Ayodhya verdict: Ex-SC judge Asok Ganguly raises questions about evidence that land belonged to Ram

Retired Supreme Court judge Asok Kumar Ganguly on Saturday raised questions about the Supreme Court’s verdict on the politically-sensitive Ayodhya title suit and said he was disturbed by the judgment.

The ruling by a five-judge constitution bench of the top court on Saturday held unanimously that a Ram temple would be built at the 2.77-acre piece of land in Ayodhya and ordered the government to give Muslims an alternative five-acre plot in a prominent place in the ancient city in Uttar Pradesh.

“I am a little disturbed by the judgment. When the Constitution came we saw a mosque and in the previous judgment of the Supreme Court relating to the demolition it has been recorded that there was a 500-year-old shrine which has been demolished,” Ganguly said while speaking to HT.

“When the Constitution came, the law became different. We recognised the fundamental right to freedom of religion; practice, preach and profess religion. If I have that fundamental right I also have the right to protect the shrines. The day the structure was demolished that right was also demolished,” he said.


Ganguly, who has written the book Landmark Judgements that Changed India, asked what evidence did the judges based their judgement to say that the land belonged to Ram Lalla.

“You have said that there was a structure under the mosque but you have not said that the structure was that of a temple. There is no evidence that after the demolition of a temple, a mosque has been built. On the basis of what archaeological insight can court decide that after 500 years?” said Ganguly, who is also a former chairperson of the West Bengal Human Rights Commission.

The Supreme Court, he pointed out, has accepted that if namaz is offered in a place then it has to be considered a mosque.


“So considering it a mosque, which has been standing there for 500 years, how do you decide the title after 500 years? On what basis can you do it? Those who have come here (in court) to depose have documents. On the basis of archaeological report you cannot decide titles,” said Ganguly.

“And today what will people think? That in 1992 this mosque was demolished, now it is 2019, and in 2022 they challenge the Supreme Court? What happens to constitutional morality? That is something I felt a little disturbed about,” said Ganguly who retired in 2012.

The bench, in the main verdict that political parties hoped would end the decades-old dispute, largely relied on evidence that established “consistent pattern of worship by the Hindus in the outer courtyard.” There was no documentary material to indicate either “settled possession or use of the outer courtyard by the Muslims.”


The judgment, however, has not given possession of the 1,500 square yard piece of land that has been in dispute for decades to Ram Lalla.

The top court ruled instead that this land will continue to remain in the statutory receiver under the Centre till the government comes up with a scheme to set up a trust and a formal order is issued.

The removal of Kashmir’s Article 370 went through despite raising eyebrows, with no consent from the Kashmir assembly legislature. The SC didn’t even rule on it, and just waived it through

India is a fascist state, nothing else to it.

nonsense. Destroying any place of worship is wrong. The babri mosque built over the temple was wrong and so was destroying the mosque outside of a clear court verdict. Therefore since two criminals acts had been committed - one to build the mosque over the temple structure and second the destruction of the mosque by the mobs - the Supreme Court provided relief against both crimes. No better verdict is possible. Well done.

Supreme Court of India has acted like a brothel house, offering it's services to the more powerful party. These 5 judges are no better than third grade pimps, of third rate prostitutes.

Not really. There are those who openly sided with the Sanghis, then there are those who were co-opted, either by threats or money.

The sexual harassment case against CJI Gogoi was nothing more than a tool to co-opt him. Just as easily the case was created against him, with same ease it was withdrawn when he got in line.

All institutions in India have been destroyed. The Supreme Court was the 2nd last one. The last one will be the Federal-State structure, a glimpse of which was provided by the Bifurcation of J&K. States like West Bengal, Tamil Nadu, Kerala that do not fall in line, will be similarly dealt with.

this chest beating is ridiculous. the SC of India delivers a verdict that makes both communities happy - and you guys think it's because the CJI was compromised.

Umm no. If you believe your preamble, the neutral outcome would be to build a non-religious neutral structure there. Missed opportunity for India.

Missed opportunity indeed - this I'd agree with. Instead of shooting for a huge pay off, what was rendered as judgement was a defensive compromise.

Building a hospital or university or a stadium. in fact Lord Rama would have preferred that.

How do you know it was built over the birthplace of your Lord RAMA? His birthplace is disputed amongst Hindus.

I don't listen to Orya Maqbool Jan. But just going by the caption I wonder how anything would result in further division of India (with Kashmir and Punjab being an exception)? I don't see any geographic center for Muslims to start a second separatist movement. I also do not think the liberal and moderate Hindus would stand up to Modi/BJP anytime soon.

Pakistani spinning machine at it again :disagree:....there is a complete proof of a temple remain beneath the structure, islamist need to take a hike & get used to it, the sooner the better. Its is a landmark judgement & would be used to reclaimed Hindu temples under other disputed structure.

Going to the supreme court and asking for justice is an Islamist viewpoint? lol you don't even know the proof they provided. The whole proof is based on pillars that MAY represent a larger temple... The archeologists failed to mention that there were forts, homes and other buildings surrounding the mosque for 1000s of years. How is the supreme court so sure that these pillars are from the temple. The location is disputed even amongst Hindus. Its a landmark judgment to you because you are a RSS nazi and you want to spread hate and deceit amongst the populace so that you could be promoted to from a shudra to a vaishya in the next life.
