ISLAMABAD: President-elect Dr Arif Alvi will seek constitutional immunity in a case related to attacks on Pakistan Television and Parliament House registered against him and other PTI leaders under the Anti-Terrorism Act (ATA) during the 2014 sit-in.

Pakistan Tehreek-i-Insaf’s lawyer Ali Bukhari appeared before the anti-terrorism court (ATC) on Wednesday.

After attending the court, he told Dawn that since Dr Alvi had been elected president, he enjoyed constitutional immunity and could not be tried in criminal cases.

He said the matter would be brought into the knowledge of ATC Judge Syed Kausar Abbas Zaidi at the next hearing.

According to Article 248 (2) of the Constitution, “No criminal proceeding whatsoever shall be instituted or continued against the President or a Governor in any court during term of office.”

Police invoked the ATA against PTI chief Imran Khan and its leaders Dr Alvi, Asad Umar, Shah Mehmood Qureshi, Shafqat Mehmood and Raja Khurram Nawaz for inciting violence during the 2014 sit-in.

As per the prosecution, three people were killed and 26 injured, while 60 were arrested. The prosecution had submitted 65 photos, sticks, cutters, etc, to the court to establish its case.

The prosecution said the protest was not peaceful and the PTI leaders sought bail after three years. On Aug 31, 2014, PTI and Pakistan Awami Tehreek (PAT) workers marched towards the Parliament House and Prime Minister House and clashed with police deployed at the Constitution Avenue.

Around 50 protesters, allegedly from the PTI and PAT, attacked and injured SSP Asmatullah Junejo the next day. Initially, police arrested six people who were allegedly involved in the attack.

In addition to the unidentified attackers, police had also nominated Imran Khan and PAT chief Dr Tahirul Qadri as accused in the case. The ATC declared them proclaimed offenders in November 2014 as they did not appear before court despite issuance of summons and arrest warrants.

In July last year, the ATC declared them absconders and started the process of confiscating their movable and immovable properties. In May this year, the ATC acquitted Mr Khan in the SSP torture case.

In the case related to attacks on the Parliament House and PTV building, the court is yet to issue proclamation against the accused persons for their absence.

The PTI leaders, including Mr Khan, remained absconders in these cases and surrendered in October last year.

He won't need to seek.. It is just given to the president of Pakistan in the constitution. It can only be removed by a constitutional amendment.

Also this case is a pretty retarded one and makes no sense to include a guy like Arif alvi in it, i don't know why the court simply doesn't dismiss it already lol.

no it simply shows "maturity" of court, in any other country the case would have been thrown out even before hearing it

why do you think pakistan is backward country, when legal case dont even follow "common sense" you cant expect investors and key people to come here

Exactly, our judicial system is flopped and focusses on petty issues. The judiciary needs reforms but our CJP is busy in taking Suo Motos over petty rather shitty issues.
The judiciary has failed to convict any of the criminals in the Mode Town Massacre case of 14 innocent people including pregnant women and old men but it has ample time to waste on the transfer of a police officer which is in fact a right of the CM.

ISLAMABAD: President Dr Arif Alvi Thursday said he had never claimed the presidential immunity in a pending case against him related to Pakistan Tehreek-e-Insaf’s sit-in of 2014, though he personally desired there should be no immunity in a criminal case.

In an interview with a private television channel, he said during the hearing of a case against him, his lawyer had told the court that he wanted to pursue the case as the allegations leveled in the case were baseless.

However, he said the judge was bound by Article 248 (2) of the Constitution and suspended the proceedings against him.

Discussing the recent protest by Tehreek-e-Labbaik Pakistan, the president called for revival of Council of Islamic Ideology as a strong body to discuss the new narratives of Islam like Namoos-e-Risalat.

He believed that Namoos-e-Risalat was part of everyone’s faith but burning or damaging people’s properties was contrary to the teachings of the Holy Prophet (Peace be Upon Him). However, he said during his interactions with the party leaders, he had advised to avoid the bloodshed.

Regarding Dr Aafia issue, he said being a president he could raise the issue with US authorities during any interaction with them and said strong efforts had to be made in this regard.

Responding to the criticism on his protocol in Quetta, he said he would now write to the provinces to keep the motorcade as short as required by security.

He said under Article 46, the law ministry apprised him about the pending legislation.

He told the interviewee that in order to discourage the practice of depriving women of their right in inheritance, he said a landmark bill was about to be tabled before the parliament which would provide for automatic transfer of property to the legal heirs as per the family record with the NADRA.

He said in future, he would be sitting in his chamber at the Parliament House to interact with the parliamentarians from all parties.

To a query, he said since his college age, he had been fighting against corruption.

He said pursuing the government’s austerity drive, he opted to reside in half a floor of five-storey presidency.

He said the presidency had started arranging students’ visits to the building. He said, on Monday, the First Lady had scheduled a ceremony in connection with Miladun-Nabi where the orphan children from Sweet Homes had been invited.

Moreover, an exhibition would be held to display the works of renowned artist Sadequain at the presidency to ensure building’s use for the public.

To a question, he said he had been interacting with BNP Mengal leaders and discussed the issue of missing persons.

He said a major water crisis was looming over Quetta and he had suggested the water resources minister to make arrangements for treatment of sewage water.

The president said the school, he had adopted in Karachi, was performing well as the strength had swelled to 1,300 students. He said, during his visit to National Defence University, the administration had agreed to open its campus in Quetta.

President Alvi said he wanted to champion the issues of water shortage, prevention of diseases, cleanliness, tree plantation and fisheries.
