ISLAMABAD: Seven years after her Pakistani ex-husband took away their three daughters, a Lithuanian mother on Monday met her children following the top court’s directives.

The decision came as a three-judge bench, headed by Chief Justice of Pakistan Mian Saqib Nisar and comprising of Justice Umar Atta Bandiyal and Justice Ejazul Ahsan, began hearing of a petition filed by the Lithuanian woman, Maimouna, seeking the recovery of her daughters Ayesha, Maryam, and Amna from the alleged illegal custody of her ex-husband Jamshid Siddique.

During court proceedings the CJP asked the children if they had met their mother, to which Maryam replied that she did not know Maimouna.

When the bench directed court officials to arrange a meeting between the children and their mother, Maryam said she wanted her father to be present in the meet.



“This is your upbringing?” asked Justice Nisar. “You have poisoned their minds.”

Ordering a meeting between the children and their mother, Justice Nisar also directed court officials to provide refreshments for the family reunion.

The top court remarked that they had no sympathies for a man who had run away with his children, now aged 13, 11 and nine. “A mother could not see her children for seven years.”



Justice Nisar observed that the father had not even made the effort to have the daughters speak to their mother via video calls.

“Why should we not lodge an FIR against the man?” asked the CJP.

The Supreme Court had taken notice of the Lithuanian woman’s plea on March 31. The petition was presented through her counsel Chaudhry Faisal Hussain in the chamber of the chief justice after office hours. The CJP directed the office to register the case and fix it before him and Justice Ejaz Afzal Khan in his chamber on Friday.

Later, the CJP and Justice Khan heard the case and issued notices to the respondents. The court also ordered the Gujranwala DPO to present the minors before this court on Monday.


“Meantime, custody of the minors should not be removed from the jurisdiction of this court. In this regard, directions be issued to the Ministry of Interior, Government of Pakistan to ensure compliance of order,” said the order. The bench also directed the DPO to serve the court’s notice to the applicant’s ex-husband.


According to the petition, Liskauskaite converted to Islam on January 7, 2004 of her own free will and contracted marriage with Siddique. The marriage was solemnised in Lithuania and three daughters – Ayesha, Maryam and Amna – were born.



On December 19, 2010, the petitioner, her husband and minor daughters settled in Dubai. However, on April 4, 2011, Siddique silently moved to Pakistan along with the children and left her alone in Dubai. On April 7, 2011, he sent her divorce papers.

“Jamshid Siddique forcibly removed the minors from her lawful custody and that according to law, she was entitled to custody of her minor daughters,” the petition said.

I really feel sorry for the mother & the kids, kids should not be kept away from their mother, its very barbaric....

You should be thankful for such an activist Chief Justice.

Under normal circumstances, he is probably poaching in the area of the Administration, but considering the state of the Administration, and the corruption within its political leadership, he is simply filling a vacuum.

True. True.

Yet Joe his activism comes to question when cases for decades are still ongoing awaiting justice.

And this is not the worst of it.

Rather than taking notice of open gutters and filth in Karachi, it would be far more appreciative if he would take notice of the following facts that
  • That the ahalmand treats you like rubbish unless you grease his hand and if you do not then they make sure your work is hell.
  • That the notice delivery guys from nazarti office take 200-300rs otherwise they don't do and simply write " tameel na howe"
  • That for warrants the bailiff takes a minimum rate of 2000-2500rs and if you don't provide then they don't go and write report stating that we found nobody.
  • That the Munshi tells the client that a 700rs newspaper advert is actually worth thousands and in one case a dawn ad is worth 100k. Yes that's the level of corruption that hounds a client.
  • That bcz of the above and cases ongoing for decades, people have sold property to pay.
  • That the common conception is that a case started by grandfather for inheritance is ended by his grandson.
Don't get me wrong. I appreciate his work but the fact is Joe that neither the executive nor the judiciary nor the legislative not even the army should enter into the other domains without first solving their own issues.

In the end Joe. This is simply another action of another institution trying appeasement and gaining power rather than buckling down and solving their own issues.

Let's hope he does some activism in his institution as well. He would be a hero of Pakistan if he takes care of the above.

However this is indeed right and indeed this was courts job and it was within his power and I am glad he did that...

The process corruption that you have mentioned is now deeply rooted in the system, in both countries, perhaps slightly less blatant (perhaps) in India compared to elsewhere, but present, nevertheless. One major roadblock is the paucity of courts, and the shortage of judges, and, of course, the system of adjournments of a hearing. That is the major money-making device for the legal profession in India, and it would not have been possible without the complicity of the bench.

Of course. He was indeed just with his decision and he did his job correct and applied both judicious and moral mind in this effort which is indeed the duty and burden of all judges.

One major roadblock is the paucity of courts, and the shortage of judges, and, of course, the system of adjournments of a hearing. It must be removed Joe. This cannot continue. Its downright horrific. Heck getting copies from case laws from the legal library at civil courts costs you some 30-40 extra otherwise they won't do jack shit.

What are the rates in India? :)

Adjournments. Don't even get me started there.

A complainant in session court took 15 dates simply to prepare arguments.

Date one. I need time to prepare arguments.

Date 2 .. Lawyer is not here.

Date 10. Its strike.

Date 15. I need another date to prepare arguments. I kid you not. I saw this at sheikhupura session courts.
Lahore civil courts. Contempt proceedings and the judge orders for courier service and then chaspangi and then the defence lawyer comes with a nemo that I will give my answer next date and 7 months later, the courts changed and he still hasn't given an answer... I saw this proceeding in a contempt proceeding at civil court lahore.


This cannot go on. This cannot be tolerated. This must end and Joe this is far more devastating as compared to other issues he has taken to notice.

A surprise visit within the courts by the CJ is more apt than a visit at the hospital.

Well this discussion is offtopic. For this thread. Let us appreciate his work in this case which is commendable.

SOB converted her, married her and became father of three girls then ditched her and take innocent children with him secretly and then divorced her....you people can't understand the pain of a parent especially mother who suddenly lost contact with her children....look at her face she is crying...SOB brainwashed children who refuses to recognize her as mother....I am not big fan of Justice Saqib but today he made very good decision....he should handed over custody of daughter to their mother ASAP...and send this SOB in jail for giving a lasting pain to this mother.

Finally someone gets it when one arm is busy looking for kickbacks someone has to do the hard work the apologists of the govt have to explain to us why couldnt they do what they claim is breach of power?

Reminds me of the two cases from last year where women from China and somewhere in Europe showed up in Pakistan to meet their "fiance's" that had promised to marry them after online dating. As you would expect the men were a no show and the women went back crying their eyes out.

If you can't take the responsibility of marriage or are too afraid of commitment then simply don't do it.

Yeah I remember that cougars aged between 45 to 50 and one lost around 30 USD.....I feel no pity since they are hunting young men over internet.
