Afghanistan wants India’s inclusion in Pak-Afghan transit pact

This point was raised by Pakistan Amb. to US. That Afghanistan is given access to Pakistani ports because it is a landlocked country and according to international law must be given transit rights to access ports. He then said according the same international law Afghanistan must give transit rights to Tajikistan and other CARs to access Pakistani ports.
First Pakistan must sign a pact with Afghanistan to uphold international law in this regard. Their 3 million citizens in Pakistan seems like the only leverage we have, so if they don't agree push a hundred thousand Afghan citizens into Afghanistan and keep doing it in intervals until they agree or we have zero Afghans.
Just impose duty on transport which can be levy as per International law the will come to senses...This law is also net binding ...Iran has not given them access from last 70 years..

The major conditions discouraging the trade include the containerization of goods, insuring goods, installing tracker system, scanning of export goods, difference in grantee vale, monopolized transport system etc

These measures still haven't mitigated our concerns. We should complete the fencing ASAP and should stop any kind of transit for Afghanistan. National security and stopping drugs is more important than trade with Afghanistan. For trade with CAR we can go via China.

Lollz, the duty has to be credited back once cargo enters Afg borders. It is not only Afg. but also Pakistani political, security and businessmen who make billions from smuggling goods back to Pakistan.

I am not talking here what corrupt businessmen doing..Just speaking of legal position and what Iran has done

You can't hav any meaningful trade via karakoram highway . 99% of your trade with china is happening tthrough sea route.

No, There is no such legal position which Iran took in this case. As a landlocked country, Afganistan can ask for the access to the sea as per international laws. Afg. preferred Pakistani route via Karachi port as most of AFG population is on the eastern side of Afg and it is also the shortest route to the sea.
There was no big port in Iran on their eastern side which Afg could access. With Chabhar on the plan now Afg. do have an option and if Iran was so anti-Afg. They wouldn't have been into Chabahar link to Afg. and Central Asia.

More importantly, the convention provided them with the right of access to and from the seas and freedom of transit. However, the law makes such rights subject to the agreements to be made by land-locked and transit states. This, in turn, depends on the prevailing relations between the concerned states.
So ,it depends on Pakistan..
It is good for Pakistan internal security if they use Iran port in future..Less interface with Afghanistan, more the peace in Pakistan

There will always be a way, we can trade with Afghanistan, your denial will only cost you more.

Last time i checked it was afghan traders who suffered and had to bear the brunt of cost and loss because the Goods rotted away on their airport when they opted for Air corridor

You are 100% correct. Now please go through 1965 and 2010 Afg. Pakistan transit agreement.
Both states, Afg. has a right to use Pakistani transit route about Paksitan doesn't have. Now Pakistan needs a transit route from Afg. to central Asia for CPEC. So it is Pakistan who wants a re-negotiations for the transit agreement. Afganistan states, Ok if you want a re-negotiations currently our trucks go until wagha border carrying goods to India, and come back empty or with Pakistani goods. Afgs want that their trucks should be allowed to bring Indian goods to Afg. from Wagha border.

So, Pakistan doesn't want to cancel the agreement because of the prevailing relations between the concerned states. As India and Pakistan relations are in a much worst situation than Afg.Pak relations and it will give a free hand to India to cancel IWT for the same reasons. :-)

You are wrong again..Pakistan already have the access to CAR as per previous agreement with Afghanistan..That is why Afghanistan has been allowed to trade with india...Further not Pakistan, afghanistan has requested to change the treaty..
On second point no one in India is naive to cancel a IWT for a minimal trade with a country like Afghanistan.
