Pakistan loses another power litigation
The London Court of International Arbitration (LCIA) has issued a final partial award against Pakistan, directing the country to pay around Rs11 billion claimed by nine independent power producers (IPPs) – a second embarrassing outcome of international litigations against the country within a month’s time.

The tribunal will also start proceedings to determine the quantum of the damage claims for which a hearing is scheduled for October 1 and 2, according to the documents available with The Express Tribune. It is learnt that after the quantum stage, Pakistan will pay more money in damages claim.

A senior official, while talking to The Express Tribune, admitted a complete failure of different government departments, especially the ministry of power that two consecutive awards of hefty amounts were issued against the country within a month.

On August 22, the International Centre for Settlement of Investment Disputes (ICSID) awarded $700 million to the Turkish company Karkey Karadeniz Elektrik Uretim AS in a damages suit it brought out against Pakistan.

Legal experts, who have experience of international arbitration, have demanded a comprehensive probe into the country’s continued failure at several international arbitrations in different cases such as those related to Rako Diq, Karkey and the IPPs etc.

Muhammad Azhar Saddique, the Chairman of the Judicial Activism Penal, lamented that arbitration matters were not dealt with seriously, claiming that a lack of coordination among government departments made the situation even worse.

The IPPs are in the business of generating and supplying electricity to the National Transmission and Dispatch Company (NTDC) – exclusive purchaser of electricity from the IPPs. It is owned and controlled by the Government of Pakistan.

The nine companies in the present case are (i) Atlas Power Limited, (ii) Liberty Power Tech Limited, (iii) NishatChunian Power Limited, (iv) Nishat Power Limited, (v) The Hub Power Company Limited, (vi) Saif Power Limited (vii) Orient Power Company (Pvt) Limited, (viii) Sapphire Electric Company Limited and (ix) Halmore Power Generation Company Limited.

I don't think so ma'am, I believe Pakistan might have the talent pool for diverse kind of specialties but just not sufficient enough, which might be the reason behind all this errors. But then again it's my personal opinion based of very limited knowledge of Pakistan & its people.

you guys are very right but we need to fight back atleast for another decade to make some difference. the corrupt government has put the country down in every field

Ma'am in my belief, it will be too much of generalization and putting all blame on corruption and present or recent governments will not do justice with the present scenario of Pakistan administration. I was thinking(maybe) it might have to do with the all past governments inaction in not creating specialized workforce but also the bench strength. A country needs a system which is built layers upon layer to not only create a integrated backup system but also act as a pillar of strength, be it in medical, political, judiciary, journalism, infrastructure, military, science, education and what not. What I find in Pakistan case is that your people do have resources which excel in their work but I don't find the contingency strategy which should be deep routed in country working structure. May be its too much of blabbering or not, Pakistani citizens will understand that better than us any day but action is missing that I can see. Thank you.

Looking at the logic Pakistanis give on this forum on various subject, be it J&K , Indus Water Treaty , support of terrorism, logic for opposing India in Afghanistan , considering Modi as terrorist while their terrorist as Gods messenger etc etc....I know their brainwashed mind will work in their terrotary and will fail miserable when tested under international rules.

Basically, Pakistan is experiencing the fallout from financial terrorism perpetrated by Pakistani corrupt officials.
