It's too ridiculous to invoke Article 62 & 63." - Imran Khan

I already explained in one of my previous posts how NS was disqualified; NS accepted in court that he is the Chairman in FZE, and is elgible for salary. Court said ok we consider this an asset, to which you have accepted ownership infront of us, and it was not declared in your nomination papers - hence you are not 'truthful'/'Sadiq' in declaring all your assets in your nomination forms and considered disqualified. I dont see the opposite of 'innocent until proven guilty' being used to disqualify NS here.

He was disqualified because he was unable to dispel the allegation. He could not back it up with the evidence in regards to his accounts for money.

That being said, not single concrete evidence prosecutor provided against the accused party throughout the entire proceeding.

In article 62/63, the platform falls on the accused party to dispel the accusation transcending above the concept of innocent until proven guilty.

So in the fictional example I provided in my last post, your neighbor in such an accusation will be considered guilty? And using a similar petition Shahbaz Sharif can also be accused to be the father of Sita whites child, and when he is not able to provide a DNA test to prove his innocence he will also be disqualified ... as according to you burden of proof should be on Shahbaz Sharif now to prove he is not the actual father. If that is the case then my friend this is CHAOS!!!

The Article 62/63 applies to the candidates from the political party campaigning for the leadership through the democratic, not Tom, Heckle, Jerry that have nothing to do with the political party.

So, that falls on Shabhaz Sharif, Imran Khan and any political leaders in the category of Article 62/63 as character testament. It is no longer fictional example when Article 62/63 can be used to validate the theory into reality.

And if he is not able to provide the evidence [DNA test] to dispel the allegation, then he might face the same fate as Nawaz Sharif just did even though prosecutors failed to provide concrete evidence throughout the entire proceeding.

It is accused party that failed to dispel the allegation hence disqualified. Precisely the same way Imran Khan can be disqualified if taken to the court as well. And 'innocent until proven guilty' won't fly with the Article 62/63. I know that sounds absurd but after Article 62/63 has been just used to disqualify Nawaz Sharif can prove double-edge sword for Imran Khan now.

Article 62/63 can apply in many ways as character testament but for Imran Khan, i am sure his opposition party will use Sita card to make the case in the court which under the act of Article 62/63 not only the court will take the case but can implement the decision if proven that Imran Khan is father or failure for Imran Khan to dispel allegation can seal the fate of Imran Khan as well.

One stone = two birds for the main establishment. Main establishment had poor history with Nawaz Sharif given the military takeover and Imran Khan due to his pro-stance on TTP. So naturally, Imran Khan is goner since Article 62/63 can be used to tackle some element that is threat to the foreign policy of the main establishment. I didn't see that coming. Checkmate from the main establishment. :D
