ISLAMABAD: Interior Minister Chaudhry Nisar Ali Khan has revealed that late additional district and sessions judge Rafaqat Ahmed Khan Awan was inadvertently killed by his own guard and not by the terrorists in a gun and bomb attack that killed 11 others in Islamabad on Monday.

In Islamabad district courts, 12 people were killed and 28 sustained injuries according to the latest figures, he told the lawmakers in National Assembly, adding the culprits of the incident would be brought to the book as important progress in the case had already been made.

Lamenting portrayal of the country as unsafe by some members of the Parliament during the discussion, the minister said other countries give message of unity after such incidents but in Pakistan, the reaction was totally different.

He urged members to avoid statements that demoralise the security forces, adding patriotism demanded that the shortcomings of the forces should not be made public.

Attacks on soft targets occur in the world, he said adding at the time of district court incident the deceased judge locked himself and staff in his retiring room but unfortunately the security guard deployed with him inadvertently shot the judge with three bullets in panic after the suicide blast.

He said speculations must be avoided on the incident of Islamabad district courts.

The guard had already confessed his crime and the post-mortem report showed that the judge had not been killed with Kalashnikov but with the guard's weapon.

Referring to F-8 tragedy in Islamabad, he said the judiciary and the lawyers’ community reacted in a responsible manner and sent a strong message that we are united against terrorism. He said similar message should have come out from the floor of Parliament but unfortunately some members resorted to undue criticism.

Chaudhry Nisar Ali Khan acknowledged that there are threats but added that, “our weaknesses are not as strong as have been highlighted by the opposition.”

“Patriotism demands that we should identify our weaknesses but not convey them to terrorists,” he added.

The minister said there were some short comings in security of the Islamabad district courts and added that, “we have learned a lesson from the incident.”

ISLAMABAD: Judges of the special court constituted to try former military ruler Gen (r) Pervez Musharraf for treason on Friday rejected the objections raised by the former president's legal team.

Lawyers for the former general had filed three applications challenging the appointment of the head of the prosecution team, the establishment and jurisdiction of the special court accusing its judges of bias against Musharraf.

During the hearing, lead judge, Justice Faisal Arab, read out the 27-page verdict, which had been reserved earlier on Feb 18.

Following the hearing, Justice Arab said the three-member tribunal had dismissed Musharraf's objections.

The judges have set March 11 as the date to indict the former general, who was ordered to appear in person to hear the charges being read out against him.

He was first ordered to appear before the tribunal on Dec 24, but has missed repeated hearings since then due to bomb scares and health problems that saw him complain of a heart ailment.

The former military dictator appeared in person before the judges for the first time last month after repeated delays.

Musharraf is facing treason charges, which can carry the death penalty, over his imposition of a state of emergency in 2007 while he was president.

Defence lawyers had previously contended that unless the jurisdiction of the court was decided, Gen Musharraf could not be indicted.

The 70-year old is also facing three other high-profile cases which include his alleged involvement in the assassination of former prime minister Benazir Bhutto, the killing of Baloch nationalist leader Nawab Akbar Bugti and the case relating to the murder of Lal Masjid cleric Abdul Rasheed Ghazi during the army operation on the mosque in 2007.

ISLAMABAD: The district courts attack case took another twist on Friday when the gunman of the slain additional district and sessions judge (ADSJ) denied allegations of shooting him.

ADSJ Rafaqat Ahmed Khan Awan and 11 other people were killed during the attack on the district courts premises on March 3.

Interior Minister Chaudhry Nisar Ali Khan on Thursday told the National Assembly that the ADSJ was killed from the bullets accidentally fired by his own gunman, Babar Hussain.

The Joint Investigation Team (JIT) constituted to probe the March 3 terror attack has already taken Hussain into custody and on Friday produced him before Special Judge Anti-Terrorism Court Atiqur Rehman to obtain his physical remand.

As judge Rehman has banned the entry of mediapersons into his courtroom since August last year, the media could not cover the proceedings. However, sources close to the development said the gunman contradicted the statement of the interior minister and pleaded not guilty.

The sources said Hussain informed the ATC judge that he was with the ADSJ Awan when the terrorists stormed the courtroom and tried to enter his chamber.

The terrorists broke the door of the chamber and shot ADSJ Awan in the chest, the sources quoted the gunman as saying.

When contacted, Naseer Kayani, the president of the Islamabad Bar Association, said the statement of the interior minister was highly condemnable. He said the minister had tried to divert the case to some other directions by giving such a misleading statement.

Mr Kayani expressed the possibility that the police might have pressured Hussain to make a fake confession in order to save their skin.

“The bar will file an application with the Supreme Court of Pakistan against the irresponsible statement of the interior minister, implicating an innocent man in the crime,” he added.

