SC rejects Bahria Town's offer to deposit Rs250 billion to avoid NAB reference

The Supreme Court on Tuesday rejected Bahria Town's offer to deposit Rs250 billion to avoid legal proceedings for illegally acquiring land for its projects in Karachi, Islamabad and Murree.

An implementation bench of the apex court was hearing a case pertaining to the implementation on a May 4, SC verdict against Bahria Town. Under the order, the court had barred M/s Bahria Town Karachi from selling any plot or constructed apartment in the housing scheme on the outskirts of the port city, declaring the grant of land to the Malir Development Authority and its exchange with the land of the private land developers illegal and void ab initio.

At the outset of today's hearing, a counsel on behalf of Bahria Town offered to submit Rs200 billion to waive off charges against the real estate developer.

Justice Azmat Saeed, who was heading the three-member bench, reminded the counsel that a fine of Rs285 billion had been imposed on Bahria Town in 2004. "If the fine money is increased by 40 per cent, it will amount to Rs300bn."

Justice Saeed noted that three separate verdicts had been passed against Bahria Town, so it should make "separate and reasonable" offers for its projects in Karachi, Islamabad and Murree.

At this, Bahira Town's counsel increased the offer to Rs250bn.

"This is not a suitable way to deal with [the apex court]," Justice Saeed said, reprimanding the lawyer. "We may ask the National Accountability Bureau to file a reference."

The counsel sought one week's time to file a reply. Justice Saeed granted the plea and directed Bahria Town to submit written offers in all the three cases.

"Our mistake was not that big," the counsel argued.

"Mistake is supposed to be of one or two kanals, not of thousands of acres," the judge replied.

The implementation bench was formed after the court had dropped the review petitions filed against its May 4 judgement barring Bahria Town Karachi from selling any plots or constructed apartments.

In its May 4 judgement, the court had declared the grant of land to the Malir Development Authority (MDA) and its exchange with the land of Bahria Town illegal and void. It had also directed NAB to continue its probe into the matters of the developer.

During the last hearing in the case, the bench had ordered the bureau to file separate references on a series of matters stemming from the Bahria Town Karachi project, including the arrears of three MDA projects.

During an earlier hearing, the court had reprimanded NAB, Pakistan Space and Upper Atmosphere Research Commission (Suparco) and the administration of Bahria Town, over what it termed their "non-cooperation" in implementing a ruling of the apex court.

Justice Saeed had warned the respondents that the judges were "about to lose their temperament" and directed NAB to ensure progress "through its actions".

Finally some money coming from corrupt mafia. For now Supreme court has rejected Malik Riaz offer but as per some experts, final settlement will be reached of about $3 -3.5 billion dollars. Last week SC told Malik Raiz to deposit $ 5 billion USD but in reply Malik Raiz raised their offer from Rs 200 to Rs 250 billion which for now is equivalent to $1.8-$1.9 Billions.

Govt/courts should do same with Omni Group and the other corrupt elites. Extract money from them as much as they can. There is no gain in keeping them in jails for years without extracting a single penny.

these highlighted sentence might be indicating the mood of bench .... should expect figure close to $ +5 billion

you dont understand how powerful pakistan would be, beyond your imagination. they lied all the way through about everything. too late, but i still feel sorry for pakistan. pak need to watch out for Bt. they dont have good intentions.

yeah...but as per some experts, final settlement may be around $3.5 billions or more which itself is not that bad. But anything close to $ 5 billion will be terrific though I doubt Malik Raiz has so much money (i.e Rs 500 billions) ?:O he may have land assets close to 1200 billion PKR as per some estimates.

I told you all before , roomers are 3 billion $$ each from AZ ,NS , Malik and Munsha and Omani wallay + many more ……. total 25+ people or groups ………. so 75+ billion $$ …….. Now Allah Knows what will happen in future , but if we do NRO and get that money that will be great ,,,,,, keep in mind if we get 75 billion that means we will lose 500+ billion which corrupt looted in last 30+ years ……….

2 to 3 billion is the amount that bahria town has made from lahore onlyy... Its peanuts..
Bahria tiwn lahore was on the outskirts of lahore where land was purchased for under a million rupee per acre (8 kanal plot) and later a single kanal plot was sold for around 4.5 to 5 million. The commercial plots were sold for 10 to 15 million for 1/4 th of a kanal. The above rates were prevalent a decade ago and the current rates for similar plots are way higher. Bahria town has 3 more schemes in lahore which cobtain thousand of kanal per scheme.
Point being.. If courts have to agree to a plea bargain then the Courts need to restrict karachi bahria to tgeir own land only with no option to expansion, get equal or more land from bahria for an artificial or man made forrest against the forest land they illegally occupied in islamabad and then fine them 4 to 5 billuon usd.
This needs to be an example for tge land mafia. If their kingpin is pinned rest will be more careful and afraid later

Payment from omni grp will take time a bit as JIT just been concluded but will happen.

Not sure Zardari and Nawaz will pay this much amount. They will rather sit in jail and buy their time to get a relief from courts if they can install judges of their liking in near by future. They can do that only if their sons or daughters become PM of Pakistan like bilawals/Mariam Nawaz etc

But seeing it from a different prespective 3 billion dollars is nothing compared to what they have stashed abroad...they can easily pay up and get a reprieve
