Last month Modi Govt already made the deal final after 3 dozen negotiation with French.What does that mean Rafale deal under Probe ?
I am suspecting Rafale MMRCA deal is not final and it can be scrapped anytime ?

New Delhi: Former Indian Air Force Chief NAK Browne, currently India's Ambassador to Norway, today strongly refuted as "baseless and malicious" reports that he was a "common link" in three major defence deals involving AgustaWestland, Rafale and Pilatus aircraft and said he was initiating legal action against a TV channel for making such allegations.

In a call from Oslo, Air Marshal Browne said that he had nothing to do with these deals and none of them have been signed during his tenure as Indian Air Force Chief.


"I am instructing my lawyer to initiate immediately legal action against a TV channel for indulging in such false and baseless propaganda. It seems these people are out to score points without any basis," he said.

Anglo-Italian firm AgustaWestland manufactures choppers while Rafale of France builds fighter jets. Pilatus is a Swiss trainer aircraft.

Expanding its probe, the CBI has asked the Ministry of Defence to provide names, addresses and contact details of all senior officers who served in the MoD between 2005 and February 2010. This was the period when the tender for 12 choppers was floated and the contract was awarded.

NEW DELHI: A day after the Enforcement Directorate (ED) sought "property details" of at least 10 senior officers of the defence ministry and the IAF, the CBI has asked the ministry of defence (MoD) to provide names, addresses and contact details of all senior officers, mostly above joint secretary rank, who served there between 2005, when the tender for 12 choppers was floated, and February 2010, when the contract was awarded to Anglo-Italian firm AgustaWestland for Rs 3,546 crore.

The CBI probe against MoD personnel is significant as the ministry, then under A K Antony, after an "internal examination" had said that "there was no wrongdoing on part of the ministry" and that "all laid procedures were followed as per the defence procurement procedure".

A senior CBI official said, "We have written to MoD calling for all relevant records related to officers who took part in important meetings, handled important files and signed on them like AM (acquisition manager), JS Air (joint secretary air), DS (defence secretary) among others, who signed on the files and took the decision ultimately to award the contract to AgustaWestland."

Designations of some senior ministry officials are mentioned against the bribe money allegedly paid by middleman Christian Michel, in a handwritten note which is part of an Italian court judgment. It is alleged that Indian officials, politicians and bureaucrats were paid Rs 360 crore in bribes for the deal.

The CBI is hoping to get a reply from MoD soon as the government has asked probe agencies to go into the root of the scam where bribes were allegedly paid up to the top level.

The Comptroller and Auditor General (CAG) had also slammed the defence ministry and said it modified some crucial parameters of operational requirements of the helicopters in 2005 to favour the Anglo-Italian consortium, which became the sole vendor as a result. The CAG had observed that in January 2006, when acceptance of necessity was granted, the projected cost was Rs 793 crore for 12 helicopters. The cost negotiation committee, however, recommended Rs 3,726.96 crore in February 2009, and a year later, the MoD concluded the contract with AgustaWestland and signed the deal for the same amount.


As first reported by TOI, ED has written to the ministry seeking "property details" of at least 10 senior officers, the abbreviations of whose designations are mentioned in Michel's note as 'DCH', 'PDSR', 'DG Maintt', 'FTT', 'DS', 'JS Air', 'AFA Air', 'DG Acq'.

The handwritten note, being treated as evidence by the CBI and the ED, mentions that 6 million euros were for AF (air force), 8.4 million euros for BUR (bureaucrats), 3 million euros for AP (alleged to be Ahmed Patel) and 15-16 million euros for the 'Fam" (believed to be S P Tyagi's family— cousins Sanjeev, Rajiv and Sandeep Tyagi).

Can someone enlighten me whether this is a one off incidence or do we have many such precedence ?

The G2G deal between India and France is contingent on the assumption that the technical trials and the price bids of the MMRCA deal were unbiased and free from any motivated manipulation in support of or biased against any competitor. If enough evidence, even circumstantial evidence emerges of manipulation in any stage of those trials, the very assumption which provides legitimacy to the G2G deal will collapse. The GOI will be bound by law, and ethics, to withdraw from the proposed deal.

