'Pakistan action against militants legitimate'

LONDON: A legal expert has termed Pakistan’s fight against violent extremists and militants as legitimate and justified in the perspective of Islamic, domestic and the international laws.

Dr. Niaz A. Shah, a lecturer in Law at the University of Hull, East England, who was speaking on ‘Fighting the Taliban - A legal perspective’ at the Pakistan High Commission on Friday evening deliberated on the relevant portions of laws in depth.

He highlighted that the Pakistan government’s action against the militants was legitimate as the domestic law, Islamic law as well as International regulations were on Pakistan's side in the context of the military action.

The talk was organised in the context of Pakistan’s ongoing war against terrorism.

He candidly presented his arguments in support of his assertion by quoting the Constitution of Pakistan 1973, Anti-Terrorism Act 1997, Pakistan Penal Code 1860, Criminal Procedure Code 1898, Pakistan Army Act 1952 and Frontier Crimes Regulation 1901.

Dr. Shah also cited references from the Holy Quran, which forms the basis of Islamic law to prove his point that military action against Taliban was covered under all the three laws.

He, however, emphasized that all laws take into account the obligations of the state to ensure that the human rights were observed. –APP
