Peshawar High Court not only rejected Pervez Musharraf appeal against election tribunals decision to reject his election papers, it went a step ahead and slapped a life time ban on him from taking part in politics. This is an interesting judicial development which smacks of vendetta as the appellant had only asked for overturning the decision of the tribunal. The bench was headed by the CJ of Peshawar Court himself. The Court ruled that since Musharraf had abrogated the Constitution twice, he could not be allowed to contest elections for either the National Assembly or the Senate. Though a fully charged apex court had termed his Emergency Proclamation of November 3, 2007 as abrogation of the Constitution, the federal government has yet to charge him. Under the law, it is the federal government and not the court to pursue such charges.
For Musharraf, seeking any relief from the angry courts, has now become impossible.
The Emergency of 2007 was proclaimed on the request of the government in which Constitution was not abrogated. It only resulted in sacking some of the over-zealous judges. The judges who were restored after a street agitation, are now out to teach him a lesson.
The outcome of his other court cases was no different.
Pakistans history is replete with military coups which were made successful only with connivance of obliging judges.
