Australian court acquits PAF cadet of indecency charges

ISLAMABAD: An Australian court of law has announced acquittal of an Aviation Cadet of the Pakistan Air Force of the charge of “indecency” levelled by his co-cadet at the Defence Air Force Academy (DAFA), Australia.

Aviation Cadet Obaid Fayyaz, who is under-training at the DAFA, according to Austrian newspaper Canberra Time, faced the charge of indecency in the court of law, where his counsel pleaded him innocent. The court, after conducting thorough deliberation into the case, declared him innocent thus acquitting him of the charges.

“It is a big relief for me to get rid of the allegation and being declared as innocent, for that I must appreciate the Australian judicial system,” Cadet Obaid told media after the verdict, “justice has been done,” he added. Cadet Obaid would continue his training at the DAFA with all dignity and honours.

The PAF has welcomed the verdict of the Australian court and expressed the resolve that its officers, men and women, would continue to maintain all- time highest values to keep the PAF flag at the upper most level.

The problem is that his credentials have already been smeared. He just doesn't know it yet. PAF is a very uncompromising place. He needs to rethink his future, else he will have trouble being promoted beyond Air Cdre. Someone is bound to bring this unfortunate incident up again in 20 years @ PAF. No matter, even if he was acquitted of any wrong-doing!

that would be politics and completely unfair of the PAF promotions board.

The lawyer for an Australian Defence Force Academy cadet who is accused of secretly filming a woman in the shower says his client in fact wanted to film himself for his fiancée.

Pakistani national Obaid Fayyaz, 21, has pleaded not guilty to an act of indecency without consent.

The ACT Magistrates Court has heard Fayyaz put a mobile phone in a vent above a shower at the academy last year.

A female cadet used the shower and found the device.

Today Fayyaz's lawyer John Harris SC told the court there was no direct evidence Fayyaz intended to film the woman.

He said he instead wanted to film himself for his fiancée.

Mr Harris argued the facts of the case did not fit the charge because Fayyaz was not physically present at the time of the alleged act of indecency.

Mr Harris said there was also no certainty anyone would come into the shower while the phone was filming.

But the prosecution rejected that argument, saying the act Fayyaz is accused of does fall within the scope of the legislation.

The court also heard Fayyaz will apply to vary his bail conditions so he can visit family in Pakistan, and he hopes the matter will be resolved soon so he can resume his ADFA study in July.

The hearing continues.

i am also interested to learn what actually he was being accused for?

That is good that court have declared him innocent!

On the contrary, the gentleman cadet deserves all the recommendations and acknowledgement for standing up to the accusations and proving them false. If anything the story spinning culprits should be taken to task.

The guy claims he set up a camera in the shower to film himself but he "accidentally" filmed another female cadet showering.

The story is a bit hard to believe. He was found not guilty because they can't prove that wasn't his intention.

There are many Muslims in Australian armed forces and are allowed to practice religion freely. There are some issues but out of the scope of this thread.

No, the charge was dismissed on a technicality. It seems Australian legislature hasn't caught up with present day reality. So the judge had no other choice than to acquit him.

Magistrate Peter Dingwall said the case was ambiguous and ruled the act of indecency was not committed because Mr Fayyaz started recording when the alleged victim was not present.