Dr Arif Alvi, Member National Assembly (MNA) of the Pakistan Tehrik-i-Insaf (PTI), while talking to Dawn said the interior minister had on Thursday expressed the possibility that bullets accidentally fired by the gunman might have hit and killed the ADSJ.

He said when the case was under investigation, it was premature to comment on the matter.

When contacted, Danial Gillani, a spokesman for the interior ministry, said the case was under investigation. “The exact detail of the tragic incident can only be given after the JIT submits its report,” he added.

RAWALPINDI: The Rawalpindi anti-terrorist court on Saturday adjourned the Benazir Bhutto murder case to March 22 after Federal Investigation Agency (FIA) special prosecutor Mohammad Azhar Chaudhry failed to appear before it on account of security concerns, DawnNews reported.

The case was heard today by ATC judge Pervez Joya within the premises of the Adiyala prison.

During the hearing, former City Police Officer (CPO) of Rawalpindi Saud Aziz, former SP Rawal Town Khurram Shahzad and Malik Safdar Javed Advocate appeared before the judge.

The hearing was however adjourned on account of the special prosecutor’s absence.

Azhar, who took over as special prosecutor in the case just last year, assumed the position after his predecessor Chaudhry Zulfiqar Ali was shot dead in Islamabad’s G-9 area in May 2013.

Benazir Bhutto was assassinated in a gun-and-bomb attack outside Rawalpindi’s Liaquat Bagh on Dec 27, 2007 when Pervez Musharraf was president. She was killed shortly after addressing an election campaign rally in the city.

Last year in August, Musharraf was indicted on three counts over Benazir’s murder.

Others accused in the case include Aziz, Shahzad, Sher Zaman and Abdul Rasheed

ISLAMABAD: Taliban and al Qaeda terrorists are planning to carry out an assassination attempt on former president Pervez Musharraf, the Interior Ministry said in a letter Monday, prompting media speculation that the former military ruler may not appear in court on Tuesday.

In the letter sent to the Home Secretary Punjab, the Islamabad police chief, the chief commissioner and other officials, the Interior Ministry warns that miscreants affiliated with the Tehreek-i-Taliban Pakistan (TTP) and Al Qaeda have planned to target General (R) Pervez Musharaf in the near future.

According to the letter, a copy of which is available with DawnNews, the ministry warns that the attackers have planned to assassinate Musharraf inside or outside the court. The ministry advises extreme vigilance and fool-proof security measures be taken to avoid any untoward incident.

Media reports on Monday quoted Musharraf’s lawyer Ahmed Raza Kasuri as saying that his client would not appear before the special court on Tuesday until he is provided fool-proof security.

The former military’s chief’s lawyers have previously warned the court that terrorists have been planning to kill judges and Musharraf’s lawyers

“I have received some information that terrorists are planning to assassinate the honourable judges (of the Special Court), two defence lawyers and a prosecutor,” Musharraf’s lawyer Rana Ijaz told the court last week.

well MQM has its local patriotic command, & has the manpower to start any massive political movment against wrong doings of the govt, eventully leading any joint opposition!

people like barrister saif of APML and ladies like asia ishaq are very talented genuine people, will eventually start immense campaigning under MQM

ISLAMABAD: Former president retired General Pervez Musharraf has sought high treason trial of civilian leaders and military officials who allegedly abetted in the imposition of state of emergency on Nov 3, 2007.

In an application filed in the special court seized with his treason trial on Monday, Gen Musharraf requested the three-member court to summon all those who had been consulted by him before the imposition of emergency.

According to the proclamation issued about the emergency, Gen Musharraf imposed emergency after consultation with the then prime minister, governors of four provinces, chairman of the joint chiefs of staff committee, chiefs of armed forces, vice chief of army staff and corps commanders.

He requested the court to initiate a trial of all of them together and argued that in the face of such omission, his trial would stand vitiated.

The application said: “Sub clause 2 of the Article 6 of the constitution highlights abettors and collaborators, rendering them equally liable with same quantum of punishment as required to be meted out to principle offenders.”

It said that the High Treason Punishment Act 1973 made it imperative that the court would take cognizance on a written complaint made by a person authorised by the federal government. Under section 5 of Article 6, the federal government is required to forward to the special court a complaint with a list of accused persons.

It was the legal right of the accused to be provided the investigation report and material on which it was based and the report of the supervisory committee, the application said.

It said that some members of the investigation team wanted to arraign all abettors and conspirators with the principal accused. Those officials who submitted a report have been sidelined as the report did not fulfil the desire of the prime minister.

It said the report had been withheld on the pretext that it went against the government’s prerogative to arbitrarily choose the accused, even though they (the abettors and conspirators) might be identically placed.

“Unless the names of all co-accused are supplied to the respondent (Musharraf), the very taking of cognizance by this honourable court becomes both questionable and controversial,” the application argued.

It requested the court to provide Gen Musharraf the inquiry report prepared by a four- member team of the FIA.
