Sea link too has view of naval base, says Harsiddhi developer

Every commuter who uses the Bandra-Worli Sea Link (BWSL) enjoys a view of naval base INS Trata, the developer of the 18-storey Harsiddhi Heights has told the Bombay high court.

Monday admitted a petition filed in October 2010 by the Indian Navy, seeking the demolition of the Worli building.

The navy had called it a threat to national security because of its proximity to INS Trata. “In fact, every commuter who takes the Bandra-Worli Sea Link enjoys a view of INS Trata’s Site V and the mobile missile launcher,” said Saket Shah, partner of Prithvi Corporation, in an additional affidavit.

He said naval authorities had asked for the sea link to be kept lower than Site V. “However, the sea link has in fact been constructed substantially higher than the Site V, which has become unusable for target firing,” the affidavit said.

Shah said the navy’s allegation that Harsiddhi Heights is a threat to national security is “baseless and malafide”. “Site V of INS Trata is fully visible from a number of buildings which have already been constructed in the vicinity,” said Shah.

He said that if the navy intends to put restrictions on the use of land, it has an obligation to pay compensation to all persons affected under the Works of Defence Act, 1903.

Additional solicitor general Darius Khambata sought time to reply to Shah’s affidavit. Admitting the petition, the judges observed that the court’s interim stay on the sale of flats in the building will continue till the next hearing in June.

Dude A LOT of mumbai buildings have a view. What I fail to understand, and hope someone can clarify.. Is why is the navy so protective about only the SAM sites? And not about all the other installations? (Like the friggin dock for starters!)
