9 jailed Maoists are ‘political prisoners’, rules Kolkata court

I am not saying that. But you cant put an end to it, by blocking businesses is what I mean. Nor can you put an end to it by using the techniques of the maoists.

BTW, as long as there is a democracy, we will have this crony capitalism problem. Its unavoidable. Best thing to do is to privitize a lot of stuff, so atleast there will be competition,

It's good idea to officially recognize that Naxalites are different than Jihadis and other separatists.
Naxalites/Maoists are NOT separatists. They are very much Indians by blood, language, culture etc. They don't claim to be foreign migrants like some Kashmiris do. They are not fighting to break India and form a homeland for some religion/tribe/caste or such group of people. They are not even a caste based terrorist organization like Ranvir Sena. They are just fighting for a different political system in India. They are basically a violent political party.

Yes they use violence, yes they are in extortion, kidnappings and such crimes. They should be tried and punished for that. But that does not make them separatists. Just as riots and other form of violence does not make RSS/Bajrang Dal and similar organizations into separatists, traitors, desh-drohis. One is right wing extremism, the other is left wing extrimism but both are Indian. The only difference is the foot soldiers of Maoists -Adivasis/Tribals of central India- are probably the most ancient and original Indians.

Maoist are against Indian constitution, killing our soldiers and collaborating with people wishing to break India. They need to be dealt properly.

 Putting people in prison just for their beliefs (or even just eating beef), what an oppressive country.

You are a false flagger aren't you??
Your rants are similar to our western neighbour.

Maoist are against Indian constitution
Thanks I was waiting for exactly this argument. Technically yes, fighting against Indian constituion can be called treason. But you can't be so rigid that you will send a cartoonist to jail on charges of sedition; you have to understand the sentiments behind the cartoon, isn't it?
Even lot of people supporting upper caste right wing political organizations are against Indian constitution. If you go through Indian comments on any forum/newssite, you will see them shouting 'scrap Indian constitution' and all this in typical abusive language of feudal mentality people of subcontinent. Has it ever crossed your mind it sounds same as Maoists? RSS till recently used to be reluctant to hoist Indian tricolour on Independence day. They have their own logic for that. Does that make them anti-national elements ?

YOu need to read the real new in CHina.....your govt just steam rolled over a peasant who not selling his land for very little money. The govt squashed his body to the point that brains spilled on the floor. Oprressive isn;t it? Oh you might be able to read that in the news, coz you govt censored it. Try your version of twitter to get the real news....

Listen thta what the Naxalites and Maoists are doing....... fighting for justice. They went thru non violent methods initially, but then gave up that route because the govt was not paying them any attention, in fact ignoring and even torturing them. Admit that our govt has become extremely corrupt, Anna Hazara has highlighted gaping problems with our govt and the corruption that permeates throughout all govt office. The same folks who belittle and mock the Maoists/Naxalites, do absolutely nothing to protest the corruption in India that led to these indigneous groups fighting in the first place. Maybe some of you like the status quo, fortunately many others don;t. How come the govt since independence has not done a damn thing yet to curb corruption yet? No major effective laws have been passed, in fact aiding such criminals who engage in such activities. That;s the folks who argue against the Maoists/Naxalites don;t have a clue what you are talking about

My confidence in teh India Against Corruption initiative has long died and been buried. This is just another means of trying to get into politics. I dont think corruption can be eradicated by creating another bureaucracy. Our country is already plagued by the same thing.

9 jailed Maoists are ‘political prisoners’, rules Kolkata court

NEW DELHI: Several jailed Maoists will now be entitled to privileges of a separate cell, home-cooked food, access to newspapers, books and other reading material, meeting with relatives and advocates and greater freedom inside jail compared to other prisoners.

A Kolkata court on Friday declared nine suspected Naxalites arrested by the National Investigation Agency in connection with the CPI (Maoist) arms manufacturing case as 'political prisoners'. The prisoners include CPI (Maoist) technical committee head and the man behind the outfit's rocket launcher factories, Sadula Ramakrishna alias RK.

