Should the state squeeze out every penny and punish him?

Pre bargain bail/arrest/corruption case formula is applied in every country if the accused is ready to repay considerable amount to the Govt. In this way, Govt end up getting substantial money and the accused one gets a clean chit from the courts and can do business like usual. Punishing him by sending him/her to jail may lead to no money from the accused party and the umpire he created, if taken down, results in losing jobs for the people working under him and also it hurts the economy over all if running business suddenly taken down all together.

No the Govt you are talking about is no more i.e pmln and ppp.

PTI is least corrupt so their utilization of funds will be appropriate.

People need to be punished for their crimes to the country and the people.
Getting a part of their looted wealth and allowing them to roam freely is encouraging people to keep being corrupt and whenever caught just give up a part of it, like wtf and which civilized law allows this bullshit?

If you really wanna get the money, then make a correct estimate of all looted wealth and have them sign it all.

Give part and stay free is like helping a rapist be a rapist as long as he doesn't touch your daughter.

SC rejects Bahria Town's offer to deposit Rs250 billion to avoid NAB reference

The Supreme Court on Tuesday rejected Bahria Town's offer to deposit Rs250 billion to avoid legal proceedings for illegally acquiring land for its projects in Karachi, Islamabad and Murree.

An implementation bench of the apex court was hearing a case pertaining to the implementation on a May 4, SC verdict against Bahria Town. Under the order, the court had barred M/s Bahria Town Karachi from selling any plot or constructed apartment in the housing scheme on the outskirts of the port city, declaring the grant of land to the Malir Development Authority and its exchange with the land of the private land developers illegal and void ab initio.

At the outset of today's hearing, a counsel on behalf of Bahria Town offered to submit Rs200 billion to waive off charges against the real estate developer.

Justice Azmat Saeed, who was heading the three-member bench, reminded the counsel that a fine of Rs285 billion had been imposed on Bahria Town in 2004. "If the fine money is increased by 40 per cent, it will amount to Rs300bn."

Justice Saeed noted that three separate verdicts had been passed against Bahria Town, so it should make "separate and reasonable" offers for its projects in Karachi, Islamabad and Murree.

At this, Bahira Town's counsel increased the offer to Rs250bn.

"This is not a suitable way to deal with [the apex court]," Justice Saeed said, reprimanding the lawyer. "We may ask the National Accountability Bureau to file a reference."

The counsel sought one week's time to file a reply. Justice Saeed granted the plea and directed Bahria Town to submit written offers in all the three cases.

"Our mistake was not that big," the counsel argued.

"Mistake is supposed to be of one or two kanals, not of thousands of acres," the judge replied.

The implementation bench was formed after the court had dropped the review petitions filed against its May 4 judgement barring Bahria Town Karachi from selling any plots or constructed apartments.

In its May 4 judgement, the court had declared the grant of land to the Malir Development Authority (MDA) and its exchange with the land of Bahria Town illegal and void. It had also directed NAB to continue its probe into the matters of the developer.

During the last hearing in the case, the bench had ordered the bureau to file separate references on a series of matters stemming from the Bahria Town Karachi project, including the arrears of three MDA projects.

During an earlier hearing, the court had reprimanded NAB, Pakistan Space and Upper Atmosphere Research Commission (Suparco) and the administration of Bahria Town, over what it termed their "non-cooperation" in implementing a ruling of the apex court.

Justice Saeed had warned the respondents that the judges were "about to lose their temperament" and directed NAB to ensure progress "through its actions".

I don't mind the idea of corrupt businessmen being spared jail in exchange for giving up wealth. However there are conditions;

  1. All investigations must be fully completed and there must be full disclosure of all crimes commited.
  2. Any financial crimes commited against individuals, must involve suitable financial compensation for the aggrieved.
  3. Any non financial crimes commited against invidivuals cannot be forgiven with fines, unless the victims are willing to accept compensation without govt pressure.
  4. 90% of all stolen recoverable wealth must be returned
  5. The law and processes which were exploited must be changed so that these kinds of exploitations cannot happen again.

I'm not sure I can extend the same to politicians, we should only offer them the opportunity of money in return for not executing their entire families. Unfortunately we don't have the leaders with the balls to do that.

Actually case against Malik Riaz is slightly different. He has given heavy bribes to previous Govt officials and acquire Govt's land on peanuts not that he has looted anyone's money or tax payers. Here the concerned parties are direct Bahria town and the state. A deal can be broken as per legal proceedings. Ordinary citizens who have invested their money on Bahria town can own their lands accordingly. Nothing will be confiscated.

Finally some money coming from corrupt mafia. For now Supreme court has rejected Malik Riaz offer but as per some experts, final settlement will be reached of about $3 -3.5 billion dollars. Last week SC told Malik Raiz to deposit $ 5 billion USD but in reply Malik Raiz raised their offer from Rs 200 to Rs 250 billion which for now is equivalent to $1.8-$1.9 Billions.

Govt/courts should do same with Omni Group and the other corrupt elites. Extract money from them as much as they can. There is no gain in keeping them in jails for years without extracting a single penny.
