Duh!!
You claimed that as the sighting of moon is meant to establish a religious obligation (i.e determining Ramazan/fasting days), Sunnah has to be followed (i.e physical sighting of the moon is necessary)
You were asked that whether or not DNA test was acceptable as an evidence in rape cases to establish another religious obligation (Yes, punishment of a Hadd crime is a religious obligation) or, according to you, only Sunnah (i.e 4 witnesses) has to be followed in that case too.
Only someone who has an IQ equivalent to that of an an apple would claim that it is 'comparing apples to oranges'...
Well if you think Ramzan fasting and Hadd punishments are in the same category of religious obligation than i am amzaed at your utter lack of knowledge. I already categorised both obligations for you. Jurisprudence and Religious duty of faith(Farz) are two different categories. Also note DNA is not the sole means for establishing Hadd. DNA evidence is as permissible as lunar calculations are. Please read our Hudood ordinance for more enlightenment on the subject. Since you love to introduce unrelated tangents to discuss every time you run out of arguments.
From a Dawn Article
The Council of Islamic Ideology (CII) on Monday formally relegated the DNA test to supporting evidence in rape cases, belying reports last week suggesting that the council might accord the scientifically proven test prime importance in investigations against rape suspects.
Speaking at a press conference here on Monday, CII Chairman Maulana Mohammad Khan Sherani said that “the DNA test is not acceptable as primary evidence in rape cases, but it could be considered as supporting evidence”.
Our CII is made up of all schools of thought. This is an entirely different debate , one you can have by making another thread.
No, you did not provide any Fatwa stating that the scholars hold unanimous opinion regarding the sighting of the moon. (You realize how stupid it is to even claim such a thing?)... Try even harder.. Balkay rehnay dain, ap k bas ki baat hi nahi hai
Your idiotic arguments are the life of this thread. I provided multiple fatwas which you didnt even read and replied. All schools of thought enjoin moon sighting. Hanbali method says it’s mustahab to avoid moon fighting. Shafi method has no clear view on this. The rest schools of thought have fatwas , some of which i spoon fed you. But like the infant you are , you even threw out the spoon i fed you. Jahilon ko smjhana waqi meray bass ki baat nahein. But i will spoon feed you some more
School of Imaam Abu Hanifa says: 'It can not be depended upon , someone who works with calculations and fixed timing in asserting the month for because he is disagreeing with the way of the Prophet ﷺ' (Al-Fiqh-u-lislaamy-wa'delatah By Dr. Whbah Az-Zuhayli vol 2, p.599)
Imaam Maalik says: The view of the crescent can not be asserted by the saying of someone who calculates the flow of the moon and its orbit neither for himself nor for someone else because Allaah, the Legislator, made fasting and ending the fasting rely of the viewing of the crescent not on its existence; this is even if the person who did the calculations is right. So the work with the astronomical observatories even if they were right is not allowed. (Al-Fiqh-u-lislaamy-wa'delatah By Dr. Whbah Az-Zuhayli vol 2, p. 600)
Imaam Ibn Hanbal says: "We should not fast according to the stars and calculations even if they were right, for many times for they do not rely on legitimate basis. (Al-Fiqh-u-lislaamy-wa'delatah By Dr. Whbah Az-Zuhayli vol 2, p.602)
And now you are lying through your teeth ....
Show me where did I deny the Sahih Hadith you quoted.
Let me dig it out for you to your further embarrassment.
When confronted with proof from Hadeeth , this is what you had to say
The Holy Qur'an is the primary text.
All other sources are open to debate.
Establishing prohibition from that Hadith is an inference/deduction and therefore the view of Ulema and not the words of Allah almighty or the Holy Prophet (PBUH)
This is your response , when i quoted the simple Hadeeth which said “Do not Fast until.. “. This was your final argument on the subject . Sounds like rejection of Hadeeth to me.
