hello brothers,

i dont know where to post this, so i am posting it here.
i need some help. i have friend whos got the job of maid in KSA embassy in taiwan a month ago, she was on the visit visa. thn she planned to return back to phillpines after her visit visa expires. so she told her boss that she wants to go home when her visit visa will expired. her boss agreed.

after a month they gve her a ticket to hongkong and gve some paper in arabic language to sign in. she signed the papers and when she arrived at hongkong she got the return ticket of taiwan.
so she had to go back to taiwan, after she arrived in taiwan she read the english version of job contract that she signs. its an year job contract that she signs in arabic. KSA embassy in taiwan have her passport in the office.

now she is in tension, she dont wana do the job anymore. she wants to go back to phillpines.
will someone tell me what advice i should give her so she can return home as soon as possible. the advice should be legal. she dont want any kind of problem with KSA embassy officials.

i will be thankful for detailed suggestion/advices.

She needs to contact the Embassy of Philippines in ROC.

Since the contract she signed is in a foreign language it is invalid.

There should be an English version. If she has signed the English version, then there is nothing much she can do.

Best would be to ask from a lawyer in Taiwan.

Why KSA embassy has kept her passport in office ? Is this written in contract ?
Is this legal per Taiwan's law ?
If the above cases are negative she can contact police to get her passport back.
If Taiwan's foreign office is different from Pakistani foreign office then it would be more better to contact Philippines embassy in Taiwan

My suggestion is flying to HongKong, and find Philippines Consulate in HongKong to solve her problem.

Yeah there is no Embassy in ROC.

Anyway, the OP can go to this address. This serves the purpose of an Embassy.

Just asked my wife about this (She is a lawyer and specialised in International Relation)

Let get the case clear, point by point.

1.) Your friend is a Philippine National (Filipino) Not KSA national or Taiwan National?
2.) Your friend have signed a contract in Arabic
3.) Was the contract signing have witness?
4.) Her job is with KSA representative office in Taiwan, is she serving in diplomatic capacity or normal capacity?
5.) Had her visa in Taiwan expired?
6.) Did she have any contact in Taiwan?

If you can provide detail of the specific, that would have been clearer.

But as the information I gather, my wife advice is as follow (assume she is on a Contract with KSA embassy (not personal residence, and her visa expired.

The easier thing and legal thing is to talk to Taiwanese Police, ask them to detain your friend, since her visa expired she will be deported back to Philippine. But that may affect her chance to return to Taiwan if anyway she want for future visit.

If your friend don't want to do that, then sorry to say, her contract is valid, as long as the signing is witnessed by third party. The only way to get out of this is to go to a Civil Court in Taiwan (Only if the contract is for private residence not in diplomatic relation) and fight for it, it will cost your friend a fair bits of money. But unless the contracting authority relent (KSA Embassy) that is the only way you can do.

However, things is a bit complicated if your friend is a maid for the representative office and not at private residence, because that will constructed as she work in KSA, not Taiwan, Taiwanese Court have no jurisdiction on KSA embassy, which mean if she want to fight for it. She will need to contact legal authority in KSA, instead of Taiwan.

There are two more thing she can do.

1,) Talk to the employer. Hopefully she can get out of the contract.
2.) Fulfil the contract. Work in KSA Embassy for 1 year. Then when the contract expire, go home, don't sign anything.

This is the advice she give to your friend.
