Muslim Woman Denied Job Over Head Scarf Wins in Supreme Court

People pay for a certain kind of image Abercombie products offer. Their models barely wear any cloths, and when they do it is sort of there. A salesperson in the middle of that store wearing a head scarf negatively impacts that image.

Folks that buy their cloths could be as shallow/dumb as a rock, regardless this is the image they are paying for.
Why didnt you offer your legal services? Their models do that so do car models and in fact even models advertising ANYTHING....just remove the clothes and men wanna buy it...

BUT how does that have anything to do with being a slaesperson? Just coz carshow room hire such model, you wont find their saleswomen 80% nude as on tv...Irrelevant and cant even call it logic!

That is the problem with the case.

VS is about women's sex appeal and AF is not that far behind for both young men and women. On a personal note, I have female in-laws -- plural -- who worked at VS for combine service time of a decade and VS will not hire a certain type of female for their front staff. Why ? Because just like AF, VS considers their front staff to be 'brand representatives' and not just 'salesman' or 'saleswoman' or 'salesperson'. It is not merely wordplay and even Home Depot got into the act.

A 'salesman' is about selling, simple as that. On the other hand, a 'brand representative' is someone who at least have to portray himself or herself as a believer in the brand. It is a quasi-military or even 'cult-ish' attitude or perspective about the brand.

Simply put, if the company had a strong case they would had won.
The Justices are not fools, but when they learned that AF did considered that religious demands were a factor in Ms. Elauf's attire, the justices had to do what AF did -- factored in religion in their decisions.

The store's assistant manager brought up religion and the manager essentially concurred that overt religious overtones via the head scarf is inconsistent with the brand, which is overt sexuality. If AF had kept religion out of it, then most likely the Justices would have ruled in AF's favor.

An Abercrombie assistant manager considered Elauf a "good candidate" but wasn't sure whether her headscarf violated Abercrombie's so-called look policy, according to the EEOC brief.

That assistant manager consulted a manager, explaining that she thought Elauf wore the scarf for religious reasons. The manager said the headscarf wasn't permitted, even if Elauf wore it because she was a Muslim, according to the EEOC.
A Victoria's Secret or Hooters managerial staff would have done the exact same thing -- assume that the head scarf is a religious mandate. Whether the religious mandate is factually correct or not is a different issue.

I contemplated the thought of becoming a lawyer, but my stomach couldn't stand it.

A salesperson wearing type of attire they sell is more approachable and likely be able to answer questions about the said attire resulting in higher sales. In real world you want to match the person with the job requirements, not the other way around.

Teenagers and young adults often times would not even want to be seen walking along with their parents, anybody who has been to a mall knows that.

Your analogy of selling cars is not comparable to this particular instance, models on the runway appear as emotionless or aloof to showcase the attire !!

many muslims nowadays in south india are "more muslim" than the arabs, so i suppose their faith is getting them through the summer. :rolleyes:

lol, this is getting to damn popular in Pakistan too, o think we had modern Muslims such as M A Jinnah, and thinkers such as Iqbal, and dictators such as Ayub Khan.

tipu sultan ruled from srirangapatna, not very far from bangalore, both in south india... tipu was the only transnational historic leader south asia had, and he would have been most saddened to see the reactionary thinking of many modern indian muslims.
