Aug 23, Colombo: India, Pakistan, and China have refused to provide information to the United Nations team appointed by the High Commissioner for Human Rights Navi Pillay to probe the alleged human rights violations during the conflict in Sri Lanka, according to a local newspaper report.

These three countries have supplied arms and technical assistance to the Sri Lankan government for the Wanni offensive against the Tamil Tiger terrorists, the online edition of Sinhala daily The Divaina reported Saturday.

The report further said these three countries have not accepted the UN probe and the refusal by to provide necessary information by them has seriously subjected the Commission to a difficult situation.

The High Commissioner for Human Rights has earlier said that the UN team will seek information from outside Sri Lanka and visiting Sri Lanka is not necessary to conduct an effective investigation into the alleged war crimes.
She also noted that Sri Lankan media reports have spread false information to discredit the UN inquiry.

Aug 19, Colombo: Sri Lanka will not allow the United Nations team investigating alleged war crimes committed during the last seven years of the three-decade long armed conflict with Tamil Tiger terrorists, President Mahinda Rajapaksa said Tuesday.

The President said the team of UN investigators appointed by the High Commissioner for Human Rights Navi Pillay will not be allowed into the country.

"We will not allow them into the country," Rajapaksa told the Foreign Correspondents' Association, when he met the journalists at Temple Trees today.

He said that any cases of people missing, or any other allegations of crimes committed during the war had to be investigated through the local panel as he took measures to strengthen the domestic investigation mechanisms.

Earlier the President announced the appointment of two more members to the panel advising the domestic Commission appointed by him to probe the disappearances of persons during the conflict (see below).

This is the first time the President has directly announced Sri Lanka's refusal to allow the UN investigators.

"We do not accept the probe. We are against it," the President said adding that Sri Lanka will not cooperate with the UN Human Rights Council.

Sri Lankan government has refused to accept the probe mandated by the UN Human Rights Council and maintains that it is an unnecessary and unethical intrusion into the island nations' sovereignty.

The President however, assured that Sri Lanka will fully cooperate with the other UN agencies.

"However, we continue to engage with the UN system. We have not walked out like some other countries," President Rajapaksa said.

The decision not to disclose the names of persons who give evidence before the Panel is totally unfair as Sri Lanka will not get an opportunity to cross examine them, Minister of External Affairs Prof. G L Peiris said.

"They are judges in their own cause. We do not recognize the jurisdiction or authority to do this investigation in the first place", he said.

"Sri Lanka could not accept such a prejudiced investigation. The UNHRC has not been known for its consistency and they changed decisions due to political reasons. Many member countries are disillusioned over this", Minister Peiris added.

Earlier this month Pillay said visiting Sri Lanka is not necessary for the United Nations to conduct an effective investigation into the alleged war crimes in response to Sri Lankan government's defiant stance that it will not allow any international investigator to enter the country to collect evidence.

"There is a wealth of information outside of Sri Lanka which can be tapped into," Pillay has said.

Sri Lankan government strongly criticized Pillay's remarks as a clear indication of personal bias.

"It is evidence of an attempt to influence the investigation process and make it follow a preconceived trajectory," the External Affairs Ministry said displaying the deep mistrust Sri Lanka placed in the High Commissioner.

"Prejudice and lack of objectivity on issues pertaining to Sri Lanka displayed by the High Commissioner Pillay in the past are unfortunate," the Ministry said.

However, the office of the High Commissioner, in a recent statement said the OHCHR Investigation on Sri Lanka, based in Geneva will continue to seek to engage with the Sri Lankan government.

Aug 19, Colombo: Sri Lankan President Mahinda Rajapaksa has appointed two more members to the panel of international experts advising the Presidential Commission Investigating Cases of Missing Persons in Sri Lanka.

The two appointees are Indian human rights activist Avdash Kaushal and a Pakistani law expert Ahmer B. Soofi.

President Rajapaksa announced the appointment of the two experts in a message to the micro blog site Twitter.

Kaushal is a human rights and civil liberties activist heading a non-governmental organization called Rural Litigation and Entitlement Kendra (RLEK) in India while Ahmer Bilal Soofi is an advocate of the Supreme Court of Pakistan and an international law expert.

Sri Lankan President Mahinda Rajapaksa on July 15th appointed three internationally renowned legal luminaries - Sir Desmond de Silva, Sir Jeffrey Nice and Professor David Crane - to serve on the Advisory Council to the Commission of Inquiry.

It is good decision of these three countries.
China and Pakistan were always with us in the past. Hope, it will remain strong in future too.
The most appreciable thing is BJP government's positive stance towards the region including SL.

  • You need not be apprehensive about hot heads in Sri Lanka and in Tamil Nadu. We Indians are with you Sri Lankans to ensure that violent evil forces of the past do not rear their ugly and violent heads again.
  • The Narendra Modi government in Delhi will, I discern from available authoritative documents, approach the Indo- Sri Lanka Relations within the following new framework:
  • India will regard all its SAARC neighbours, including Sri Lanka, as of priority concern in bilateral relations, with due regard for their special sensitivities and internal issues.
  • India will not try to fetter the sovereignty of any neighbouring state in its dealings with its internal problems and in its international relations.
  • India will not support in any issue of the UN Charter, including in matters of human rights, an intrusive probe into the conduct of a duly elected democratic government.
  • India will always place its own national interest above any of its internal provincial, linguistic, or religious demands in framing its foreign policy.
  • India will defend any of its SAARC neighbours from any terrorist insurgency if such a help is sought.
  • India foster economic union, freer travel, and cultural bonding with its neighbours, and with East Asia in general.

There's no need for peace and stability to be upended in South Asia just because of some spurious HRV allegations.
Navi Pillay's behavior is highly doubtful.
Her claims against the government of Sri Lanka has been criticized over the claim that she acts as per the pro-western ideology and inquires only about the last part of the civil war in the country, completely missing out the initial 30 years of the civil war that was prevailed. specially the obvious human right violations by the LTTE against the civilians of Sri Lanka (mainly against Tamils, Sinhalese and Muslims). Many argue that her support towards the Tamil Diaspora ideology against the government of Sri Lanka is due to her ethnicity of being a Tamil. During her visit to Sri Lanka in 2013 she has been accused of trying to place a flower wreath at the Memorial of the late LTTE Terrorist leader Velupillay Prabakaran, which was objected by the local authorities as an act of promoting terrorism.

UN teams only probe small countries, never had the guts to probe US and Israel and even India in Kashmir

You should ask that question from Navi Pillai. She is the one who accused SL and said things like this.

Despite the many differences, many Asian countries are coming closer and closer. Must be the result of the 'Look East' policies that many Asian countries have adopted.
