Punjab governor denotifies CM Parvez Elahi

The governor of Punjab, Balighur Rehman, has denotified Chief Minister Parvez Elahi after he failed to take the vote of confidence from the Punjab assembly, Geo News reported on Friday.

However, the Pakistan Tehreek-e-Insaf (PTI) has rejected the governor's notification as not legally binding. PTI leader Fawad Chaudhry said that the notification regarding the denotification of CM Elahi has no legal status.

The Punjab governor had ealier asked the chief minister to take vote of confidence from the provincial assembly. However, Speaker of the provincial assembly Sibtain Khan declared the order unconstitutional and illegal. In his ruling, Speaker Sibtain Khan said that until and unless the current session is prorogued, the governor cannot summon any fresh session — according to a three-member bench of the Lahore High Court in the Manzoor Ahmad Wattoo vs Federation of Pakistan case.

The speaker added that the session in terms of Article 130(7) of the Constitution — under which the governor can summon a session for a vote of confidence — can "be determined only in a session which is especially summoned for this purpose".

Earlier this week, Pakistan Muslim League-Nawaz (PML-N) and the Pakistan Peoples Party (PPP) submitted a no-confidence motion against Chief Minister Parvez Elahi in the Punjab Assembly on Monday, after Pakistan Tehreek-e-Insaf (PTI) Chairman Imran Khan announced that the provincial assemblies of Punjab and Khyber Pakhtunkhwa will be dissolved on December 23.

Reacting to the governot's order to call the sesssion for vote of confidence, Sibtain Khan had said that it is not a governor’s problem to give or not give a ministry to someone. He added that the governor cannot summon a new session while one is already in progress in the assembly.

Interior Minister Rana Sanaullah claimed on Thursday that PML-Q leader Parvez Elahi was no longer the chief minister of Punjab constitutionally.

“The Punjab governor had asked the chief minister to take a vote of confidence by yesterday, but he did not take it, so according to the constitution, Parvez Elahi is no longer the chief minister,” said Sanaullah while talking to the media in Lahore.

The interior minister said that Governor Baligh Ur Rehman is using his powers under the Constitution, adding that whenever the orders [of de-notifying Parvez Elahi as chief minister] are issued by him, they will be implemented.

PTI's reaction

The PTI snubbed the governor's step as not legally binding. Fawad Chaudhry reacted to the governor's notification, saying Parvez Elahi and the provincial cabinet will continue functioning as usual.

Lahore HC full bunch had already given judgement in past in similar 14 hours denotification by a governor. Judgement said to allow 10 days for process to complete.
