Dhaka, Feb 2 (bdnews24.com) — The High Court has rejected the writ petition to try 195 members of the Pakistan military for committing war crimes during Bangladesh's Liberation war in 1971.

The bench of justice Imman Ali rejected the petition on Wednesday terming it 'not presented.'

BNP leader wing commander (retd) Hamidullah Khan filed the petition on Aug 25 last year.

The chief justice ordered that the petition be sent to the bench when another bench, on Nov 2 last year, issued a 'confused' verdict.

Object of the petition may be different from what it seems to be.

@ This trial was solved in 1973 when the "Simla Agreement" was signed between Bangladesh, Pakistan and India. Why AL is bringing this point again.

@ About the trial of colloraborators of 1971, well AL can do it but still it is long way to go. So far I know it has lot of observations. Some of the observation are depicted below:

1. Can a govt trial a convicted person twice ? Or Once some one was arrested and the act was in total repealed by another Govt ? Can the subsequent Govt revive the Act and start trial again ?

2. The Colloborators Act of 1973 was made hurriedly on the line of Socialistic System where due share of the convicted was not considered.

3. In 1973 Act, there is a provision that any papers cutting, any article or hearsay can be considered as evidence of prove but it is contadictory to the constitution of Bangladesh as well as the aspiration of International standard.

4. In 1973 Act, there is no provision of appeal agianst the verdict of tribunal nor the accused have the right to change the tribunal bench, it is also against the provision of our constitution and against the International stardard.

5. In International law no capital punishment is allowed but in 1973 Act it is given.

6. In short, there are in total 16 to 18 observations on this Act which is being forwarded by the International Jurrists. Everytime, the foreigners are comming and giving their observations but the govt is moving at its own way. Whenever any foreign visitors are comming govt is behaving like,"Yes, yes, no, no, good, good, we are doing". Things are not that easy. That is why things are delayed and the time will soon come when the govt would be unable to do that.

7. Some of the amendments the govt has alraedy made since the govt has 2/3 majority but if all the observations are amended it will totally change the motive than the question will come how many political leaders were killed by the AL itself during and after the liberation war ? People says it is even 19,000. Is it not a International crime ? Than what about the killing of Bharies/non Bengaless ? Are they not a human being ?

8. Infact the real motive of the present govt is keep on bay the Jammat-i-Islami and their followers so that they donnot make hands with the nationalist forces and through the "divide and rule policy" win the next general election.

^^^It was a BNP leader who filed the petition. Anyways theres no point in arguing 'bout a rejected petition.

@ Since long this AL lead govt has come to power they are shouting too much about the trial of war criminals and their collaborators after 40 years. So, one of the sector commander who is now doing BNP politics wanted to test the actual power of the Govt whether really they do have that much strenght to deal with the case . That is why for the fun seek he made a writ petition and so naturally it was rejected.

@ Now, the question arises once you cannot trial the actual criminals of 1971 than why you are shouting to trial their collaborators?

They don't want it in the first place!! As it solely place themselves to rule for what you demands from others for so long, they know they can't, [Possible Racist comment removed]

They don't want to mingle with western Bengal bcz the other part would be in upper hand in such scenario as with the case with western Pakistanis in United Pakistan.

They just want to get their "ego" be appeased & groomed by others in every encounter endlessly......or show/take others to their level at least.... thanks to "geographics" we have no land borders with them, we have already enough in our plates at the moment, yes they left alone by us but they have to forget the past and move along i/o becoming a slave to it.

They have to solve their problems by themselves by accusing Pakistanis or Indians alone won't solve anything in the longer run and by doing so they are only increasing their pain i/o decreasing.

But, the ex-Pakistani soldiers must be tried. I am disappointed. Wheather they were tried in India or not. That doesn't matter. After trying of ex-razakaars the Pakistanis ex armies will be tried one day. And, dont forget we will try some Indian looters too as they have taken out some possessions/weapons from BD.

Al has opened up box of Pandora. They will be treated with own medicine. AL should not be spare next time around. :tup:

Bingo! Last election already proved it wrong. BNP should realize that people aren't interested about past and people are smart enough to understand Awamis false politics. :tup:
