NA finally passes Hindu marriage bill

ISLAMABAD: The National Assembly finally approved the Hindu Marriage Bill 2016 on Monday, paving the way for the adoption of a comprehensive and widely-acceptable family law for Hindus living in Pakistan.

The bill was tabled before the house by Human Rights Minister Kamran Michael. Though approved unanimously by the lower house without any opposition from political parties, the law met with minor objections raised by Pakistan Tehreek-i-Insaaf (PTI) MNA Lal Chand Malhi.

He pointed towards Clause 12(iii), which deals with ‘Annulment of Hindu Marriage’, saying that it could encourage or give cover to ‘forced conversions’. The clause stipulates that any marriage under this act could be annulled if the other party “has deserted the petitioner for a continuous period of not less than two years immediately preceding the presentation of the petition”.

A proviso defines ‘desertion’ as “desertion of petitioner by other party to the marriage without reasonable cause and without the consent or against the wish of such party and includes the willful neglect of the petitioner by the other party”.

However, the minister for Human Rights pacified the Hindu legislator from Umerkot, assuring him that he had misunderstood the clause.

PML-N’s Dr Ramesh Kumar Vankwani, one of the movers of the bill, told Dawn that while there were certain shortcomings in the bill it was a laudable and bold step taken by the present government.

“There was no Hindu marriage law in the country for 66 years — the country’s leadership and all the political parties in the parliament have done a commendable job,” Dr Vankwani added.

He has been pursuing the law for almost three years and it took the Standing Committee on Law and Justice around 10 months to clear the bill.

The draft Bill was approved by the NA Standing Committee on Law and Justice on February 8, 2016. Committee Chairman Chaudhary Mehmood Bashir Virk said that the delay was mainly due to certain technical points in the bill.

“This is a complete bill and it relates to the lives of our fellow citizens, therefore all segments including the Council of Islamic Ideology (CII) was consulted during the course of discussions, so that there are no complaints from anybody after the law is enforced,” Mr Virk added.

The bill also allows separated Hindu persons to remarry. Clause 17 of the bill states that Hindu widows “shall have the right to re-marry of her own will and consent after the death of her husband provided a period of six months has lapsed after the husband’s death”.

There are penalties for violating the provisions of the bill, which also enables Hindus to finally have a proof of marriage document called the shadiparat, similar to the nikahnama for Muslims. The bill will now be forwarded to the Senate for consideration and passage.

A country where Upper and lower class hindus have objections on Divorce clause

They came here to troll without the ability nor the desire to add anything fruitful or worthwhile to the discussion apart from their own misery or hatred. Ignore the trolls as answering them gives them what they desire most. Attention.


Anyhow this is very good step. Recently we gave taken a lot of steps towards minorities which will go a long way. The Hindu marriage bill faced opposition amongst the Hindu sectors themselves but the passing is a very good step. Amendments can be made in the future to make all parties happy.

Because I suppose there is no such law in India and it was bold because lot and lot of work was required to bring all hindus on same page regarding bill,it was proposed many times in past but was rejected by hindu leaders.

Thats why the bill was delayed Hindus had disagreements over divorce clause upper class hindus were in favour of it while lower class hindus were against it in Pakistan all religious groups have different marriage laws

All minorities in Pakistan must be protected, they are Pakistanis first and anything else later.

And besides, protecting minorities is something what true Islam teaches us.

Govt non seriousness and traditional value hindus were responsible for delay in marriage law this bill is 7 years late because of the disagreement on divorce clause

Poor Hindus are suffering for the past 69 years in Pakistan . Seriously what kind of country takes 69 years to pass a marriage bill.

Finally, the Islamic republic decides to treat non-Muslims as humans and grant them a civil marriage act.

Yes, I am sure there is no marriage law in India under which Hindus get married . Are you joking or just not intelligent?

Or that marriage act for Hindus is not a problem in the number of places where Hindus are in sizeable numbers - India, Indonesia, Nepal, Bangladesh, Bhutan, etc.

Its only in Pakistan where it takes over 60 years for Hindus to even get basic decency of a marriage law.

I know. There have been huge issues in its drafting and even its wording. The opposition from the hindu sections themselves. The Hindu leaders had to be brought in, there were talks and a consensus was created between them. Even in the upper house it faced opposition amongst the Hindu leaders however the drafters and passers of the bills worked upon it and brought all parties into the mix and satisfied them and passed it. The passing is a good thing bcz if any sector wants changes then by through talks and agreements, amendments can be made to satisfy all parties.

Happy to hear that. It's been a long process. I'm glad that it's been resolved now. My best wishes to the Hindus of Pakistan. They can now have official documentation for their marriages.

That answers your Question,we failed to make bill because they never demanded it,they were satisfied with traditional unwritten law but when issue of conversions and forced marriages was highlighted a bill was needed,so it's there.
