The Supreme Court (SC) on Friday disqualified Pakistan Tehreek-i-Insaf MPA from Shangla, Abdul Munim Khan, for holding on to his position as a government employee until two days prior to the 2013 election.

The disqualification came as a result of a petition filed by Jamiat Ulema Islam's Sher Alam against Khan, who had been serving as the Khyber Pakhtunkhwa adviser for tourism.

The Election Commission of Pakistan (ECP), in April 2017, had disqualified Khan on Alam's petition; However, the PTI MPA had taken a stay on the ECP's order from the Islamabad High Court.

Khan was disqualified over allegations that he was a serving government school teacher in the Kohistan district before the 2013 elections and that he resigned from his post just two days prior to the election.

Alam said in his petition that, according to the law, a government servant could not contest elections unless there was a two-year gap from the time he retired and election time.

Khan has been serving as an adviser to KP Chief Minister Pervez Khattak and a special assistant to the chief minister for tourism, and had also travelled to China with the KP CM for a road show.

Following the SC's ruling today, the ECP was ordered to denotify Khan immediately.

He was school teacher before contesting elections

Being a PTI supporter, I support this action.

Moreover, EC should also be taken to task why it allowed such a person to contest elections in the first place. The perks he enjoyed, the salary he took, who is answerable for this? EC chairman?

. . . .
He was just a school teacher

Not like a SC Judge or member of armed forces. I think the law needs to be revised so that educated people could come to the parliament with ease

Nizam-e-Pakistan, for the powerful...by the powerful.

Technically the correct decision. But he was just a school teacher - what influence could he have yielded with that position?

This seems a very unfair to be honest. If he left his position 2 years before the election then how is he expected to earn a living? I know the rich candidates can live without working for a long time but a school teacher would struggle without a wage for a few months.

The systems appears rigged to favour the rich and penalise people like this teacher who could make a difference to the country.

Law is blind, remember

Good decision by the SC, any wrongdoings by anyone should be dealt by law, not repeating tantrums mujhe kyun nikala slogans.

Bhai acha hua nikal dia. Good decision.

Supreme court should also investigate why they (Election Commission) allowed such a person to contest the elections.

also, this law should be changed. how a person is supposed to earn for living if he is not working (as a government servant) for 2 years ? it only help those who work in Private firms or even don't work, mean's jagirdar, sardar, choudhry, saaen. this law is preventing the educated middle class to contest in elections which is unfair. instead, they should resign from their post as soon as they are elected.
