India has said it will not use an anti-piracy law to try two Italian marines accused of killing two Indian fishermen in 2012.

The government told the Supreme Court that the law, which carries the death penalty, would not apply in the case. The marines will still be tried - but under less stringent criminal laws.

India's decision to use the anti-piracy law led to a diplomatic row with Italy.

Last week, Rome recalled its ambassador to India over the issue.

The Italian foreign ministry said Daniele Mancini would return home because of "yet another unacceptable, deliberate delay" after a hearing in the Supreme Court was postponed.

The Italian government also asked the UN and European Union to intervene in the continuing dispute with India.

The marines - Massimiliano Latorre and Salvatore Girone - were guarding an Italian oil tanker when they opened fire, killing two men off the Kerala coast. The marines said they mistook the fishermen for pirates.

They are on bail pending trial, and are living and working at the Italian embassy in Delhi.

On Monday, Indian attorney general Ghoolam Vahanvati told the Supreme Court that the prosecution did not intend to proceed against Mr Latorre and Mr Girone under the anti-piracy section of the Suppression of Unlawful Acts (SUA).

"We want to delete the anti-piracy clause," he said. Mr Vahanvati did not give any reason.

Although India had previously ruled out the possibility of a death penalty, its decision to invoke the anti-piracy law had angered Italy.

The diplomatic spat has dragged on since Mr Latorre and Mr Girone were first detained on suspicion of murder in February 2012.

Although they were allowed to go home to vote in elections a year ago, Rome initially refused to send them back, arguing the case should take place in Italy as the incident took place in international waters.

The men eventually returned to Delhi in March 2013.

I'll be surprise to see an Indian on this thread. The leader of India is Italian. So she definitely have a tender heart for her own country.

Some one is too excited with this news.But that excitement will wind down easily.
Reasons:Supreme Court will decide fate of NIA involvement .After all SC ordered NIA to probe this case.
If NIA is not allowed then a new agency need to start the investigation again.
Now Italian expectations for releasing Marines before election will not happen.SC may delay this case again due to NIA involvement problem.Not certain.
I dont think Sonia Gandhi involved in these case.Because A Bofors scandal gave enough hate against Sonia.If she again
do that .Indians will kick out her from India.
Finally an election is coming ,If Congress loosened their rope here then their is no return.Kerala is one of few statesCongress still hope.If these case is against them Congress will completely perished in next election in kerala.
These measures will may reduce noise for now.But their release before election will not happen

I would favour this,they weren't pirates. Not that they should be let free,they should have some years behind the bars and a good compensation must be paid to the dead fisherment.

Had the government not instructed the NIA to investigate, this drama would not have happened. The police would have investigated. They would have charged the case under IPC or CrPC and we could have gone ahead with life. But, the idiots in the law and home ministries were sleeping when they handed it over to the NIA, without understanding the repercussions of the same.

Now, they will be filed under the IPC where there will be case of Section 307 and/or Section 302. This should have been the course of action from day one, instead of handing over to the NIA which is an anti terror organisation.

Diplomacy is all about give and take while making sure that we keep the ties intact.

Obviously the right decision. It was stupid to charge them under anti piracy laws. They should have been charged under the plain old CrPC, of manslaughter. Or culpable homicide, or whatever it is. Now hoepfully the law will take the right course.

BTW this has nothing to do with diplomacy. Even if it was an Indian who shot the fishermen, it would be the Indian penal codes that apply, not SUVA laws or anti piracy laws.

I know it's a good opportunity for the usual trolls to paint it as 'india crumbling' and all that bullshit, but hey - trolls will be brainless trolls.

It's stupid to put piracy charges on them. They weren't 'pirates' for sure.

I have no idea why they even tried. It's well known that the marines were protecting the ship and not inolved in piracy. Guess they just wanted to give the Italians the third degree.

Italy seems to have a lot more diplomatic power than I thought.

Prosecuting serving soldiers under Anti-Piracy was untenable especially since they were serving under the direct order of the govt. of Italy.

However this should have been dropped before this news became public and italy created a scean.

But on the other hand maybe it was designed to give the Italians some sort of victory before the sentencing. Diplomacy is hard to figure out and India plays the game quite well.
