The US has released guidance on its immigration laws that will make it almost impossible for members of a Communist party or similar to be granted permanent residence or citizenship of America.
The announcement was made in a policy alert issued on Friday by the US Citizen and Immigration Services (USCIS).
In a sign Washington is dusting off its Cold War-era legislation, the agency said: “In general, unless otherwise exempt, any intending immigrant who is a member or affiliate of the Communist Party or any other totalitarian party … domestic or foreign, is inadmissible to the United States.”

The law effectively blocks members of any communist party from ever obtaining permanent residency or citizenship of the US, and reinforces the widening ideology gap between the world’s two largest economies that has already damaged people-to-people exchanges.


The USCIS said the policy amendment was “part of a broader set of laws passed by Congress to address threats to the safety and security of the United States”.

While the alert did not mention the Chinese Communist Party, which has 90 million members, by name, it adds a new dimension to the ongoing rivalry between Beijing and Washington.

Hu Xijin, editor-in-chief Chinese tabloid newspaper Global Times, took a positive view of the rule change, saying the immigration restriction would help “keep more talents in China”.

“Many outstanding talents in China are Communist Party members,” he said on Twitter.

According to the announcement, exceptions may be granted if a party member can prove they joined “for the purposes of obtaining employment, food rations, or other essentials of living”.

The policy builds on a law dating back to 1918 that classified communists, anarchists and others as security threats because of their political affiliations.

The US also reinforced its immigration laws during the Cold War, its decades-long stand-off with the Soviet Union.
The 1950 Internal Security Act was the first to exclude foreign members of communist or totalitarian parties from becoming naturalised US citizens.

There are no official figures for how many members of the Chinese Communist Party have residency or citizenship in the US.


Since taking office in 2012, Chinese president Xi Jinping has launched several campaigns to crack down on government officials holding US green cards or other foreign passports. Under Communist Party rules, members face expulsion for taking up foreign residency and Chinese law forbids any citizen from adopting dual citizenship.

According to the Migration Policy Institute, a US think tank, there were 2.5 million Chinese immigrants in the United States in 2018, or about 5.5 per cent of its total foreign-born population.
The same year, China accounted for 67,000 of the 1.1 million people granted permanent residency of the US, ranking it third in the nation of origin table after Mexico and Cuba.

Almost all Chinese government officials are members of the Communist Party, as are most executives of state-owned enterprises and officials at public institutions.

Past and present members include: Li Wenliang, the Wuhan doctor who flagged the risk of coronavirus, and
Ren Zhiqiang
, the property tycoon and critic of Xi who was last month sentenced to 18 years in prison on corruption charges. He had earlier been expelled from the party.
China hawks in Washington are trying to separate the Chinese people from the ruling Communist Party.

On October 1, China’s National Day, US Secretary of State Mike Pompeo issued a note of congratulations to “the people of China”. Beijing responded by saying any effort to separate the ruling Communist Party from its people was doomed to fail.
Earlier in the year, US policymakers considered banning Chinese Communist Party members from even entering the country, Reuters and The New York Times reported.




Hmmmm....not sure this is a good move, since the US was receiving billions of dollars from corrupt top CCP members who either emigrate to the US or invest heavily there or buy green cards. I believe the US should have encouraged this even more, for their own national interests, instead of banning them. They will just move to other Western countries which is a loss for the US. 🤦‍♂️

This childish fight will continue for years Trump opened a door that shouldn't have been opened. Republicans can use China as a choke hold against Democrats in the future, and show them as not helping the Americans stay on top and then the Demo's will further inflame situation with more stringent policies.

You know what is more interesting. Its the hypocrisy of the west. they passed a guidance that would deny residence or citizenship to any person that would declare their belief to be of communisms. This is clearly discriminatory and US as a nation has a right to do this but what if the same was passed by say China or Pakistan or India that anybody that held membership to a Left party or a Right party or a Green party or any political or politco-economic ideology, then what would happen? There would be condemnations, articles on suppression and declaration on how these countries are barbaric.

Personally the West uses its status as developed to do many things that other nations would be called out on and this hypocrisy creates waves and we witness how International politics is becoming more hypocritical.

If China allowed immigration she is free to write their own rules

It's more about Communist Party membership and is quite natural. Why would the Capitalists let Communists in their country? A party that directly contradicts the values of capitalism.
It is not the hypocrisy of the west rather the hypocrisy of the communist who sells communism to their poor awam and sends their kids to western countries for better education, medical treatment, or straight out leaves for the US with their ill gotten wealth.

Actually, trump is stupid. Since all those corrupt top CCP officials who have and will keep stealing from their country to send their families to the US or invest their massive amount of ill gotten wealth will simply replace the US for U.K, Australia, Canada, France and many other western countries . So it's a loss for the US and a gain for other western countries. So it won't stop corruption in China, since there many more western countries where CCP top corrupt officials will keep their money in.
The issue here is that China has to self introspect and ask itself why many of it's officials are sending their ill gotten wealth,, family abroad , emigrating abroad in large numbers. Means there is something terribly wrong with the party anti corruption system. Seems it's due to the fact that the partys anti corruption agency is not independent itself and so is prone to party leanings and control. So it might not target those who have a say in it's running.
The fact that many wealthy Chinese are buying citizenship in western countries and stashing their wealth in the West should be the main question for most Chinese actually.

They would have changed the name of not for the implications for the party itself. Since there is absolutely nothing communist with the CCP today. That boat has long sailed. Mao would be shocked if he woke up today to see the party he founded doesn't adhere to almost anything he believed in anymore.

You are brainwashed by your own media to think so. There are of course some members in CCP doing so, but the ratio is so small and negligible. Absolute majority of Chinese trust the current system, perhaps much more that Westerners trust their democracy.

Your words just show that most Westerners have been brainwashed to a serious level. OK, your average IQ may be a little low to accept that fact. That's why your countries are going down and the trend cannot be reversed. How about the extremely capitalist and non-Communist India ( my country ) ? Has it been a resounding success or something else ?

Those 300,000+ Indian farmers who committed suicide between 2005 and 2015 because of socio-economic reasons... who knows how many before... why that happened ? And continues to happen.
