The Lahore High Court (LHC) on Friday instructed President Dr Arif Alvi to appoint a representative to administer oath to Punjab Chief Minister-elect Hamza Shehbaz after Governor Omer Sarfaraz Cheema refused to do so.
"A copy of the court order should immediately be sent to the president," LHC Chief Justice Ameer Bhatti said.
He gave the verbal order after the hearing of a petition filed by Hamza earlier this week.

The PML-N leader had contended that he had been elected chief minister on April 16 in a session held on the directions of the LHC but Governor Cheema was refusing to adhere to his constitutional duty by delaying the oath-taking ceremony.

The judge had earlier adjourned the hearing till 2pm. Before that, he had warned Cheema to take a decision regarding the oath-taking ceremony or else "the court will announce its verdict", asserting that the governor had "no justification" to delay the oath.

Punjab Advocate General Ahmed Owais argued that he had met the governor on court orders and the two of them discussed some objections over administering oath to Hamza.

"In the absence of the governor, the speaker of the Punjab Assembly had the responsibility to administer the oath.
"But Hamza hasn't named the speaker as respondent in his petition," he argued.

When the judge asked whether the governor had given any reason for not administering the oath, Owais replied that the governor believed the chief minister's election was against the law and the Constitution. "The governor is not a rubber stamp or post office. The Punjab governor has taken an oath and he has to abide by the Constitution," the advocate general said.

He said he wanted to submit a detailed written response to the court because of the seriousness of the matter.
Justice Bhatti, however, remarked, "If it was so important, you would have prepared for your arguments. You just come to court to take dates." The judge then dismissed the advocate general's request to adjourn the hearing, saying that the governor had to respond.

'Cheema to write letter to President Alvi'​

The LHC chief justice further observed that for the past 21 days, the province had been functioning without a government. "The system has come to a stop. What is the governor doing?

"If he doesn't want to administer the oath, tell us. The law will pave its own way forward," he said, adding that it was the only way to protect the province.

The advocate general informed the court that he had met Cheema recently, who he said was writing a letter to President Dr Arif Alvi about all the reasons for not administering oath to Hamza.

The judge then questioned what the governor had been doing for the past five days. "When will he send the reasons? I have postponed three hearings because of the lack of a government. The Punjab government's response was needed but there was no government in the province."

At this point, the advocate general reassured the court that the letter would be sent soon and no one would be allowed to go beyond constitutional limits.

"But when? Exactly when?" Justice Bhatti grilled Owais, remarking that the court could "not see the system being destroyed".

"I can't give an exact time," Owais replied. "He will write it either today or tomorrow ... as per the Constitution, the governor is not accountable to the court."

Subsequently, the judge remarked that delaying the oath was a violation of the Constitution and adjourned the hearing till 2pm.

Governor denies oath to Hamza​

At a press conference earlier this week, Cheema had declined to administer oath to Hamza stating that the Punjab Assembly secretary's report, the LHC's instructions and the facts presented to him raised questions on the validity of the chief minister’s election.

"I have written to the Punjab advocate general and the Punjab Assembly speaker to seek their opinion on the assembly secretary's report, LHC directions and other facts to make up my mind whether to hold the oath-taking ceremony at the Governor House or not," he had said, adding that he could not endorse anything beyond the ambit of the Constitution.
Following Cheema's presser, a news item quoting PML-N central spokesperson Maryam Aurangzeb came to light, where she claimed that the governor had been removed from his office by Prime Minister Shehbaz Sharif using his discretionary powers.

The governor had, however, rejected the claim, saying he held a constitutional office and would continue to hold it. "Only the president of Pakistan has the power to de-notify a governor, which has yet not been done," he had asserted.

In his three-page report, the Punjab Assembly secretary stated that the deputy speaker had entered the house with his personal guards as well as his Punjab police detail, who manhandled the parliamentarians. Later, he stated, the deputy speaker called the deputy commissioner and DIG Operations summoned a heavy contingent of police. He stated that he explained that no other than the sergeants-at-arms could perform any duty on the floor of the house.

The assembly secretary stated that the deputy speaker conducted the election process from the Officers’ Box with a megaphone, which was contrary to the Assembly Rules and Procedures.

The principal secretary to governor, however, immediately wrote to him that the assembly secretary’s report had been found one-sided, biased and politically motivated and added that he (the secretary) had no power under any provision of the Constitution, the law or the Rules of the Punjab Assembly 1997 to call into question the declaration of the result by the deputy speaker, who was duly authorised by the Lahore High Court to conduct the election for the office of chief minister.

The principal secretary had added that no power was vested in the governor under the Constitution or any law to set aside the election on any grounds whatsoever...

Senate Chairman to administer oath to Hamza Shahbaz today after Governor Punjab hospitalised



LAHORE – President Dr Arif Alvi has appointed Senate Chairman Sadiq Sanjrani as his representative to administer the oath to Punjab Chief Minister-elect Hamza Shahbaz Sharif after Governor Sarfraz Cheema has been hospitalised.

