Exhume Hena’s body, HC orders

The High Court on Monday ordered exhumation of the body of teenage girl Hena who was allegedly whipped to death after rape in Shariatpur last month to ascertain the reason of her death.

The court ordered formation of a three-member body of doctors and forensic experts to conduct further post-mortem as the reports of police inquest and the post-mortem, as reported in The Daily Star on Monday, failed to convince it.

The court also summoned Sub-Inspector Aslam Uddin, who prepared the inquest report, doctors Sultan Ahmed and Nirmal Chandra Das, a senior nurse and other doctors at Shariatpur Sadar Hospital who attended Hena, and arbitrator Idris Sheikh, a local Union Parishad councillor who allegedly whipped Hena, to appear before the court at 10:00am on February 10.

The bench of Justice AHM Shamsuddin Chowdhury Manik and Justice Sheikh Md Zakir Hossain passed the order in a suo moto move following publication of a report in The Daily Star headlined “Police, post-mortem miss injury marks” on Monday, our staff correspondent who covered the event at the HC reported.

The report says neither the police inquest nor the post-mortem found any injury marks on Hena's body though the national media quoting numerous witnesses had reported she had been whipped to death following a fatwa at Chamta village of the district.

Both the reports contradict the confessions made by the two detained local arbitrators before a court that the girl had been lashed in their presence, The Daily Star found.

Picking up the clue form the report, the HC on Monday ordered Shariatpur deputy commissioner to exhume Hena’s body for further post-mortem.

The HC bench ordered civil surgeon of the district to form a three-member committee comprising a gynaecologist, a forensic expert and one of the two doctors of Suhrawardi Medical College and Hospital quoted in The Daily Star report.

The court asked the concerned to submit the post-mortem report before it as soon as possible.

To expedite the process, the bench ordered the HC officials to convey its order to Shariatpur DC, civil surgeon and other concerned by the same day (Monday).

According to witnesses, Hena was whipped at least 50 times a day after she was raped allegedly by her 40-year-old cousin Mahbub and physically tortured by Mahbub's wife and in-laws on January 23.

The next day, Imam of local mosque Saifullah passed a fatwa for whipping the girl 101 times and Mahbub 200 times. He also fined Mahbub Tk 50,000.

The fatwa was given in a closed-door meeting, arranged by the family of Mahbub's wife Shilpi in collusion with Idris Sheikh, member of Chamta union parishad.

At one stage of the lashing, Hena collapsed to the ground, witnesses add.

Still, Idris and some others did not allow Hena's family to take her to hospital until January 25, when her condition worsened.

Following her death, police arrested four people -- Hafez Mofiz, Joynal Shikhder, Ala Box, and Shilpi. Hafez Mofiz, Joynal Shikhder made the confession before a magistrate court.

Police have yet to arrest the rest including the main culprit Mahbub, Saifullah, Idris and Monimala, who lashed Hena.
