Not only this but by using this line of argument one can CLAIM Sindh & Punjab High Courts even Supreme Court of Pakistan INCITES FOR MUTINY

In a case of Samiullah Khan Marwat vs. Government of Pakistan (2003 SCMR 1140) clearly stated

the exercise of powers by the public functionaries in derogation to the direction of law would amount to disobey[ing] the command of law and the Constitution"


In another judgment of Sindh High Court in the case of Mehboob Ali Zardari Vs NAB [link] wrote the following

"Honourable Supreme Court has time and again held that the duty of those holding public office is to independently discharge their functions and they should not be influenced by “dictatorial misuse of powers” at the hands of those in power. The compliance of illegal orders is not justified on the basis of having been issued from higher authority as it is the law and Constitution, which must be obeyed"

In Sindh High Court in the case of Iqbal Hussain vs. Province of Sindh (2008 SCMR 105 link) declared that

“the compliance of any illegal and arbitrary order is neither binding on the subordinate forums nor valid in the eyes of law.

According to Zahid Akhtar vs. Government of Punjab PLD 1995 SC 530 [link] illegal orders cannot be defended on the plea that these could expose the concerned government servant to the risk of disciplinary action

Therefore IF one accept this argument then It is necessary to arrest all the Judges of Higher Judiciary as well and Quaid SHOULD also be declared as Traitor who used to incite for mutiny.

If this is the case then we must accept that this is NOT THE PAKISTAN for a common people who still believe the dream of a country RULED BY LAW & CONSTITUTION. It is a country which is RULED by Orders of Criminals of SHARIFISTAN.

It is not just a war of Narratives but a war b/w Pakistan Vs. Sharifistan.

What exactly is so pathetic about this line of argument? Legal, Lawful, Constitutional versus Illegal, Unlawful, and Unconstitutional? For an order to be obliged, it must be constitutional, follows legal framework and must abide by and be under the law.

Do you believe the army of Ibn Ziyad, should be immune from facing any criticism, related to the barbaric acts of which they were abettors in Karbala, just because they were simply following orders? What about Ibn Ziyad himself, should he also be declared innocent, as he was only following orders of Yazeed?

What about Nazis? Ever heard of Nuremberg Trials? And about Srebrenica massacre? Should the people who abetted these, must not be criticized with "extreme prejudice", as they were only following orders?

And, what about the Indian Army who mass raped women in Poshpora? Should those men also be revered, held in utmost high esteem, just because they gleefully obeyed a pathetic order?

History is full of people who believed themselves to be above law, constitution, and legal niceties, and history has never been kind to such self proclaimed deities.

If he said that, and I am rephrasing what is out there, that rank and file should not go against people sentiments and user their brain etc. This is different from criticizing Army about their political role. He did a big mistake because what he said has bad connotations about discipline of the army.
Army has assumed a wrong role but still we can't provoke their command structure.

It is no harm if PTI say that it was a wrong statement and we are not with it.
