon sa pasukan ng Scarborough Shoal," Zambrano said.

Aside from the two Chinese vessels, the group also sighted four more vessels in the area.

Because they were not allowed to enter Scarborough Shoal, the Filipino fishermen decided to just fish outside the area. However, two speed boats circled around the fishermen as they were fishing.

The Chinese Coast Guard also used their megaphones to tell the Filipinos to leave the area.

"Minemegaphone kami, kinukunan kami ng litrato at video at sinasabi nila, 'This is China Coast Guard. This is a law-enforcement operation. We order you to leave the area immediately'," Zambrano narrated.

Scarborough Shoal is around 16 hours from Masinloc town in Zambales. Because of the incident, the fishermen were only able to get a small amount of fish, enough only for a night's meal.

The Permanent Court of Arbitration (PCA) on Tuesday ruled in favor of the Philippines' arguments for maritime entitlements over the West Philippine Sea, dealing a major legal blow to China's claims in the area rich in seafood and gas reserves.

China has held Scarborough Shoal, a rich fishing ground, since 2012 following a tense naval standoff. Filipino fishermen in the area have accused the Chinese of routine harassment that have left them jobless.