Right now investigations are being conducted to ascertain if any of the senior officers involved with AW negotiations/trials were involved with the MMRCA deal, and whether documents and log files indicate any unusual incident that would indicate manipulation; files being pushed unduly hastily, performance requirements being changed at the last instance or after a trial, changes to trial data etc etc. Anything that indicates something will erupt into a massive controversy.

Then there are the ongoing red flags issued by the Law Ministry. To be honest, this deal going through without a major hiccup would be a small miracle.

The attempt to equate the MMRCA with the AW deal are completely nonsensical. The MMRCA trails were conducted on a competitive basis and even the losing contenders (SAAB, MIG, LM, Boeing) didn't raise a concern about the valididity of the technical evaluation process.

The price bid element is entirely redundant as the price talks were started from scratch in April 2015, nothing was assumed from the MMRCA in that regard.


Then there are the ongoing red flags issued by the Law Ministry. To be honest, this deal going through without a major hiccup would be a small miracle.

That's old news and a non-story. The deal is all but done, some last minuet attempt to spoil the show from those with vested interets was to be expected.

Norway has a very active Church 'outreach' program that interferers in global matters. Especially in places like Sri Lanka, North East India etc. They do political, economic and military interference under the cover of the church.

A Christian defence chief as a diplomat to such a country is a good idea. RAW needs somebody solid to cover their back in Norway.

In any case a probe can only help matters if there is nothing to hide. Better to pre-empt all possible attack which we know for sure, is coming.

He is a congi stooge. Watch his coverage of AW deal. He is cherry-picking speeches of Sharad Yadav and Mayawati who were defending mutter Sonia ,calling then neutral umpire, and bashing Subramanium Swamy, apart from telling obvious lies which have been debunked by Subramanium Swamy and Parrikar.

The most funny part of his coverage was when he said that though no MANPADS have been discovered in Chattisgarh and Maharashtra, but since some BSF and Army helicopters have been fired upon by small arms fire, therefore the argument that VVIP choppers of central government ,for which IAF specified 6000m ceiling so that they could not be targeted by MANPADs in Kashmir and along IB, apply in case of Chattisgarh and Maharashtra too as small arms fire denote that ,if Congress was wrong, BJP too was wrong in purchasing AW choppers for its state government.

It could be NATO or CIA. It could be the Vatican.

We only know the list of troubles they have caused around the world. Their source of funding is a mystery. But the German church too has a notorious history and work closely with the spooks. But they are funded internally.

Congress raises question over buying of Rafale aircraft by Modi govt

New Delhi: Amid the storm over the AgustaWestland chopper deal, Congress today raised questions over buying of Rafale fighter aircraft by the Narendra Modi dispensation.


"Which Defence Procurement Procedure permits a Prime Minister to go and buy fighter aircraft from a private company without tendering process on Off-the-Shelf Basis leading to expenditure of Billion Dollars?", party's chief spokesman Randeep Surjewala asked while talking to reporters.

Raising a number of questions over the deal, he wondered whether is it sovereign right of the Prime Minister over exchequer's money?

"If there is no sovereign right that a Prime Minister has, can a Prime Minister tomorrow decide that he will spend 'X' amount of Billion Dollars of exchequer's money on Off-the-Shelf purchase of the Fighter Aircraft, the answer is clearly 'No'.", he said.

So, the Defence Procurement Procedure post independence, if ever has been negated, "thrown in the dust-bin and violated with impunity," it is in case of purchase of Off-the-Shelf Rafele Aircraft by Prime Minister Shri Narendra Modi, he claimed.

Besides, he recalled that a global tender was held by Government and two companies had qualified Dassault Aviation of France which manufactures Rafele and the other Company which makes Euro Fighter.

In such a scenario, "if you had to make Off-the-Shelf purchase, should an equivalent offer had not been made to both the companies, so that we could have got the best price possible," he said.
