McDonalds and Hotshots in F-9 Case Appeal:Demolition ordered by SC

Justice has been served people. Really really happy that the law has been upheld and corporate barons have had to bow infront of it. For those unaware of the case, F-9 Park (or Fatima Jinnah Park) is big park in Islamabad spread over 3.6 million sq yds.

Commercial activity inside Parks is prohibited as per CDA's own rules but CDA has relentlessly pursued destruction of protected green areas (under its elitist agenda, more fast foods and country clubs=signs of development).

In 2006, CDA had allowed the start of construction for a "Mini Golf Course" in the F-9 Park. Around that time McDonalds opened a branch in the South-Western corner of the Park. An entertainment club by the name of "HotShots" has operated within the Park boundaries for a long time as well.

When the news of the Mini golf broke, proponents of sustainable development and critics of CDA's corrupt practices took it to court. In a landmark judgment in Moulvi Iqbal Haider vs Capital Development Authority (CP 36 of 2005), the SC deemed the construction illegal and declared that all commercial activity inside Park premises had to be stopped immediately. Hotshots and McDonalds went into litigation and lost the case, appealed and today the SC passed its final decision in the case which is a victory of people's rights.

SC orders demolition of constructions in Islamabad Park

ISLAMABAD: A three-member Supreme Court (SC) bench has ordered demolition of illegal construction of commercial buildings in F-9 Park, also known as Fatima Jinnah Park.

The bench comprising Chief Justice Iftikhar Muhammad Chaudhry, Justices Ghulam Rabbani and Khalilur Rehman Ramday gave its ruling in a case filed against constructions built inside the Fatima Jinnah Park in violation of the court’s 2006 verdict banning all commercial ventures in public parks.

The apex court had reserved the decision last month at the completion of the hearing. In its verdict on Friday, court has ordered demolition of multinational fast food chain outlet and leisure club built within the premises of the park.

The court has also accepted the apology of restaurant’s owner Ameen Lakhani for his remarks about Supreme Court and ordered that owners of these buildings will demolish the structures within three months on their own expenses.

The apex court also directed legal action against former chairman CDA and present secretary petroleum Kamran Lashari for giving permission for construction.

Besides, there's the pending issue of Islamabad Club's activities and access controlled cricket grounds inside the park, another violation of public property laws. The problem here is that Islamabad Club is an incorporated company but is Federally sponsored as well (Patron being the President and is subsidized by the Federal Govt). Hence the issue of whether it's cricket ground is public property or not comes intro question besides the violation of rights that a person inside thew park is stopped from going into a cricket ground inside the park premises because of exclusive membership privileges. That case will certainly take longer but I hope that justice will be done.

The decisions can be used to take the CDA to the court for commercial activities in Rawal Lake Park as well but the SC in many land right cases has deemed that public land can be converted to commercial land under existing laws (which are normally stringent) only if it is deemed in the "greater public interest". Of course the "greater public interest" can be interpreted in light of previous judgments and in the court only. The Rawal Lake Park area would never face serious trouble for although it was protected as a public park, it was yet to be opened to the public at large.

iki duki achi jaga hain islamabad main entertainment ki wo bhee gara do takay kuch na bachay! ... there could be other way to handel it demolition is not the last answer. :frown:

I agree whatever has been said by the honorable member of this forum. We must salute my lords as they are HONORABLE MEN. Will they also take suo moto notice of a multiplex in Jinnah Park Rawalpindi; a Pizza Outlet, a McDonald and wait a minute...a departmental store. Will they also look towards Ayub Park and race course park Lahore? Or their wholehearted effort is for Islooites to confine themselves to their homes before 9 pm as use to happen before 2002. No entertainment, no place to go, be a good kid, remain at home. Sir, honestly tell me did McDonald hurt anybody? Did my lords children or families never went there?
And why, may I ask, stop work on Citizen's Club? Do my lords will also issue orders for Islamabad Club to be open for social welfare?
When would hypocrisy and double standards go away? When will aw be applied to all and sundry without discrimination? Would my lords attend to some trivial matters like lower judiciary - made hostage to whims and wishes of lawyers - judges sitting in mortal fear? Would my lords attend to their own institution before reforming other institutions? Will my lords decide about stay order granted to Shahbaz Sharif or would he complete his term as stay order CM? Would they like to start hearing Asghar Khan's case? And sir lastly would our superior courts start applying themselves to their primary duty i.e. to listen to appeals of thousands ******* in jail waiting for their turn? Article 184 and 199 are articles which are meant when all other means are exhausted. They are not to be used frequently. And at the end sir, may I say " much talking judge is like an ill tuned cymbal". Judges do not speak their judgments speak. My lords please issuing statements and stop humiliating public servants just because you are in a position to do so. My lords take sou moto notice of Hunza Lake tragedy. Is it not more important than Mcdonald in F-9? Are there any parks in the world where you do not have clubs and eating areas?

Please ask what condition is in subordinate judiciary and what is happening to justice to the down trodden and wretched of this earth? What justice is being meted to them by police, lawyer and the magistrate or a civil judge?
 
It is the right decision, because rules are rules, they shudnt have broken it on the first place
 
Demolishing will be only in case if they fail to win the new lease auction. The CDA Board has to approach the Federal Govt. to ask for conversion of the said land for entertainment purpose. fIf not allowed, then McDonalds will be demolished. If allowed, it will carry out a public lease auction and then winner gets away with the area.

Copy of the Judgement is available on the SC website. It turns out that the issuance of lease to McDonalds (under M/s Siza Foods) was not even transparent. CDA Board did not approve it. A chit from Kamran Lashari approved it.

As for the 1.28bn Rupees worth useless Citizen's club; CDA has wasted 575mn of public money on it.There is no need for 18 hole golf courses and swimming pools. CDA personifies the exploitation of the poor at the hands of the elite.