Reports in local media said the Chairman of the Senate has already arrived in the Punjab capital where the oath-taking ceremony would be held at the Governor House while Prime Minister Shehbaz Sharif is also expected to attend the event.

Earlier, Chief Justice Lahore High Court Ameer Bhatti ordered President Alvi to nominate a representative to administer the oath to the chief minister-elect. The court ruled that the governor cannot refuse to administer the oath.

PML-N officials moved court after Cheema refused to administer the oath to Hamza Shehbaz citing ‘legal reasons’. PTI stalwart after holding a meeting with his constitutional experts' team, said Hamza’s election was not ‘legal’.

The former ruling party appears to be adamant in its stance against accepting Hamza as the new face of the most populous region.

In the latest event amid the oath crisis, the Punjab Governor was now shifted to Lahore hospital over gastroenteritis. The medical team at Services Hospital examined Cheema’s health and conducted a few medical tests, per reports.

The Lahore High Court (LHC) on Friday directed National Assembly Speaker Raja Pervez Ashraf to administer the oath to Punjab Chief Minister-elect Hamza Shehbaz tomorrow (Saturday) at 11:30am.

Justice Jawad Hassan issued the nine-page written order after earlier reserving the verdict. The PML-N leader had sought the court's intervention for a third time over his oath-taking process and had filed a petition seeking the administration of oath to him by "a person nominated by the court" owing to the "defiant attitude" of President Arif Alvi and the province's governor, Omar Sarfraz Cheema.

At the outset of the hearing, Justice Hassan asked about the order passed by the LHC CJ. Subsequently, Hamza's counsel, Khalid Ishaq, read the order out loud and told the court that the president and the Punjab governor were blatantly violating the Constitution.

Justice Hassan remarked that no one should have the audacity to flout the court's directives. "This concerns the respect of the high court and Pakistan's judiciary," he said.

He also regretted the fact that two orders passed by the high court were not implemented, adding that he would make a decision based on the Constitution.
Hamza's lawyer told the court that LHC had issued directives for holding the chief minister's election. He added that the governor was refusing to administer the oath to the chief minister-elect in contravention of the court's directives.

When the hearing continued after a short break, Justice Hassan asked why the petitioner had not made the president and the Punjab governor respondents in the case. At this, Hamza's lawyer replied by saying there was no need to make them respondents in the case.

Meanwhile, Punjab Additional Advocate General Umair Niazi contended that proceedings could only move forward once the Punjab advocate general was issued a notice under Article 27-A of the Constitution.

"The Punjab governor has sent the matter to the president. How can he administer the oath when the matter is with the president?" he asked.

He told the court that the Senate chairman could also administer the oath. "But according to my information, he is currently not in the country," he said. He added that the president or the Punjab governor could administer the oath or appoint a representative to do the same.

The court had reserved the verdict after hearing the arguments.

Hamza files third petition​

This was the third time that Hamza — who was elected as Punjab's chief executive on April 16 during a provincial assembly session marred by mayhem — sought LHC's intervention over his oath-taking process as the Punjab governor continues to refrain from administering oath to him, questioning the validity of his election, and President Alvi is yet to nominate another individual to perform the duty, as directed by the high court earlier.

In a petition filed on Friday, Hamza contended that the governor and president had proved themselves to be "guided by whims and fantasies instead of law and Constitution" by refusing to abide by the court's orders on his previous two petitions.

The PML-N leader had first approached the court after Cheema refused to administer oath to him. After hearing the arguments, the court had instructed President Alvi to appoint a representative to administer the oath in the absence of the governor.

However, after further delay by the president, Hamza had moved the court again on April 25. This time, he had asked the LHC to instruct Senate Chairman Sadiq Sanjrani to administer oath to him. In his ruling, LHC CJ Ameer Bhatti had directed Governor Cheema to complete Hamza's oath-taking process by April 28.

In the third petition submitted today, the CM-elect said: "No heed has been paid to the direction issued by the constitutional court and the governor and president are harping on the same looney tunes of their purported notions which have already been condemned and deprecated as transgression of constitutional mandate."

The conduct and actions of the governor and the president were "contemptuous and treasonous" as they held in abeyance the constitutional provisions and mandate by unconstitutional means, the petition stated.

"Such blatant contemptuous conduct requires the initiation of proceedings under Article 6 and Article 204 of the Constitution ahead of all other actions."

Hamza also highlighted that Punjab had been functioning without an active government for nearly a month now and pleaded the court to "end the constitutional crisis".

"Article 199(1)(C) empowers this honourable court to enforce fundamental rights. The judicial branch has long been described as the 'balancing branch' and our courts are the balance wheels of our entire constitutional system," he said.

Subsequently, the CM-elect requested that his petition be taken up on the above mentioned grounds in the interest of justice, equity and in order to restore constitutional functioning of the province.

"Kindly direct the administration of oath to the chief minister-elect by a person nominated by this honourable court at the Governor House at a specified time and the coercive arm of the state be set in motion for implementation of the orders of this honourable court," the petition prayed.

It added that the defiant attitude of Cheema and President Alvi should be declared to be "utter and blatant violations of the Constitution".
