PESHAWAR: The Pakistan Tehreek-e-Insaf (PTI) has formed a four-member committee of its top legal brains to prepare a case against the Jamiat Ulema-e-Islam-Fazl (JUI-F) chief Maulana Fazlur Rehman and also file a reply to the contempt of court notice against its chief by the Supreme Court.
Qazi Muhammad Anwar, a member of the committee, told The News on Wednesday that the PTI chief had called the committee’s meeting in Islamabad immediately after Eidul Fitr to discuss the two important legal matters.
He said PTI’s Senior Vice-President Hamid Khan would chair the committee and the other two members would be Justice (retd) Wajihuddin Ahmad and Justice (retd) Shaiq Usmani.
A few days ago, Imran Khan stated that he would sue the JUI-F chief Fazlur Rehman in the court for calling him an agent of the Jews.
“The committee would decide whether cases should be filed against Maulana Fazlur Rehman in all the four provinces or in the federal capital. It would also decide whether a criminal case would be filed against him or both civil and criminal,” said Qazi Anwar, who is also the convener of the Insaf Lawyers Forum, Khyber Pakhtunkhwa.
He said a case of defamation would be filed against the JUI-F chief under Section 499 of the Pakistan Penal Code (PPC). The Section 499 of PPC reads: “Whoever by words either spoken or intended to be read, or by signs or by visible representations, makes or publishes any imputation concerning any person intending to harm, or knowing or having reason to believe that such imputation will harm the reputation of such person, is said except in the cases hereinafter excepted, to defame that person.” The punishment for defamation is awarded under Section 500 of the PPC that reads: “Whoever defames another shall be punished with simple imprisonment for a term which may extend to two years, or with fine, or with both.”
On the other hand, JUI-F Khyber Pakhtunkhwa spokesperson Abdul Jalil Jan told The News that they have started preparations to tackle the legal challenge and would submit their reply with proofs if the PTI chief filed a defamation case against Maulana Fazlur Rehman. “We are ready for debate with the second-tier leadership of the PTI on any issue. We would produce evidence that Imran has links with Jews,” he added.
Imran and Fazl have been at loggerheads since the time of the elections. They have been trying to undermine each other’s credibility in their public speeches, particularly in the KP. The JUI-F chief, in the lead-up to the May 11 election, had repeatedly declared it was ‘haram’ (un-Islamic) to vote for the PTI candidates. Fazlur called Imran an agent of “Americans, Jews, Ahmadis and a person of bad character.” Imran in his political rallies reportedly said that “people like Fazlur Rehman should stop selling religion to get votes.”
