An anti-Islam Florida pastor who was arrested last year on his way to burn 3,000 Korans showed up in Polk County court Tuesday morning wearing a “NUKE ISIS” T-shirt.

Pastor Terry Jones was arrested driving near Tampa and charged with illegally transporting fuel on his way to perform the stunt that outraged Muslims across the world.

A judge dismissed the charge, but now the state is asking if a higher court will approve for him to be charged again, a local Fox affiliate reported.

“I am definitely surprised. … The judge reviewed it. The judge threw it out,” Mr. Jones told the station. “They know they didn’t have any kind of chance from the very beginning, and they are just continuing to drag it out — I think just trying to wear us down.”

A defiant Mr. Jones faced the court Tuesday wearing a T-shirt that said “NUKE ISIS.”

A felony conviction of illegally carrying fuel would prohibit Mr. Jones from being able to carry a gun. The preacher said he has received several death threats and needs the gun for protection, the Fox affiliate reported.
