The ICC can intervene only when a member country is unable or unwilling to prosecute war crimes, crimes against humanity or genocide itself. The Afghan government asked the ICC to stop its 15 year probe into war crimes since it is investigating those crimes itself, thus taking it out of ICC jurisdiction.
