It can...there is a time period you have to wait...but you can force divorce.
So is in Islam , khula is same, so please admit that you didn't know about that :) , woman if don't like want to live with the man then she can go for khula which take care of everything for her....

I don't, but am interested to learn. Could you Tell me what are the conditions on which khlua can be had? I personally know of folk who seem unable to get their husbands to divorce them, though they want to divorce and start a new life. One husband in the case I know off in fact lives in another town, refuses to give money to the wife and refuses to divorce her. What can she do? I am genuinely interested to know her options, not trying to catch you out or anything.

Please tell in your "socialist, Islamic" UCC what kind of divorce procedure will be there?

strictly without talking of changing the economic system of india, the procedure will be like this...

1. during the wedding, the groom should pledge a reasonable amount to the bride as maintainance in case of divorce later... conditions will need to be balanced if the bride has paid employment or the groom is finding difficulties in paid employment.

2. there cannot be any dowry given from the bride's parents to the groom's family.

3. a marriage should be retained with the consent of both parties... if there are problems, a marriage counsellor should be available to listen and resolve... if the problems cannot be resolved in a few months, the marriage is best dissolved.

3. the parents of the bride cannot shy away from helping their daughter during her difficult time in marriage or after divorce... they not helping her must be punishable.

4. the maintainance money must be supplied until the remarriage of the wife... it can also be terminated if the wife requests because she happens to be paid-employed and can handle her expenses.

a further point is that communication technology in a unenlightened situation like india's creates more harm than good... i always said that cell phones are rubbish things... neither violent crime has been prevented for someone keeping cell phone nor has oppression/injustice not happened with a user of cell phone ( like in this case ).

I am not interested in defending any brigades. But I am sure anyone who is secular and progressive will want muslim personal law abolished in India. And there are women organizations some of them headed by muslim women who support women in cases like this one. Please stop spreading your prejudice about secularism. Its getting old.

ALAPPUZHA: Ten days after her marriage, the 21-year-old BDS student's groom left for Dubai.After remaining incommunicado for over three weeks, he sent her a message — triple talaq — over WhatsApp.

The unexpected talaq shattered the woman and her family. Both she and her sister, a Plus Two student, have now dropped out of their classes.

Overcoming the initial shock, the young woman on Monday lodged a complaint at the state women's commission's adalat in Pala, Kottayam.

The commission has ordered the department of non-resident Keralites' affairs to find her husband, a 27-year-old from Vaikom in Kottayam district.


"He has conveyed that he does not wish to live with her," commission member J Prameela Devi said. "He said she was like an apple and he had already tasted it. So he did not want her anymore."

The girl returned home from her in-laws' residence after they showed scant interest in the development.

"The girl's father had died around four years ago. Her mother conducted the marriage and gave a dowry of Rs 10 lakh in cash and 80 sovereigns of gold," the women's panel member said.

The commission, which doubted the validity of 'WhatsApp talaq', directed cops to present the man's parents during the next adalat.

The talaq over WhatsApp, meanwhile, has divided Islamic scholars. Sayyed Attakoya Thangal, the Alappuzha district president of Samastha Kerala Jam-Iyyathul Ulama termed it valid. "The divorce, however, will be granted only after holding discussions with both the man and wife and their family members. If husband sticks to his stand, divorce will be sanctioned," he said on Tuesday.

Another leader of the same organization and the chairman of the state Haj committee, Kottumala T M Bappu Musaliyar, said the WhatsApp message was not a legal document. "Talaq should ideally be done face-to-face. If it is not possible, talaq can be done after presenting relevant documents signed by witnesses," he said.

Kerala Nadvathul Mujahideen state president T P Abdulla Koya Madani termed talaq over WhatsApp "oversimplification of the entire process." He said, "Talaq should be done under unavoidable circumstances and conditions. Mandatory steps for talaq cannot be followed in WhatsApp."

Activist-poet and former chairperson of the state women's commission B Sugathakumari condemned the WhatsApp talaq, and sought strict action against the man. "I don't think a normal youth can act in this manner. The commission should provide protection and legal aid to the girl and her mother,'' she said.

If this is actually happen, She have all the rights to take this forward and get onto her new life.

In Islam actually the financial responsibility of wife and any kids are on the husband. if he is not giving any support to her and its been more than few months now. she should contact the court to take the khula .. In Pakistan woman can take the husband to court for khula .. the court always orders the husband to respond on it and issue notice. if husband appear in court and try to settle down the differences than its upto the woman what she wants..

in case of woman still do not want to live with that guy there are like 3 hearings in court and finally court orders the khula and they are separated.
in case the husband never appear in the court after 3 hearing dates the court order the khula....

All the kids still remains the financially depended of the husband and she can demand the financial support from the husband even after the divorce/khula