While the NIA is likely to challenge the verdict, this comes close on the heels of an August order by Calcutta high court which declared eight suspected Naxalites, including senior CPI (Maoist) leader Chhatradhar Mahato, political prisoners.

Security agencies look at the two orders as precedent-setters that will make more jailed Naxalites push for this status across the country. Already, several suspected Maoists have been on hunger strike in Maharashtra jails pushing for this demand.

Agencies also see the order as a symbolic victory for the Maoists who have been able to take the offences related to Naxal violence out of the purview of terrorism or general crime and have made their violent activities look political.

The present order came in response to a petition filed before the Kolkata sessions court by the nine accused arrested by NIA. The petitioners sought status of political prisoners even as NIA opposed the pleas. The court, however, overruled NIA's objection citing the August 8 Calcutta HC judgment that had granted political prisoner status to Mahato and seven others.

The status was granted under the West Bengal Correctional Services Act, 1992. According to the Act, political prisoners are those who are arrested or convicted on a charge of having committed or attempting to commit aiding or abetting the commissions of any political offence. It is applicable even if the person is charged under the Indian Penal Code.

The law also says that anyone who commits or allegedly commits an offence during a political or democratic movement with an exclusive political objective, free from personal greed or motive, is entitled to political prisoner status. Even charges of waging war against the nation cannot prevent an accused from being granted the status.

Understandably, security agencies are not very enthused by the order. A senior official from the security establishment said, "The order has effectively, even if symbolically, separated the Naxalites from other terrorists. But even a Hafiz Saeed does not spread violence for personal gains and fights for an ideology and a particular political order. Should he be granted the same privilege if he is arrested?"

A senior NIA official said the agency would study the order, consult the government and then appeal against it in the high court.

However, those fighting for the rights of prisoners have welcomed the decision. Lawyer Surendra Gadling, who is representing several suspected Naxalites in Maharashtra, said, "Maoists are merely struggling for a different political order. They cannot be equated with other criminals. They are essentially political prisoners."

In other words maoists are freedom fighters.Overall good judgement by the courts.

These Bengali's(not all) always have affection with Maoist idea, problem's root arises with CPI government spoon feeding communist ideas and related courses to children from school itself!! :hitwall:

If Maoists be treated as political prisoners simply because they have a political ideology. The problem with this decision is that all terrorist movements are political, be it Hezbollah, Al Qaeda, IRA, LTTE or the Lashkar –e-Taiba. All these groups have a well defined political agenda with a specific goal of attaining power!!

Killing of security personal, civil authority and even civilian in Left Wing Extremist (LWE) is very common!! Hope the son of these judges has ever served in CRPF or even served nation's any security force they would have not dared to demean the motivation of security forces who had laid their life uselessly to capture these Maoist alive!!! :sniper:

Sir I would request you to visit any Maoist infested area, you would know the truth then and there only!!

You won't find this in news but I am telling almost everyday a villager is being murdered in Khuti District of Jharkhand, on charges of being CRPF informers.

This maoist operation has gone way away from exercising political idea of communism, no civilian authority is able to do any kind of development, even basic amenities like Government hand-pumps or public toilets in LWE areas because they threatened by these Maoist. They don't want any kind of development in that area because with development their breeding ground, poor village will become economically competent enough to feed themselves !!

Almost all political parties fund these Maoist Group to gain vote (not known by many as Maoist oppose voting system itself) but all pol parties try to side with most powerful Maoist faction in their constituency!!

Maoist are getting not only funded by these political parties but also get political clout with their party in power!! As not many here would know that no CRPF search or Combing operation takes place without taking State police along with them !! Most of the hideout and secret information are passed on to CRPF company headquarters from City Superintendent of Police (City SP) collected from different sources and security agencies.

And in India we all know City SP dances on whose tune, state government:hitwall: Only when these Maoist started to undermine states power, they cried for central government help!! and then again opposition parties start getting cozy with these Maoist and starts defending them and this vicious cycle goes on and on!!
