Article 63 (3) of the Interim Constitution provided electoral constituencies based on population, geography and special characteristics, “
and in the case of Madhes on the basis of percentage of population”. Under this provision, Madhes, with more than 50 per cent of the population, got 50 per cent of seats in Parliament. The latter phrase has been omitted in Article 84 of the new Constitution. “It needs to be re-inserted so that Madhes continues to have electoral constituencies in proportion to its population,” a government source told
* In Article 21 of the Interim Constitution, it was mentioned that various groups would have “
the right to participate in state structures on the basis of principles of proportional inclusion”. In the new Constitution (Article 42), the word “proportional” has been dropped — Delhi wants it re-inserted.
* Article 283 of the Constitution states that only citizens by descent will be entitled to hold the posts of President, Vice-President, Prime Minister, Chief Justice, Speaker of Parliament, Chairperson of National Assembly, Head of Province, Chief Minister, Speaker of Provincial Assembly and Chief of Security Bodies.
This clause is seen as discriminatory for the large number of Madhesis who have acquired citizenship by birth or naturalisation. Delhi says this should be amended to include citizenship by birth or naturalisation.
* Article 86 of the new Constitution states that National Assembly will comprise 8 members from each of 7 States and 3 nominated members. Madhesi parties want representation in National Assembly to be based on population of the Provinces. This, Delhi says, should be done to address concerns.
* Five disputed districts of Kanchanpur, Kailali, Sunsari, Jhapa and Morang: Based on the majority of the population, these districts or parts of them may be included in the neighbouring Madhes Provinces.
* Article 154 of the Interim Constitution provided for delineation of electoral constituencies every 10 years. This has been increased to 20 years in Article 281 of the new Constitution. Echoing the Madhesi parties, India wants this restored to 10 years.
* Article 11(6) states that a foreign woman married to a Nepali citizen may acquire naturalised citizenship of Nepal as provided for in a federal law. Madhesi parties want acquisition of naturalised citizenship to be automatic on application.

Article 63(3) : India too follows the same system. Where sparsely populated Mijoram and Sikkim gets atleast 1 representative but bihar gets around 30 . If you go just by population then sikkim and mijoram will not get any representatives. So, do you think this is fair? This is whats madhesis want entirely population based representatives. What we have ? Like India population and geography based representatives.
Article 21 : Madhes is a geography , its the plain. And madhes of Nepal have mixed population. Today 52% population live in madhesh and it includes maithili speaker (madhesi) , hills khas aryan, hills indigenious, madhes indigenous ( tharu) etc. Madhesi wants 52% inclusion but hill khas aryans, hill indegenious cant be part of it.
For eg. Maharashtra has mixed population from around the India right? And it includes bengali, gujarati, parsi, punjabi, muslim everyone which is lets say 20% of entire India's population. So, would it be fair to ask reservation in the name of everyone living in maharastra ie 20% and only marathi people be allowed to enjoy it.
Nepal is giving 45 % inclusion , highest in any country. Even India doesnt have reservation acc to population. These madhesi are asking reservation but they have their own caste system. And social disparity is highest in Madhesh but they dont want inclusion in the name of madhesi dalit, madhesi muslim, madhesi musahar, madhesi brahmin. They want exclusively 50% reservation where only madhesi be allowed. And no specific inclusion for lower caste, untouchable, indigenous tharus shoudl be included in this 22% . There fore only higher caste, rich jamindars , madhesi ellites who make up around 1% of population will enjoy , exploit this. So do you think is fair for others who have been denied of inclusion.
Article 283, if indian law doesnt allow sonia gandhi to become pm of India, please dont expect that from us.

Arrey yaar, those districts are happy where they are. There are no protests in thsoe areas except few. You tell me if darjeeling doesnt want to be under sikkim and is happy with w.bengal, then should anyone be pressurized to have included darjeeling under sikkim? Is it fair for sikkim to burn for darjeeling , while darjeeling are happy where they are?
Article 20, Nepal does it in every 20 yrs or 30 yrs, why should that matter to India? Do you know Nepal is one of the poorest country in the world , and it cannot afford many things?
With so many illegal citizenship being sold, Its Nepal jobs to make sure it is being well checked. Whats the big deal with doing some extra paperworks to get citizenship via mother?

Read your constituion well enough, India represntative is according to geography where sparsely populated Sikkim and Mizoram gets 1 representative and higher population gets more representative.
How will India suffer? Do you really think India will suffer? India is such a big democratic country , India aisa toh kaccha kha jayega. Nepal is a small country, Nepal wont be able to handle it. So much concern for Bihar election but Why no concern towards Gorkhaland issues? Why border arent being sealed that side too ?

No truck were allowed until yesterday morning, but then few trucks started moving in since afternoon. Trucks are lined but they are moving too.
Brother you have to understand States 1 and 2 wants those 3 districts. Both have warned if they donot get those 3 districts things , they will vandalized. But those three districts are happy being in state 1. There is protest but in vy few places of thsoe 3 districts. Now how will government fulfil tehir demand, its like kashmiri asking for free kashmir. How can India fulfil that demand? Its not viable.

At the end its Nepal's issue. And India should have remained shut. Since India doesnt like pakistan speaking on kashmir issue, we also dont like being interfered. But if you go my way or highway and avoid seeing truth, all the best.
No one shoudl interfere in anyone else's internal affair. India could request Nepal to make sure it doesnt affect Bihar election but not go bossy around, sending their envoy to order us to do this and that. jaishanker coming on last min of constitution being drafted and not being worried about bihar election or petrol tanks speaks alot.
Beinga a neighbour, we wish India on every Independence day but on such a big occasion India was worried only about their petrol tank and bihar election, that too on the eve of official constitution drafting ceremony. Before that what was India doing?
