I think the issue is going to revolve around whether or not the constitutional right of any Pakistani to reside in Pakistan can be trumped by a voluntary exile. If the court rules that it does not, then we might see the secondary argument that his exile was a condition for the remittance of his prison sentence, in which case the court would have to rule whether the "exile" would be constitutional in that sense. We might see the court rule that it still isn't constitutional and NS has to therefore serve out his prison term if he returns, or that the exile is unconstitutional and NS does not have to serve his term because of the sentence remittance. It would be interesting to see how the court justifies the latter; if the remittance of the sentence can be shown to be a direct result of, and conditional to, the agreement to go into exile.

Pakistan govt releases Sharif exile documents

ISLAMABAD (AFP) - Former Pakistan prime minister Nawaz Sharif and his family agreed to conditions for their exile seven years ago, according to a document released by the government Wednesday.

The document was submitted to the Supreme Court where Sharif and his younger brother Shahbaz are appealing the former premier's exile to Saudi Arabia so that he can return to Pakistan.

The document, a copy of which was made available to AFP, contains a written agreement from Nawaz Sharif that he and his family would stay out of Pakistan for 10 years, provided that he be allowed to travel.

"I agree to stay out of Pakistan for 10 years, during which time my residence will be the country that I approved, but I will be able to travel on the condition I will come back to my residence," it said.

Sharif served as prime minister from 1990 to 1993, and again from 1997 to 1999.

The industrialist-turned-politician was toppled in a bloodless coup by President Pervez Musharraf who then sentenced him to life in prison on tax evasion and treason charges.

Attorney General Malik Muhammad Qayyum said the government has sought the dismissal of the appeal on the ground that Sharif was not forced to leave the country.

"He himself decided to leave Pakistan under the exile agreement," he said.

The document, titled "Confidentiality and Hold Harmless Agreement," was signed by the Sharif brothers in December 2000, Qayyum said.

"This was an undertaking reached between Pakistan's government and Nawaz Sharif," Qayyum told reporters in the court.

The entire process was facilitated by a "gentleman" and the government of a very friendly country, Qayyum said, in an apparent reference to Saudi Arabia.

Sharif in his undertaking approved the "gentleman's" assistance to negotiate on his behalf for his release from jail in Pakistan, the document said.

"I further acknowledge that I am thoroughly satisfied with the course and results of the negotiations on my behalf; that I have been kept fully advised of the negotiations, that I have been in full agreement with each step in the negotiations," it said.

The government's lawyer requested Wednesday a three-week adjournment to procure the original document. The court had been scheduled to resume Thursday.

Sharif and another former premier, Benazir Bhutto -- who is living in self-imposed exile due to corruption charges -- have both said they would return to Pakistan for elections due by early next year.

I good analysis. While not being a fan of most of our Pakistani Politicians I have to say that this decision may have to go in favour of the "NOT SO Shareef Brothers". Any agreement while they were in jail would have to be considered under duress and therefore nullified. We also have to review the Government charger sheet to see if the sentence metted out to them satisfied the writ of the law or not. If it did not they will either have to be retried or freed to return. Even though it seems harsh, it is a good omen that the Judiciary has finally woken up and developed a sense of direction. In the long run if they continue this in an unbiased fashion, it will do our country a lot of good.I think whatever is to happen should happen within the framework of law.

Sharifs can return home: SC verdict

ISLAMABAD: The Supreme Court of Pakistan in a landmark verdict on constitutional petitions of Mian Nawaz Sharif and his brother Shahbaz Sharif, Thursday announced that Sharif brothers are Pakistanis and can return home and participate in the national politics.

The apex court in a brief judgment said that under Article 3 of the constitution no citizen of the country can be stopped from his or her return to home.

Senior lawyer Fakhruddin G. Ibrahim appeared before the court in the case on behalf of Sharif brothers. Attorney General Malik Qayyum, Ahmed Raza Kasuri and Ibrahim Satti were the counsels of the federation.

Well this just sucks. Apparently his sentence remittance does not contain any reference to the "deal" so that might be a no go as well. I don't think charging him with new cases, as was suggested by NAB reopening some cases a few weeks ago, will be a good idea. We might end up making him more popular by sending him to jail after he returns to Pakistan. (Sigh). So BB should be on her way back soon too.

God help us. Might as well allow Altaf Hussein to come home too. Why allow just one idiot to carry the vote. Hopefully between the three, a divided electorate will only allow coalition governments to form, denying one individual the ability to destroy whatever progress has been made.

Dictatorship hasnt worked in Pakistan and wont work in Pakistan. Everything looks rosy when they are in power but then the moment they are ousted whatever they have done looks like a mistake. Its hightime Pakistani electorate matured and realised that they shudnt support a coup everytime it happens.

Agonistc Muslim...... There is no law preventing Altaf Hussain from returning to Pakistan. He is in self exile and will never return
